Kay County Courthouse

 The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, April 22, 2013, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on April 19, 2013, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Tyson Rowe called the meeting to order.  Those present were as follows: Steve Austin, Member; Dee Schieber, Member; Brian Hermanson, District Attorney (DA); Marilee Thornton, Kay County Court Clerk; Carol Purdy, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Everette Van Hoesen, Kay County Sheriff; Jody Burd, Kay County Detention Center Director (KCDCD); Harold Hughs, KCDC; Cheryl Howard, Kay County Election Board Secretary; Larry Klumpp, OSU Extension Agent; Kristi Woolley, Oklahoma Juvenile Affairs (OJA); Ray Ball, Kaw Nation; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet).

Motion was made by Austin and seconded by Schieber approving regular meeting minutes of April 15, 2013.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving Oklahoma Juvenile Affairs Claim for March 2013 in the amount of $2,270.07.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Jail Director Report:  Jody Burd, KCDCD, reported 165 as the daily inmate count, 45 arrested and released over the weekend and 31 in Department of Corrections (DOC).  He said inmates have been picking up trash around the community and will continue to do so. 

 

Motion was made by Austin and seconded by Schieber approving Detention Services Agreement by and between Sac and Fax Nation and the BOCC of Kay County, $21.11 a day per child.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge projects:  Commissioner Rowe said crew is working on North Main and noted beams are set and ready to pour concrete; he noted 44th Street will be shut down for two days.

 

Commissioner Schieber said his crews are blading roads and preparing for the weather coming in.

 

Commissioner Austin noted the concrete box that had been vandalized is being fixed.  Crews are blading roads and bridge crew poured the west abutment on Peckham Road bridge and are currently forming the east abutment. 

 

Motion was made by Rowe and seconded by Schieber approving BIA Title Page Project B0710141.  Note:  Title Page was not presented in meeting but Rowe said it was standard.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving to go out on bid to sell a 1999 Dixon ZTR Mower 16 HP Kohler Engine 42” Cut, Model 4516.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving the Letter of Support on HB 1080.  Austin said letter was similar to the letter from Kaw Tribe.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin noting the following Kay County Monthly Reports for March 2013:  Sheriff; Treasurer; Assessor.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving the following Resolutions to Dispose of Equipment:  Res#12, 13-267, Highway Dist#3, John Deere mower, traded; Res#12, 13-268, Highway Dist#3, Camera, junked; Res#12, 13-269, Court Clerk, Canon scanner, sent back to AOC.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving Supplemental Appropriations to General Government Maintenance & Operations (M&O) money from State of Oklahoma-Civil Emergency Performance Grant funds October 1 thru December 31, 2012.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving the following Resolutions to Deposit Funds:  Res#12, 13-264, Highway Dist#2-$4,692.00 (corrected from agenda that read $20,060.00); DIST#3-$28,060.00 (corrected from agenda that read $4,692.00), sale of equipment at Elk City auction; Res#12, 13-265, Highway Dist#3-$8,805.90; sale of scrap metal-$660.00, share of cooperative’s margin-$9.68, Insurance settlement on road damage, Nationwide Retirement-$50.00, Total-$8,805.90; Res#12, 13-266, Open Dump Reward-$200.00, December 2012 & February 2013 Newkirk reward fees.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the following Cash Fund Estimate of Needs & Request for Appropriations:  Highway-$32,752.00, Dist#2-$4,692.00; Dist#3-$28,060.00; Highway Dist#3-$8,808.90; Open Dump Reward-$200.00; Visual Inspection Reimbursement-$1,717.41; Public Building Authority-Health-$168.01; CBRI 105-$27.06; Highway-$25.41, Dist#1-$10.48; Dist#3-$14.93l County Improvement-$0.18; Public Building Authority-Pioneer Technology Center-$0.74; Public Building Authority-Tonkawa Public Schools-$0.59.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving the following Transfer of Appropriations:  County Clerk Personal Service-$3000.81, Part-time-$4,940.05, Capital Outlay-$5.00 to Travel-$945.00 and M&O-$7000.86; Data Processing Personal Service-$6,295.00, Capital Outlay-$5.00 to M&O-$6,300.00.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Unscheduled Public Appearances:  DA Brian Hermanson made an open invitation to a tree planting ceremony to be held at 10 a.m. in front of the courthouse in memory of crime victims and those who provide services to victims of crime.

 

Gayle Hobaugh, Blackwell citizen, pointed out there was not a fair election process of nominations held at the Blackwell Township Red Cross Building regarding recent fair board elections.  She said time was not given to nominate and commented it should be made fair to all parties.

 

Carrie Adams, Blackwell citizen, also attended the fair board election held at the Blackwell Township and she reiterated Ms. Hobaugh in saying time was not given to make a nomination.  She said the board closed the floor for nominations – ceasing nominations.  Ms. Adams said the third nominee’s name was not even announced.  She presented a video of the election to the BOCC for review.

 

DA Brian Hermanson made those in attendance aware of the fact the BOCC could not make any comments.
