Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, June 4, 2012, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on May 31, 2012, at 3:30 p.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Member Tyson Rowe called the meeting to order.  Those present were as follows: Steve Austin, Member; Christy Kennedy, Kay County Treasurer; Everette Van Hoesen, Kay County Sheriff; Jody Burd, Kay County Detention Center Director (KCDCD); Cheryl Howard, Kay County Election Board Secretary; Ray Ball, Kaw Nation; Glen Nichols, Evans & Associates;  Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  Chairman Dee Schieber, absent.  (See sign-in sheet). 

 

Member Tyson Rowe led the Flag Salute.

 

Motion was made by Austin and seconded by Rowe approving regular meeting minutes of May 29, 2012.  Motion carried:  Rowe, aye; Austin, aye. 

 

Jail Director Report:  Jody Burd, KCDC, reported the daily inmate count of 202.  He noted 39 were arrested and released over the weekend and 106 for the week.  Burd pointed out the May average for being arrested and released was 376 and a high on May 25th of 228 with currently 51 in Department of Corrections.  He said there were no major issues on May 31 and June 1, 2012, with the power outage due to recent storms. 

 

Motion was made by Austin and seconded by Rowe approving Contract-Canadian County Juvenile Detention and Kay County for Services at Canadian County Juvenile Detention Center, $19.31 per child per day.  Motion carried:  Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving Contract-Texas County and Kay County for Services at Texas County Juvenile Detention Center, $29.36 per child per day.  Motion carried:  Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving Agreement between BOCC and Patrick F. Fuller for remote terminal capabilities with the Assessor’s Office.  Motion carried:  Rowe, aye; Austin, aye. 

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Rowe mentioned that Commissioner Dee Schieber was in Oklahoma City at the State Capitol for the signing of the new transportation bill.

 

Commissioner Rowe noted that roads closed due to flood damage are now opened and noted work continues on the Wind Farm Project roads and should be finishing up soon.  He alerted drivers to be extra careful due to the amount of traffic.  He mentioned patch work and overlay will begin soon on 13th Street and working on Highway 60.

 

Commissioner Austin reported the north and south entrance of Traders Bend is closed and said crew is working on roads to get back in shape after all of the storms and rain.

 

Motion was made by Rowe and seconded by Austin approving the following Public Service/Pipeline Crossing Line Installation with Superior Pipeline Co., L.L.C., Dist#3:  NE4/NE4 S26 T25N R2W ending NW4/NW4 S25 T25N R2W; NW4/NE4 S26 T25N R2W ending SW4/SE4 S23 T25N R2W; NE4/NE4 S27 T25N R2W ending NW4/NW4 S26 T25N R2W; NE4/NE4 S28 T25N R2W ending NW4/NW4 S27 T25N R2W.  Motion carried:  Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Resolutions for Disposing of Equipment:  Res#11, 12-236, Dist#2-Two (2) Belly Dump CTS (corrected from Agenda that read Belly Dump CAT CTS); Mower Batwing Rhino; Hoist; Excavator 235 Caterpillar, sold.   Motion carried:  Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving Officer’s Request for Supplemental Appropriations; money is being added to General Government Courthouse Parking Lot (G2000-45)-$150,000.00, from Kay County Home Finance Authority.  Motion carried:  Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving the following Resolutions to Deposit Funds:  Res#11, 12-232A, Highway Dist#3-$104,141.36, Bridge #062 Blackwell Wind Farm Project-H3103-57; Res#11, 12-233, Highway Dist#1-$9,060.90, BIA Pecan North Road Project FY11-12 H3101-98; Res#11, 12-234, Highway Dist#1-$53,299.12, BIA Oakland Bridge#145 Project, H3101-145; Res#11, 12-235, Highway Dist#3-$300,000.00, Blackwell Wind Farm Project, H3103-57 (corrected from Agenda that read Bridge #062).  Motion carried:  Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Cash Fund Estimate of Needs and Request for Appropriations:  Highway Dist#1-$53,229.12; Highway Dist#1-$9,060.90; Highway Dist#3-$104,141.36; Highway Dist#3-$300,000.00;

Highway Dist#3-$2,500.00; Sheriff’s Service Fee-$1,619.20; Public Buildings Authority-$1,408.84.  Motion carried:  Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Transfer of Appropriations:  Treasurer Part-Time-$128.49/Personal Services-$207.65 to Travel-$137.79/Maintenance-$198.35.  Motion carried:  Rowe, aye; Austin, aye. 

 

Unscheduled public appearances:  Kay County Treasurer Christy Kennedy noted the June resale would be held next Monday.

 

Motion was made by Austin and seconded by Rowe to enter into Executive Session pursuant to and convened under authority of Oklahoma Statutes Title 25 Section 307.B.4 to discuss litigation on Case No. CJ-2012-74 BOCC v. Freeport-McMoran Copper & Gold Inc.; Freeport-McMoran Corporation formerly known as (f/k/a) Phelps Dodge Corporation; Cyprus AMAX Minerals Company; and Blackwell Zinc Co., Inc. (9:28 a.m.).  Motion carried:  Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving to reconvene regular meeting of the BOCC (10:05 a.m.).  Motion carried:  Rowe, aye; Austin, aye. 

 

No action or discussion was made regarding litigation on the Blackwell Smelter Waste.
