Kay County Courthouse

Newkirk, OK 

 

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, November 25, 2013, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on November 22, 2013, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Tyson Rowe called the meeting to order.  Those present were as follows: Steve Austin, Member; Dee Schieber, Member; Brian Hermanson, District Attorney; Marilee Thornton, Kay County Court Clerk; Christy Kennedy, Kay County Treasurer; Jody Burd and Harold Hughs, Kay County Detention Center (KCDC); Everette Van Hoesen, Kay County Sheriff; Cheryl Howard, Kay County Election Board Secretary; Larry Klumpp, OSU Extension Agent; Dennis Bonewell, Emergency Management Director; Ray Ball, Kaw Nation; Scott Cloud, Newkirk Herald Journal;  Tammy Reese, Secretary/Kay County Clerk (see sign in sheet). 

 

Chairman Tyson Rowe led the Flag Salute.

 

Motion was made by Austin and seconded by Schieber approving regular meeting minutes of November 18, 2013.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Jail Director Report:  Jody Burd, KCDCD, reported 217 as the daily inmate count, 33 arrested and released over the weekend and 108 for the week; 33 Department of Corrections and 13 county inmates.

 

Motion was made by Austin and seconded by Schieber to rebid Carpet for the DHS Building (bids were opened in BOCC meeting on 11-18-13) because the low bidder did not include in amount to furnish full-width carpet equal to five percent of amount installed, packaged with protective covering for storage, and identified with labels clearly describing contents, before installation begins which was in the bid specifications.  Austin stated that particular specification will not be included when rebid.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Schieber and seconded by Austin approving going out to bid annual ballots for County Election Board.  Motion carried:   Rowe, aye; Schieber, aye; Austin, aye.

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge Projects:  Commissioner Rowe said crews are hauling material around Tonkawa and Blackwell, changing out horns and working on blacktop.

 

Commissioner Schieber said his crews are mowing, trimming trees and stock piling rock.

 

Commissioner Austin stated his crews are mowing, trimming trees and stock piling.  He mentioned crews are also hauling sand north and east of Newkirk.

 

Motion was made by Austin and seconded by Schieber approving amending holiday dates for the calendar year 2014, noting the dates of December 25 and 26, 2014 the courthouse will be closed instead of December 24 and 25, 2014.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the following Public Service/Pipeline Crossing Line Installations:  SandRidge Exploration & Production, NE4/NE4 S25 T29N R2W ending NW4/NW4 S30 T29N R1W, 60th Str., D#3; SandRidge Exploration & Production, SW4/SW4 S30 T29N R1W ending SE4/SE4 S25 T29N R2W, 60th Str., D#3.   Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

Motion was made by Austin and seconded by Schieber noting the following Kay County Monthly Reports for October 2013:  Sheriff; Court Clerk – Newkirk; Ponca City; Blackwell.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the following Resolutions for Disposing of Equipment: Res#13, 14-120, Court Clerk, filing cabinet – transfer to Drug Court  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving the following Resolutions to Deposit Funds:   Res#13, 14-115, Child Abuse Prevention-$68.25, jury donations; Res#13, 14-116, Highway Dist#3-$1,000.00, Two (2) Pipeline Crossing Line Installation; Res#13, 14-117, Highway Dist#3-$300.00, sale of truck bumper & tractor tire; Res#13, 14-118, Highway Dist#3-$1,423.00, sale of scrap metal; Res#13, 14-119, Highway Dist#3-$1,000.00, Line 1-30H Permit.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

There were no Unscheduled Public Appearances made. 

 

Motion was made by Austin and seconded by Schieber approving to enter into Executive Session pursuant to and convened under authority of 25 O.S. Section 307 (B)(4) to discuss litigation and settlement in Western District of Oklahoma Case #CIV-12-601 C.  (9:26 a.m.).  Motion carried: Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving to reenter regular meeting of the BOCC (10:10 a.m.).  Motion carried: Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Austin and seconded by Schieber to approve the terms and conditions described in, and to execute, the settlement document as presented to the Commissioners and previously executed by the other parties including, but not limited to, the Settlement Agreement and Release, Escrow Agreement, Deed, License Agreement and Lease Agreement, authorize Ryan Whaley Coldiron Shandy to file the Joint Stipulation of Dismissal as presented to the Commissioners, and authorize Tyson Rowe to take any further actions, and to execute any additional documents, that may be necessary or required with regard to the settlement.   Motion carried: Rowe, aye; Schieber, aye; Austin, aye.
