Kay County Courthouse

Newkirk, OK

 

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Tuesday, October 15, 2013, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on October 11, 2013, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Tyson Rowe called the meeting to order.  Those present were as follows: Steve Austin, Member; Dee Schieber, Member; Brian Hermanson, District Attorney; Marilee Thornton, Kay County Court Clerk; Carol Purdy, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Harold Hughs, Kay County Detention Center (KCDC); Everette Van Hoesen, Kay County Sheriff; Dennis Bonewell, Emergency Management Director; Cheryl Howard, Kay County Election Board; John Williamson, Newkirk Citizen; Ray Ball, Kaw Nation; Jerry Putnam, Putnam & Company, PLLC; Tammy Reese, Secretary/Kay County Clerk (see sign in sheet). 

 

Chairman Tyson Rowe led the Flag Salute.

 

Motion was made by Austin and seconded by Schieber approving regular meeting minutes of October 7, 2013.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Jail Director Report:  Harold Hughs, KCDC, reported 209 as the daily inmate count, 43 arrested and released over the weekend; Hughs noted the maximum number of inmates for this month as being 211. 

 

Motion was made by Schieber and seconded by Austin approving Agreements between the BOCC and the following for remote terminal capabilities in the Assessor’s Office:  McCarty & Rigdon; Moyer MacDonnell Insurance.   Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge Projects:  Commissioner Rowe said he drove his roads this morning and found them to be in good shape.  He said crews are hauling rock and trimming trees on blind intersections since the roads are too wet to work.

 

Commissioner Schieber said crews are doing routine maintenance.

 

Commissioner Austin mentioned his crews are working on repairs and maintenance.  He said as soon as roads are dry crews will begin preparing roads for the winter months.

 

Motion was made by Austin and seconded by Schieber approving to pay National Association of Counties Membership (NACo) dues in the amount of $931.00.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Rowe and seconded by Austin approving ETR Contract and application.  Rowe said funds are being withheld because of the federal government shutdown so he is using ETR support.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving to go out for bid to purchase a 2008 or newer 6430 premium John Deere Tractor with diamond boom mower, 50” head, Dist#3.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

No action was taken on Deer Creek Title Page for Dist#3.

 

Motion was made by Austin and seconded by Schieber approving the following September 2013 Monthly Reports:  County Clerk; Treasurer; Election Board; County Health; Assessor.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the following Resolutions to Deposit Funds: Res#13, 14-85, Highway Dist#3-$9,857.66, Road rock, labor & equipment hours billed for road repairs; Res#13, 14-86, Highway Dist#3-$9,857.66, Road rock, labor & equipment hours billed for road repairs.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber to approve the following Cash Fund Estimate of Needs & Request for Appropriations:  Highway Dist#3-$9,857.66; Highway Dist#3-$9,857.66; Treasurer Mortgage Certification-$615.00; Public Buildings Authority-Health-$114.40; Drug Court-(-$2,479.17); County Sales Tax-$343,863.72; Use Tax-$46,992.30; Visual Inspection Reimbursement-$748.09; CBRI 105C-$29,408.24.  Motion carried: Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approved the following Transfer of Appropriations:  County Sales Tax JFA Personal Service-$8,000.00 to ST-Part Time; Overtime-$754.90 to ST-Part Time; Maintenance & Operations(M&O)-$25,000.00 to Capital Outlay; Use Tax M&O-$20,000.00 to Capital Outlay.  Motion carried: Rowe, aye; Schieber, aye; Austin, aye. 

 

Unscheduled Public Appearances:  Newkirk Citizen John Williamson expressed his concerns in Dist#1 & #2 regarding weight limit signs.  He questioned how farmers were to get hay out of the fields and cattle buyers down these roads with the weight limit signs and asked who he should contact with these questions.

 

Motion was made by Austin and seconded by Schieber approving Blanket Purchase Orders.  Motion carried: Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Schieber and seconded by Austin approving Maintenance & Operations claims.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

FY 2013/2014 PURCHASE ORDERS:  

               

 

Details’ concerning the above listed purchase orders/claims are available in the County Clerk’s Office.  All records are open to the public, and any person may examine same during regular office hours. 

 

BOCC opened Bid#2013-38, Selling Caterpillar Excavator Model 325DL.  Bids were opened as follows:  Frontier Equipment-No Bid; Van Kepple Company-No Bid; Kirby-Smith Machinery, Inc.-No Bid.  No action was taken since all bids opened were “no bids.”

 

The remaining portion of the BOCC meeting was jointly held with the Kay County Excise Board to finalize budget matters.

 

Motion was made by Schieber and seconded by Austin approving Kay County General Fund Budget Fiscal Year 2013-2014.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Schieber and seconded by Austin approving Kay County 2013-2014 Estimate of Needs and Financial Statement of the Fiscal Year 2012-2013.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

 

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting. None.
