Kay County Courthouse

 The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, October 1, 2012, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on September 28, 2012, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Dee Schieber called the meeting to order.  Those present were as follows: Steve Austin, Member; Tyson Rowe, Member; David Willkie, Assistant District Attorney (ADA); Christy Kennedy, Kay County Treasurer; Marilee Thornton, Kay County Court Clerk; Carol Purdy, Kay County Assessor; Everette Van Hoesen, Kay County Sheriff; Cheryl Howard, Kay County Election Board Secretary; Larry Klumpp, OSU Extension; Donnie Head, Circuit Engineering District No. 8; Dusty Bittle, Yellow House Machinery; Steve Winters, Warren Cat; Ray Ball, Kaw Nation; Stephanie McDonald, Blackwell Journal Tribune; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet). 

 

Chairman Dee Schieber led the Flag Salute.

 

Motion was made by Austin and seconded by Rowe approving regular meeting minutes of September 24, 2012.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Rowe and seconded by Austin approving Oklahoma Juvenile Affair claim for August 2012 in the amount of $4,193.54.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving and authorizing Chairman Schieber to sign Reimbursement from State on Election Board Secretary Salary for September 2012.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

No Jail Director Report was given. 

 

Motion was made by Austin and seconded by Rowe approving Detention Services Agreement by and between Sac and Fox Nation and BOCC at the rate of $21.11 a day per child.   Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge projects:  Commissioner Rowe indicated the bridge on 76th Street should be opened by Tuesday or Wednesday, crew tearing out and driving piling on Bridge 204.

 

Commissioner Austin said he is doing regular road maintenance and Commissioner Schieber reiterated the same.

 

Motion was made by Austin and seconded by Rowe approving going out for bid on Bridge over Bois D’ Arc on Peckham Rd., Dist#2, Austin said this would be a BIA/County funded project.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving  Resolution No. 12, 13-82 on adopting the Five Year Plan with change on  Construction BIA Project CN 42 from $120,000 to $130,000 all the way through to year 2013.  Donnie Head, CED#8 went over the five year plan and all the specifics with BOCC.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

Motion was made by Schieber and seconded by Rowe approving Programming Resolution #12, 13-83, construction of new bridge structure to allow roadway to be raised to reduce flooding frequency on Hubbard Rd. EW18, NS 323.8 new bridge is 171 ft., Dist#1.   Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving the following Public Service/Pipeline Crossing Line Installations for PetroQuest Energy, LLC/Bravo Construction, Dist#3:  Trenching permit for gas line, 2-28N-2W to 3-28N-2W; Trenching permit for gas & water line, 3-28N-2W to 2-28N-2W; Trenching permit for gas & water line, SE/C 34-29N-2W to NE/C of 3-28N-2W; Boring permit for gas line, SW/C 3-28N-2W boring road to NE/C 9-28N-2W; bore permit for water & gas lines, 11-18N-2W boring road to 2-28N-2W.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

No action was taken on Resolutions for Disposing of Equipment:  Res#12, 13-94, County Clerk Data Processing, computer, monitor & keyboard, transferring to Major County Clerk; Res#12, 13-95, County Clerk Data Processing, computer, monitor & keyboard, transferring to Major County Clerk because the wording on the Agenda item did not allow for any action to be taken.

Motion was made by Austin and seconded by Rowe approving Officer’s Request for Supplemental Appropriations-$154.00, money being added to EMA Travel from State of Oklahoma, reimbursement for Lodging Expense (Purchase Order 205).  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

Motion was made by Austin and seconded by Rowe approving the following Transfer of Appropriations:  Health Maintenance & Operations (M&O)-$251.10 to Travel; Highway Dist#3 M&O-$1,600.00 to Personal Service; Highway Dist#1 Capital Outlay-$10,000.00 to M&O.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.   

 

Unscheduled public appearances:  Commissioner Austin announced there would not be a regular scheduled meeting next Tuesday, October 9, 2012. 

 

Motion was made by Austin and seconded by Rowe approving to enter into Executive Session pursuant to and convened under authority of Oklahoma Statutes Title 25 Section 307.B.4 to discuss litigation on Case No. CJ-2012-74, 9:50 a.m.   Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Austin and seconded by Rowe approving to reconvene regular meeting of the BOCC, 10:59 a.m.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

No action was taken regarding lawsuit on Blackwell Smelter Waste, Case No. CJ-2012-74.

 

Motion was made by Schieber and seconded by Austin rejecting bidders on Bid#2012-44, Roller Compacted Concrete Pavements (RCC), Dist#1 (bid originally opened in BOCC meeting on September 24, 2012).  Schieber said changes in specifications and provisions in the bid packet were needed; he said he would go back out to bid on October 15, 2012, with a start date of March 1, 2013.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Bid#2012-45, Lease with option to buy Motor Graders, Dist#2 was opened as follows:

Warren Cat-$255,950.00 with trade at 2.70% interest; Yellowhouse Machinery-$236,123.00 at 2.5% interest on a John Deere 672GP, $236,123.00 at 2.5% interest on a John Deere 770GP, $225,123.00 at 2.5% interest on a John Deere 770G, $225,123.00 at 2.5% interest on a 672G; Van Keppel-No Bid; Frontier Equipment-No Bid.

 

Motion was made by Austin and seconded by Rowe to accept bid on Bid#2012-45, Lease with option to buy Motor Graders, Dist#2, from Warren Cat in the amount of $255,950.00 with trade at 2.70% on a five year lease with option to purchase.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Austin and seconded by Rowe to rescind original motion on Bid#2012-45.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Austin and seconded by Rowe to accept bid on Bid#2012-45, Lease with option to buy Motor Graders, Dist#2, from Warren Cat in the amount of $255,950.00 with trade at 2.70% on a five year lease with option to purchase.  Austin said the resale value is much better and preferred Cat graders.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye
