Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, September 30, 2013, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on September 27, 2013, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Tyson Rowe called the meeting to order.  Those present were as follows: Steve Austin, Member; Dee Schieber, Member; Brian Hermanson, District Attorney; Marilee Thornton, Kay County Court Clerk; Carol Purdy, Kay County Assessor; Jody Burd and Harold Hughs, Kay County Detention Center (KCDC); Dennis Bonewell, Emergency Management Director; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Secretary/Kay County Clerk (see sign in sheet). 

 

Chairman Tyson Rowe led the Flag Salute.

 

Motion was made by Austin and seconded by Schieber approving regular meeting minutes of September 23, 2013.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Austin and seconded by Schieber approving Application for County Burial and Affidavit of Financial Inability to Pay.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Jail Director Report:  Jody Burd, KCDCD, reported 212 as the daily inmate count, 53 arrested and released over the weekend, 34 Department of Corrections.  Burd noted staying on top of maintenance jobs is more challenging with the number of inmates increasing.

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge Projects:  Commissioner Rowe said crews are setting beams on a bridge south of Hwy. 60, hauling rock and materials to roads, stock piling in the Braman, Blackwell and Tonkawa areas and getting roads in condition for winter.  He mentioned problems on 44th Street and noted there would be a detour route.

 

Commissioner Schieber said crews are blading Brake Road and noted asphalt should be done today on Hartford.

 

Commissioner Austin mentioned his crews are mowing, blading and hauling rock on various roads. 

 

Motion was made by Rowe and seconded by Austin approving Public Service/Pipeline Crossing, Select Service, NW4/NW4 S12 T25N R2W ending SE4/SE4 S35 T25N R2W, 76th Str., Dist#3.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Schieber and seconded by Austin approving  Public Service/Pipeline Crossing, International Energy Corp., SW4/NE4 S25 T25N R1E ending SE4/SE4 S24 T25N R1E, White Eagle Rd., Dist#1.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the following Resolutions to Deposit Funds: Res#13, 14-77, Highway Dist#3-$392,221.16, BIA Reimbursements for Tonkawa Bridge Projects FY12/13-($107,180.31 & $285,040.85); Res#13, 14-78, Highway Dist#1-$155,286.20, BIA Reimbursement for Oakland Bridge #145 FY13/14; Res#13, 14-79, Highway Dist#1-$12,987.00, BIA Reimbursement fort Oakland Bridge #145 FY13/14; Res#13, 14-80, Highway Dist#1-$9,483.50, BIA Reimbursement for Hartford/McFadden Reconstruction Project; Res#13, 14-81, Highway Dist#3-$1,500.00, Public Service/Pipeline Crossing; Res#13, 14-82, Highway Dist#1-$500.00, Public Service/Pipeline Crossing.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber to approve the following Cash Fund Estimate of Needs & Request for Appropriations:  Highway Dist#1-$155,286.20;Highway Dist#1-$12,987.00; Highway Dist#1-$9,483.50; Highway Dist#1-$42.71; Highway Dist#1-$500.00; Highway Dist#3-$392,221.16; Highway Dist#3-$1,500.00; CBRI 105C-$19.43; Sheriff’s Service Fee-$16,934.66; County Sales Tax-$5,610.88; County Sales Tax-$53,720.72; County Improvement-$0.18; Public Buildings Authority-Pioneer Technology Center-$0.68; Public Building Authority-Tonkawa Public Schools-$0.54; Drug Court-$11,025.00.  Motion carried: Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approved the following Transfer of Appropriations:  Assessor Visual Inspection Maintenance & Operation (M&O)-$1,000.00 to VI Travel; (Highway Dist#2 Bridge 42-$11.36 to M&O; Highway Dist#2 Bridge 247-$0.15 to M&O; Highway Dist#2 Personal Service-$23,000.00 to M&O-all on same Transfer).  Motion carried: Rowe, aye; Schieber, aye; Austin, aye. 

 

There were no Unscheduled Public Appearances.

 

Motion was made by Austin and seconded by Schieber approving Blanket Purchase Orders.  Motion carried: Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Schieber and seconded by Austin approving Maintenance & Operations claims.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

FY 2013/2014 PURCHASE ORDERS:  

               

 

Details’ concerning the above listed purchase orders/claims are available in the County Clerk’s Office.  All records are open to the public, and any person may examine same during regular office hours. 

 

Motion was made by Austin and seconded by Schieber approving to enter into Executive Session pursuant to and convened under authority of 25 O.S. Section 307(B)(4) to discuss litigation in Western District of Oklahoma Case #CIV-12-601-C with counsel (9:46 a.m.).  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Motion was made by Austin and seconded by Schieber approving to reenter regular meeting of the BOCC (10:40 a.m.).  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

No action was taken regarding litigation in Western District of Oklahoma Case #CIV-12-601-C.

 

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting. None.
