Kay County Courthouse

  The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Tuesday, November 13, 2012, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on November 9, 2012, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Dee Schieber called the meeting to order.  Those present were as follows: Steve Austin, Member; Tyson Rowe, Member; David Wilkie, First Assistant District Attorney (ADA); Everette Van Hoesen, Kay County Sheriff; Steve Kelley, Kay County Undersheriff; Mike Landis, Kay County Sheriff office; Jody Burd, Kay County Detention Center Director (KCDCD); Harold Hughs, Kay County Detention Center; Larry Klumpp, OSU Extension; Kristi Woolley, Oklahoma Juvenile Affairs; Rick Buellesfeld, Kay County Free Fair; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet). 

 

Chairman Dee Schieber led the Flag Salute.

 

Motion was made by Austin and seconded by Rowe approving regular meeting minutes of November 5, 2012.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Rowe and seconded by Austin approving Oklahoma Juvenile Affairs claim in the amount of $2,855.45 for September 2012.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Austin and seconded by Rowe approving to enter into a special meeting of the Kay County Home Finance Authority 9:02 a.m.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Rowe and seconded by Austin approving to reconvene into regular meeting of the BOCC 9:04 a.m.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Jail Director Report:  Jody Burd, KCDCD, reported 152 for the daily inmate count, 50 arrested and released for the weekend and 39 in Department of Corrections.

 

Motion was made by Austin and seconded by Rowe approving Sheriff Van Hoesen to sign Lease Agreement between Kay County Sheriff Department and City of Newkirk for the use of the existing firing range.  Mike Landis, Range Officer, explained it’s use.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving reimbursement claim from the State for Kay County Election Board Secretary salary in October 2012. Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge projects:  Commissioner Schieber said since there is moisture back on the roads crews would begin blading roads.

 

Commissioner Rowe reiterated and noted Bridge 196A would be opening today and crew would be moving one-half mile down the road to the next one.

 

Commissioner Austin said River Road at LA Cann would be closed and crew would be taking out box; he said there is a main sewer line located right under box.  Austin thought road could be opened in approximately seven (7) days.

 

Motion was made by Austin and seconded by Rowe approving amending six month Bid#2013-4 Grader Blades to include blades with ¾” holes.  Austin said new graders require bigger holes.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving to reject Bid#2012-45, County Bridge #42 on Peckham Road, Dist#2 (bid opened in meeting on 11-5-12).  Austin said bids came in $145,000.00 over what is available; Austin said he plans to speak with Donnie Head, CED#8, to review different options to reduce the cost and then will have to rebid.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving letter of demand from Kay County and ODOT regarding a fiber optic line from Ponca City to Blackwell.  Schieber explained this is a cable line and the owner of land this affects will not agree to move so this letter is needed for BOCC protection.  Schieber added the reasoning for this is because of making Hubbard to Waverly a four lane.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving the Preservation Agreement on Bird’s Nest Creek Bridge Structure 36E0280N3210003 upon the approval of the District Attorney’s office.  Rowe said this is a historical bridge and this agreement allows us to transfer to a private owner, Cornerstone Mart, L.L.C.  He noted Bureau of Indian Affairs will pay to have the bridge removed. Motion was made by Rowe and seconded by Austin approving Public Service/Pipeline Crossing Line Installations for Range Resources NE4/NE4 S25 T25N R1N ending NW4/NW4 S30 T25N R1E, CR 130, Dist#3.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving two (2) Public Service/Pipeline Crossing Line Installations for Superior Pipeline Co L.L.C.:  1) NE4/NE4 S15 T25N R2W ending NW4/NW4 S14 T25N R2W on South 92nd Street, 2) NE4/NE4 S16 T25N R2W ending NW4/NW4 S15 T25N R2W, Dist#3.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving two (2) Public Service/Pipeline Crossing Line Installations for Select Energy Services, 1) temporary water line, SW4/NE4 S13 T25N R2W, 2) SW4/NE4 S13 T28N R2W ending SW4/NE4 S6 T27N R2W, Dist#3.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe noting Sheriff’s Monthly Reports for August and September of 2012.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin noting the following October 2012 Monthly Reports:  County Clerk; Public Health; County Election.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving the following Resolutions to Deposit Funds:  Res#12, 13-116, Highway Dist#3-$4,750.00, Public Service/Pipeline Crossing Line Installations; Res#12, 13-117, Highway Dist#3-$1,000.00, Public Service/Pipeline Crossing Line Installations; Res#12, 13-118, Highway Dist#3-$1,500.00, Public Service/Pipeline Crossing Line Installations.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

Motion was made by Austin and seconded by Rowe approving the following Cash Fund Estimate of Needs and Request for Appropriations with noted correction:  Highway Dist#3-$4,750.00; Highway Dist#3-$1,000.00; Highway Dist#3-1,500.00; Sheriff’s Service Fee-$22,540.90 (corrected from Agenda that read $22,540.00); Use Tax Collections-$2,534.00; Public Buildings Authority-$1,408.84; Treasurer’s Mortgage Certification-$595.00.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye
