Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, June 25, 2012, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on June 22, 2012, at 3:30 p.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Dee Schieber called the meeting to order.  Those present were as follows: Steve Austin, Member; Tyson Rowe, Member; Brian Hermanson, District Attorney (DA); Christy Kennedy, Kay County Treasurer; Everette Van Hoesen, Kay County Sheriff; Steve Kelley, Kay County Undersheriff; Mary Ramey, Kay County Court Clerk; Jody Burd, Kay County Detention Center Director (KCDCD); Larry Klumpp, OSU Extension; Dennis Bonewell, Emergency Management Director; Tiffany Davis, Oklahoma Court Services; Mike Anello, Blackwell Journal Tribune; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet). 

 

Chairman Dee Schieber led the Flag Salute.

 

Motion was made by Rowe and seconded by Austin approving regular meeting minutes of June 18, 2012.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving Contract for Supervision of Community Service by and between the BOCC and the Oklahoma Court Services, Inc.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Jail Director Report:    Jody Burd, KCDCD, said the current inmate count was 189; noting 52 were arrested and released over the weekend and 112 for the week. 

 

Motion was made by Rowe and seconded by Austin approving to enter into Executive Session pursuant to and convened under the authority of Oklahoma Statutes Title 25 Section 307.B.1, Discussing the employment, hiring, appointment, promotion, demotion, disciplining or resignation of any individual salaried public officer or employee,  Dennis Bonewell (9:05 a.m.).  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving to reconvene regular meeting of the BOCC (9:25 a.m.).  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

No action was taken regarding the employment, hiring, appointment, promotion, demotion, disciplining or resignation of any individual salaried public officer or employee, Dennis Bonewell.

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8: Commissioner Schieber reported it was hot, dry and dusty.

 

Commissioner Rowe said crew is pouring concrete on Bridge located on 92nd Street. 

 

Motion was made by Rowe and seconded by Austin approving Service and Price Agreement entered into by and between Alcohol and Drug Testing, Inc. and Kay County.  DA Hermanson commented regarding the wording in the Agreement “automatic renewal” noting he is usually not comfortable with that language because he would rather it read year-to-year.  However, because the agreement is locked in as a long-term agreement and it is a financial advantage for the county Hermanson approved as to form.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe Tabling Resolution No. 11, 12-244 (Amendment to Resolution No. 11, 12-91) whereas Kay County Use Tax Funds may be used for General Government operations of the county.  Commissioner Austin wanted to confirm with the auditor’s that this language would allow the county flexibility with use of the funds.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe noting the following Monthly Report of Officers for May 2012:  County Health; County Court Clerk-Newkirk/Ponca City/Blackwell.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Resolutions to Deposit Funds:  Res#11, 12-243, Child Abuse Prevention-$448.70, jury service donations; Res#11, 12-245, Highway Dist#2-$861.88, fuel for generators during power outage May31-June1,2012.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving the following Cash Fund Estimate of Needs and Request for Appropriations:  County Sales Tax-$35,705.88; Child Abuse Prevention-$448.70; Highway Dist#2-$861.88; Highway Dist#1-$70.00.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Transfer of Appropriations:  County Sales Tax JC Maintenance & Operations (M&O)-$30,000.00 to ST Personal Service; County Clerk Data Processing Travel-$112.31/Purchasing Capital Outlay-$5.00 to County Clerk Travel-$113.35/Data Processing Capital Outlay-$3.96; County Clerk Part-Time-$348.22/Purchasing Travel-$49.55/Purchasing M&O-$25.07 to County Clerk Travel-$422.84.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Unscheduled Public Appearances:  Christy Kennedy, Kay County Treasurer, reported that money received from the state in a “check” format will now be received by ACH an electronic format.
