Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, February 25, 2013, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on February 22, 2013, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Tyson Rowe called the meeting to order.  Those present were as follows: Steve Austin, Member; Dee Schieber, Member; Brian Hermanson, District Attorney (DA); Carol Purdy, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Everette Van Hoesen, Kay County Sheriff; Jody Burd, Kay County Detention Center Director (KCDCD); Harold Hughs, KCDC; Cheryl Howard, Kay County Election Board Secretary; Dennis Bonewell, Emergency Management Director; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet). 

 

Chairman Tyson Rowe led the Flag Salute.

 

Motion was made by Austin and seconded by Schieber approving regular meeting minutes of February 19, 2013.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

DA Hermanson said National Crime Victims’ Rights Week is the week of April 22nd.  Hermanson asked BOCC for permission to plant a Victim’s Tree on the front lawn of the Kay County Courthouse and mentioned he tried to contact Karen Dye, Newkirk Main Street to discuss the placement of the tree. He said during this week victims may tie a ribbon on the tree.  Hermanson said he e-mailed Secretary of Agriculture Jim Reese to see how to obtain a sapling from the Survivor trees that were planted from the Oklahoma City bombing and was told saplings are given out April 19th.  Hermanson said he would like for the tree to be planted on a Monday morning on April 22, 2013.

 

Motion was made by Schieber and seconded by Austin approving and allowing DA Hermanson to plant a Victim’s Tree on the front lawn of the Kay County Courthouse.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.

 

Jail Director Report:  Jody Burd, KCDCD, reported 132 as the daily inmate count, 41 arrested and released over the weekend 42 Department of Corrections (DOC). 

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge projects:  Each of the three commissioners said they were getting prepared for the weather situation moving in.

 

Motion was made by Schieber and seconded by Austin approving and accepting bid offer from Duit Construction Co., Inc. on Bid#2013-16, Roller Compacted Concrete & Stabilization, Dist#1 (bid opened in BOCC meeting February 11, 2013).  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin entering into an Agreement between Kay County Board of County Commissioners and Cowan Group Engineering, LLC for engineering services which include survey right of way staking and utility relocation management services.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving the following Public Service/Pipeline Crossing Line Installations:  Select Service, NW4/NW4 S26 T25N R1W ending SW4/SE4 S13 T25N R1W, White Eagle-“O” Str. On Riverview, D#3; Mustang Gas Products, LLC, SE4/SW4 S24 T25N R1W ending NE4/NW4 S25 T25N R1W, D#3.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the following Resolutions to Dispose of Equipment:  Res#12, 13-211, Treasurer, file server, junked.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye.  

 

Motion was made by Austin and seconded by Schieber approving the following Resolutions to Deposit Funds:  Res#12, 13-207, Highway Dist#3-$500.00, Public Service/Pipeline Crossing Line Installation; Res#12, 13-208, Highway Dist#3-$500.00, Public Service/Pipeline Crossing Line Installation; Res#12, 13-209, Highway Dist#2-$40,566.27, Devon River Road Project; Res#12, 13-210, Highway Dist#2-$2,039.40, sale of scrap metal.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the following Cash Fund Estimate of Needs & Request for Appropriations:  Highway-$112.04, D#1-$14.16; D#3-$28.34 & $69.54; Highway Dist#2-$40,566.27; Highway Dist#2-$2,039.40; Highway Dist#3-$500.00; Highway Dist#3-$500.00; CBRI 105C-$28.44; Public Building Authority-Pioneer Technology Center-$0.86; Public Building Authority-Tonkawa Public School-$0.68; County Improvement-$0.18.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the following Transfer of Appropriations:  Sheriff’s Service Fee Maintenance & Operations-$2,000.00 to Overtime; Highway Dist#1 Maintenance & Operations-$572.75 to Kildare Paving REAP Grant Project.  Motion carried:  Rowe, aye; Schieber, aye; Austin, aye. 

 

Unscheduled Public Appearances:  Undersheriff Steve Kelley introduced the new courthouse security deputy, Andy Jones, to the BOCC and told his past working experiences.

 

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting.].  Chairman Tyson Rowe announced the courthouse would be closing today at noon and advised all to go home and stay home for safety precautions.  He said if the weather is as bad as predicted the courthouse would be closing on Tuesday as well.
