Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, August 27, 2012, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on August 24, 2012, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Dee Schieber called the meeting to order.  Those present were as follows: Steve Austin, Member; Tyson Rowe, Member; Jennifer Layton, Assistant District Attorney (ADA); Christy Kennedy, Mary Ramey, Kay County Court Clerk; Marilee Thornton, Kay County Court Clerk Office; Carol Purdy, Kay County Assessor; Everette Van Hoesen, Kay County Sheriff; Jody Burd, Kay County Detention Center Director (KCDCD); Cheryl Howard, Kay County Election Board Secretary; Larry Klumpp, OSU Extension; Krisiti Woolley, Oklahoma Juvenile Affiars;  Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet). 

 

Chairman Dee Schieber led the Flag Salute.

 

Motion was made by Austin and seconded by Rowe approving regular meeting minutes of August 20, 2012.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Rowe and seconded by Austin approving Oklahoma Juvenile Affairs Claim for July 2012 in the amount of $2,607.90.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Jail Director Report:  Jody Burd, KCDCD, reported 204 for the daily inmate count, 53 arrested and released over the weekend and 112 for the week.  Burd mentioned he signed a temporary contract to hold federal inmates and noted there would be a little extra revenue with the contract. 

 

Motion was made by Austin and seconded by Rowe approving to enter into Executive Session pursuant to and convened under authority of Oklahoma Statutes Title 25 Section 307.B.1 to discuss appointment of Court Clerk (9:05 a.m.).  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving to reconvene back into BOCC regular meeting (9:08 a.m.).  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving appointment of Marilee Thornton to the position of Kay County Court Clerk to be effective September 4, 2012.  Thornton was elected Court Clerk after a primary race held on June 26, 2012.  Appointment being made due to Court Clerk Mary Ramey retiring.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Roads and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge projects:  Commission Schieber said crew will start sod and striping on the courthouse parking lot on Wednesday and hope to be finished by Friday.  He said he was wanting the burn ban removed from the counties that was set by Governor Fallin.  Schieber talked about upcoming meetings regarding the five year plan for ODOT Division 4 and the State CED meeting to be held on Wednesday.

 

Commissioner Rowe said half of the pilings were drove on Bridge 181 on 76th Street.  He said on the Nardin/Billings Road crew was drilling to see how deep to go for pipe filings.

 

Commissioner Austin said the guard rails were put on Bridge 34 and it should be opened Wednesday.

 

Motion was made by Austin and seconded by Rowe to noting the following monthly reports for July 2012:  Court Clerk-Newkirk, Ponca City, Blackwell; County Health.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

Motion was made by Rowe and seconded by Austin approving the following Resolutions for Disposing of Equipment:  Res#12, 13-53, Highway Dist#3, Hewlett Packard Digital Camera, junked.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Resolutions to Deposit Funds:  Res#12, 13-52, Highway Dist#1-$103,297.95, H3101-99 Prospect/Airport Bridge No.110 Road Project FY12-13 ($98,936.13 + $86.57 interest)/H3101-94 Washunga Bay Overlay Road Project ($4,7275.25).   Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Cash Fund Estimate of Needs and Request for Appropriations:  Highway Dist#1-$103,297.95; Highway-$301,202.73, D#1-$100,400.91; D#2-$100,400.91; D#3-$100,400.91; Highway Dist#1-$18.97; CBRI 105C-$120.14; County Improvement-$0.53; County Improvement-$0.17; County Sales Tax-$14,994.79.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe rescinding original motion.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Cash Fund Estimate of Needs and Request for Appropriations with noted correction:  Highway Dist#1-$103,297.95; Highway-$301,202.73, D#1-$100,400.91; D#2-$100,400.91; D#3-$100,400.91; Highway Dist#1-$18.97; CBRI 105C-$88.71 (corrected from Agenda that read $120.14); County Improvement-$0.53; County Improvement-$0.17; County Sales Tax-$14,994.79.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving the Transfer of Appropriations:  Preservation Fee Personnel Services-$454.53 to Maintenance & Operations(M&O); County Clerk Personnel Services-$1,893.83 to M&O.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Unscheduled Public Appearances:  Commissioner Schieber told Larry Klumpp, OSU Extension Agent, he needed to start advertising about the Kay County Free Fair.  Klumpp said advertising is being made; he noted there would be a free concert held Thursday, Friday and Saturday night, a free fairly large petting zoo and a wood carver would be new to the fair this year, plus being opened through Sunday.

A joint meeting was held with the BOCC, Excise Board and Kay County Officers to discuss budget matters.  Each officer presented their budget and estimate of needs requests.  Questions were asked accordingly.  No action was taken.

 

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting.].  None.
