Kay County Courthouse

Newkirk, OK

 

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, October 7, 2013, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on October 4, 2013, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Tyson Rowe called the meeting to order.  Those present were as follows: Steve Austin, Member; Dee Schieber, Member; Brian Hermanson, District Attorney; Marilee Thornton, Kay County Court Clerk; Carol Purdy, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Jody Burd and Harold Hughs, Kay County Detention Center (KCDC); Steve Kelley & Bill Grose, Kay County Sheriff Department; Dennis Bonewell, Emergency Management Director; Cheryl Howard, Kay County Election Board; Kristi Wooley, Oklahoma Juvenile Affairs; Ray Ball, Kaw Nation; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Secretary/Kay County Clerk (see sign in sheet). 

 

Chairman Tyson Rowe led the Flag Salute.

 

Motion was made by Austin and seconded by Schieber approving regular meeting minutes of September 30, 2013 and special meeting minutes of October 3, 2013 and October 4, 2013.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving Oklahoma Juvenile Affairs claim for July 2013-$2,280.81 and August 2013-$1,475.91.   Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Jail Director Report:  Jody Burd, KCDCD, reported 201 as the daily inmate count, 41 arrested and released over the weekend, 31 Department of Corrections and seven (7) county inmates.

 

Motion was made by Austin and seconded by Schieber approving 2014 Highway Safety Office Grant Agreement.  Bill Grose said this grant is helping work drunk driving.   Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Schieber and seconded by Austin approving purchasing a juvenile transport van from Davis Moore for the Sheriff’s Department out of the Use Tax Account. (Steve Kelley said Davis Moore price of $19,609.00 with fleet was lower than the state bid price of $20,990.00).  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Weight limit signs:  Discussion was made regarding weight limit signs and trafficking/patrolling such signs.

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge Projects:  Commissioner Rowe said Fountain Road from I-35 to the Nardin Billings Road has been rocked, opening Hubbard Rd. today, blading, mowing and hauling shell to repair bad spots in roads.

 

Commissioner Schieber said crews are blading, mowing, hauling sand, cleaning out ditches and finishing up “S” Street.

 

Commissioner Austin mentioned his crews are mowing, blading and hauling rock on various roads.  He mentioned Kay Electric took out some trees and county crews are cleaning up and working on water problem areas.

 

Motion was made by Rowe and seconded by Schieber approving Public Service/Pipeline Crossing, Select Service, NE4/NE4 S11 T25N R2W ending SE4/SE4 S35 T25N R2W, 76th, Fountain, Riverview, White Eagle, Cowboy Hill and County Line Rd., Dist#3.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Rowe and seconded by Austin approving Title Page for the Tonkawa Tribe Road Project, Dist#3.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the following September 2013 Monthly Reports:  Treasurer.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving the following Resolutions to Dispose of Equipment:  Res#13, 14-84, Court Clerk, several computers, monitors, printers, etc., AOC picked up & replaced.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving the following Resolutions to Deposit Funds: Res#13, 14-83, Highway Dist#3-$1,750.00, Public Service/Pipeline Crossing.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin to approve the following Cash Fund Estimate of Needs & Request for Appropriations:  Highway-$64.87, D#1-$21.62; D#2-$21.63; D#3-$21.62; Highway Dist#3-$1,750.00; County Clerk Lien Fee-$1,325.00; County Clerk Preservation Fee-$4,775.00; Public Building Authority-$1,408.84.  Motion carried: Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approved the following Transfer of Appropriations:  Highway Dist#3 Maintenance & Operations (M&O)-$30,000.00 to Highway Dist#1 Capital Outlay; Highway Dist#3 Personal Services-$22,293.04 to M&O; Highway Dist#3 M&O-$30,000.00 to Capital Outlay.  Motion carried: Rowe, aye; Schieber, aye; Austin, aye. 

 

Unscheduled Public Appearances:  Undersheriff Steve Kelley said he would be attending a Courthouse Security Seminar in Austin, Texas the last week of October.  He said this seminar will evaluate the courthouse for the best kind of security needed and help determine what is best for Kay County Courthouse.

Motion was made by Austin and seconded by Schieber approving to enter into Executive Session pursuant to and convened under authority of 25 O.S. Section 307(B)(4) to discuss litigation in Western District of Oklahoma Case #CIV-12-601-C with counsel (9:42 a.m.).  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Austin and seconded by Schieber approving to reenter regular meeting of the BOCC (10:01 a.m.).  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

Motion was made by Schieber and seconded by Austin approving and authorizing Chairman Rowe to sign settlement term sheet in settlement of case, if appropriate.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

No action was taken on Kay County General Fund Budget Fiscal Year 2013-2014. 

 

No action was taken on Kay County 2013-2014 Estimate of Needs and Financial Statement of the Fiscal Year 2012-2013.

 

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting. None.
