Kay County Courthouse

Newkirk, OK

 

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, October 28, 2013, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on October 25, 2013, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Tyson Rowe called the meeting to order.  Those present were as follows: Steve Austin, Member; Dee Schieber, Member; Brian Hermanson, District Attorney; Marilee Thornton, Kay County Court Clerk; Carol Purdy, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Jody Burd, Kay County Detention Center (KCDC); Everette Van Hoesen, Kay County Sheriff; Dennis Bonewell, Emergency Management Director; Larry Klumpp, OSU Extension; Tamra Cunningham, Oklahoma Court Services; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Secretary/Kay County Clerk (see sign in sheet). 

 

Chairman Tyson Rowe led the Flag Salute.

 

Motion was made by Austin and seconded by Schieber approving regular meeting minutes of October 21, 2013 and special meeting minutes of October 25, 2013.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Report was given by Tamra Cunningham from Oklahoma Court Services (OCS):  Ms. Cunningham reported 657 hours were completed with 113 client’s submitting community service hours.  She mentioned Humane Society has one of their work days.  Ms. Cunningham said OCS is going through some exciting changes; OCS has made new completion letters for the courts and will be monitoring sanctioned community service hours for the District Attorney.

 

Jail Director Report:  Jody Burd, KCDC, reported 211 as the daily inmate count, 48 arrested and released over the weekend; 33 Department of Corrections and four (4) county inmates.  He presented the BOCC with a handout showing more numbers.

 

Motion was made by Austin and seconded by Schieber approving an approximately 12.4 acres for a gun range for the Sheriff’s Department.  Before the motion was made, Sheriff Van Hoesen presented the BOCC with a design and layout of the 10 Target gun range.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Austin and seconded by Schieber approving to go out on bid for carpet for the DHS Bldg. in Newkirk.  Before motion was made, Commissioner Austin said he went to look at the carpet and noted it was stained with holes and felt it was time to update.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the re-appointment of Fred Horinek and Milton Leseman to the Kay County Floodplain Board.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving adoption of revised floodplain maps for Kay County (Res#13, 14-100).  Before the motion was made, Dennis Bonewell, Emergency Management Director, said there were changed to the floodplain mapping and this process is completing is finalizing that all the proper procedures were followed.

Motion was made by Austin and seconded by Schieber approving the regular meeting dates of the BOCC for Calendar Year 2014.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin designating dates as Holiday/dates the Kay County Courthouse offices will be closed for Calendar Year 2014.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Austin and seconded by Schieber approving Cooperative Extension Services Agreement between the Oklahoma State University acting for and on behalf of its Cooperative Extension Service and The United States Department of Agriculture and The BOCC for the period of July 1, 2013 through June 30, 2014.   Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge Projects:  Commissioner Rowe said he had a box structure fall in on Bridge on 92nd Street.  He noted repairs are being made.  Rowe mentioned an accident that occurred on 92nd Street and said work is in progress to take care of bad spots on the road.  He said crews are blading and working on a bridge on the Braman Road.

 

Commissioner Schieber noted Title Pages have been signed to do an overflow structure on Hubbard Rd. at Chikaskia River Improvements.  He mentioned he would attending a meeting regarding right-of-ways, speaking at a Town Hall meeting in Norman about BIA Projects and he would attending the ACCO Conference in Norman.  Schieber said crews continue to blade and mow.

 

Commissioner Austin mentioned his crews are hauling rock, patching bad spots in roads and mowing intersections.

 

Motion was made by Austin and seconded by Schieber designating Tyson Rowe as the Kay County Official, Dee Schieber as first alternate and Steve Austin as second alternate to the CED#8 Board.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Rowe and seconded by Schieber approving environmental check list for Deer Creek CIRB Project, Dist#3 (County Res#13, 14-97).  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving the following Resolutions for financial assistance from the Rural Economic Action Plan (REAP) Fund:  Res#13, 14-94, Nardin Overlay Road Project; Res#13, 14-95, Highland Garden Overlay Road Project.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving Interstate 40 Crosstown Steel Beam Transform Form to Noble Co., NBI#07045.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving the following Public Service/Pipeline Crossing Line Installations:  Trek Resources, Inc., SE4/SW4 S15 T29N R1W ending NE4/NW4 S22 T29N R1W, Judd Rd., D#2; Rural Water Dist#5 (RWD), SE4/SE4 S23 T29N R1E ending NE4/NE4 S26 T29N R1E, Peckham Rd., D#2; RWD#1, SW4/SW4 S6 T27N R3E ending NW4/NW4 S7 T27N R3E, Hubbard Rd., D#1; Sandridge E&P, NE4/NE4 S25 T29 R2 ending NW4/NW4 S30 T29 R1, N. 60th Str., D#2.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving Title Page for Hubbard Rd & Chikaskia River overflow structure.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber noting the following September 2013 Monthly Reports:  County Health; Sheriff.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Schieber and seconded by Austin approving the following Resolutions for Disposing of Equipment:  Res#13, 14-90, Hwy. Dist#1, Dell Opti Plex 755, junked; Res#13, 14-93, Court Clerk, Clock, junked.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.   

 

Motion was made by Austin and seconded by Schieber approving the following Resolutions to Deposit Funds: Res#13, 14-91, Hwy. Dist#3-$462.80, sale of scrap & $1.00-permanent easement; Res#13, 14-92, Hwy. Dist#2-$500.00, Public Service/Pipeline Crossing Line Installations.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin to approve the following Cash Fund Estimate of Needs & Request for Appropriations:  Highway Dist#2-$500.00; Highway Dist#3-$463.80; County Sales Tax-$47,284.31; County Sales Tax-$5,103.35; Sheriff’s Service Fee-$14,093.61.  Motion carried: Rowe, aye; Schieber, aye; Austin, aye.  

 

Motion was made by Schieber and seconded by Austin approved the following Transfer of Appropriations:  Highway Dist#3 Maintenance & Operations (M&O)-$509.40 to M&O Hwy. Dist#1; Highway Dist#3 M&O-$3,722.33 to ETR Bridge #189; Highway Dist#3 M&O-$35,000.00 to Hwy. Dist#1 M&O (Schieber asked to change from Capital Outlay as noted on Agenda to M&O).  Motion carried: Rowe, aye; Schieber, aye; Austin, aye. 

 

There were no Unscheduled Public Appearances.

Bid#2013-39 Tractor with diamond boom mower, D#3 were opened as follows:  Boxcer Equipment-No Bid; Grissoms/John Deere-new tractor and mower-$85,657.18 and used tractor and mower-$$38,650.00; Yellowhouse Machinery Co.-No Bid; Frontier Equipment-No Bid; P&K Equipment, Inc.-$70,000.00; Van Keppel Co.-No Bid.

 

Motion was made by Rowe and seconded by Austin to accept the bid from P&K Equipment, Inc. in the amount of $70,000.00 on Bid#2013-39 Tractor with diamond boom mower, D#3.  Motion carried: Rowe, aye; Schieber, aye; Austin, aye.
