The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, January 13, 2014, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on January 10, 2014, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Tyson Rowe called the meeting to order.  Those present were as follows: Dee Schieber, Member; Brian Hermanson, District Attorney; Harold Hughs, Kay County Detention Center (KCDC); Everette Van Hoesen, Kay County Sheriff; Christy Kennedy, Kay County Treasurer; Carol Purdy, Kay County Assessor; Dennis Bonewell, Kay County Emergency Management; Cheryl Howard, Kay County Election Board Secretary; Penny Ennis, Kay County District No. 2; Marilee Thornton, Kay County Court Clerk; Ray Ball, Kaw Nation; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Secretary/Kay County Clerk (see sign in sheet).  Absent:  Steve Austin, Member.

 

Chairman Tyson Rowe led the Flag Salute.

 

Motion was made by Schieber and seconded by Rowe approving regular meeting minutes of January 6, 2014.  Motion carried:  Rowe, aye; Schieber, aye.

 

Motion was made by Schieber and seconded by Rowe electing Tyson Rowe as Chairman of the BOCC for 2014.  Motion carried:  Rowe, aye; Schieber, aye.

 

Jail Director Report:  Harold Hughs, KCDC, presented an Acting Director’s Report; he reported 245 as the daily inmate count, 61 arrested and released over the weekend, 112 arrested and released for the week, 44 Department of Corrections, 19 sentenced to county time and six (6) contract beds. 

 

Hughs said in the Justice Facilities Authority (JFA) meeting held on Friday, January 10, 2014, the Jail Director position was offered to Don Jones who has served as the JFA Jail Consultant since approximately 2007.  He praised Jones for his knowledge and expertise in this field.

 

Hughs mentioned the Fire Inspector had been to the jail and reported it was too hot; he said inmates had covered a couple of the vents and noted no other instances were reported.    

 

Motion was made by Schieber and seconded by Rowe approving Application for Financial Assistance/County Burial and Affidavit of Financial Inability to Pay.  Motion carried:  Rowe, aye; Schieber, aye.

 

Motion was made by Schieber and seconded by Rowe approving the following Agreements between BOCC and subscribers for remote terminal capabilities in the Assessor’s office:  Fidelity National Title Group; Ponca City Development Authority; City of Newkirk; First National Bank of Oklahoma; Simply Unique; Meyer-MacDonnell Insurance; Redbud Appraisal Service, LLC; Bivin & Associates, Inc.; Hartzog, Conger, Cason & Neville, LLP; G & C Concrete Co.; Simplified Ins. & FS; Mark Estep, State Farm Agent; The Myers Agency, Inc.; Farmers Exchange Bank; Ngaly Wells, State Farm Insurance Agency; McKenzie-Noles Agency Inc.; Nicholson Auction & Real Estate; Baumert, Cummings & Hiatt; Earl Ball Insurance Agency, Inc.; The Blackwell Zinc Smelter Settlement; State Farm Insurance Co.; City of Tonkawa; Arcadis US Inc..  Motion carried:  Rowe, aye; Schieber, aye.

 

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge Projects:  Commissioner Rowe said crews will be blading all roads all week, work continues on Braman Rd. and bridge west of Tonkawa, Bridge 180 drive pilings, cover culverts in town of Nardin and hauling rock.

 

Commissioner Schieber said his crews will be blading, cutting trees, hauling sad and putting in 10-12 pipes. 

 

Motion was made by Rowe and seconded by Schieber approving Right-of-Way Public Utility and Encroachment Agreement and Resolution No. 13, 14-142, to underwrite the acquisition of right-of-way in connection with the construction of a public project known as CIRB-136D(161)RB, 25084(04) Const., (03) Util., (02) R/W in accordance with the terms and tenor of 69 O.S. 2001, Section 1205, 1206, 1401 and 1403.  Rowe noted this project is for a bridge south of Nardin.  Motion carried:  Rowe, aye; Schieber, aye.

 

Motion was made by Rowe and seconded by Schieber rescinding motion made to go out on bid for a HMC SP-100 Vibratory Pile Drivers in BOCC meeting on January 6, 2014.

Motion carried:  Rowe, aye; Schieber, aye.

 

Motion was made by Rowe and seconded by Schieber approving to go out on bid for HMC SP-80 Vibratory Pile Drivers (new or used), Dist#3.  Motion carried:  Rowe, aye; Schieber, aye. 

 

Motion was made by Schieber and seconded by Rowe noting the following Kay County Offices December 2013 Monthly Reports:  County Clerk; Assessor; Election Board; Sheriff.   Motion carried:  Rowe, aye; Schieber, aye. 

 

Motion was made by Schieber and seconded by Rowe approving the following Resolutions for Disposing of Equipment:  Res#13, 14-141, Court Clerk, Scanner, returning to AOC; Res#13, 14-143, Court Clerk, Scanner, returning to AOC; Res#13, 14-144, Assessor’s Office, Ten Key Calculator, junked; Res#13, 14-146, Sheriff Department, Monitor, junked; Res#13, 14-147, Sheriff Department, Computer, junked.  Motion carried:  Rowe, aye; Schieber, aye. 

 

Motion was made by Schieber and seconded by Rowe approving the following Resolutions to Deposit Funds:  Res#13, 14-145, Highway-$60,562.89, D#1-$18,050.18, FEMA DR4064 PA-4064 PW10-95 #2714 SP Voucher 00056466; D#2-$8,841.35, PA-4064 PW 14-64 #2714 SP Voucher 00056467; D#3-$33,671.36 PA-4064 PW65-120 #2714 SP Voucher 00056471.  Motion carried:  Rowe, aye; Schieber, aye.

 

Motion was made by Schieber and seconded by Rowe to approve the following Cash Fund Estimate of Needs & Request for Appropriations:  Highway-$60,562.89, D#1-$18,050.18; D#2-$8,841.35; D#3-$33,671.36; Preservation Fee-$4,085.00; County Sales Tax-$357,611.24; Use Tax-$40,453.33; Public Buildings Authority-$1,408.84; Public Buildings Authority-Health-$93.56.  Motion carried: Rowe, aye; Schieber, aye.

Unscheduled Public Appearances:  Commissioner Schieber introduced Colt Donaldson, Ponca Tribe.

 

Heather Roquemore, Oklahoma Court Services, was not present to report on the number of community service hour’s defendants are working the projects they are involved in.
