THE TEMPORARY LOCATION OF THE KAY COUNTY COURT CLERK'S OFFICE IS 801 W. SOUTH ST IN NEWKIRK. THIS IS THE OLD DHS BUILDING LOCATED ON THE CURVE AS YOU ENTER TOWN FROM THE SOUTH. 


Responsibilities

Responsibilities of the Court Clerk’s Office are as follows:

  • Blood Test: Oklahoma law does not require a premarital blood test.
    • Waiting Period: No waiting period required except for those under the age of 18, there is a 72 hour waiting period.
  • Civil: Legal actions that are not criminal in nature are considered civil actions
    • CJ: are cases of $10,00 or more
    • CS: are cases of $10,000 or less
    • CV: are cases not requesting money judgment (examples: Driver’s license appeals, Name changes)
    • SC: are cases of money judgments and evictions $10,000 or less
    • Forms to initiate a small claims action are available in the Court Clerk’s office.
  • Criminal: Felony and Misdemeanor cases
  • Jury Service: You have been chosen by random selection from Oklahoma Driver’s Licenses. You will be given a date certain to appear for Jury Orientation.
  • Marriage Licenses:
    • Age 18 and older: proof if age is required, driver’s license, birth certificate or passport
    • Age 16 to 17: Parental consent of either parent of legal guardian, birth certificate
    • Under 16: Is prohibited in this state except by court order.
  • Ministers’ Credentials: By law those preforming marriage ceremonies in the State of Oklahoma must record their credentials with the Court Clerk’s Office. Ministers who live outside Oklahoma who desire to preform marriage ceremony in our state must file their credentials with the Court Clerk prior to conduction the service. No fee is required.
  • Passports: All applicants must appear in person, including children. We accept passports between the hours of  8a.m. to 3 p.m. 
  • Payment of fines, fees and court costs in criminal cases
    • Court ordered criminal assessments are due at the time of sentencing, unless Cost Administrator provides a defendant with a payment plan as sanctioned by the sentencing Judge. Defendants must appear in person to the cost administrator as ordered by the sentencing Judge.
    • No appointments are made and defendants are seen on a first come, first serve bases

    • We accept: cash, money orders, cashier’s check or payment by phone with a credit or debit card
    • We do not accept personal checks
  • Traffic: Citations given by Oklahoma Highway Patrol and Kay County Sheriff’s departments are filed in the District Court.
    • Notice: All costs and fines must be paid in full on or before the court appearance date.
    • Payment: Cash, Cashier’s Check, Money order, Credit or Debit card and Personal Checks
