Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, April 16, 2012, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on April 13, 2012, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Dee Schieber called the meeting to order.  Those present were as follows: Steve Austin, Member; Tyson Rowe, Member; Brian Hermanson, Kay County District Attorney (DA); Christy Kennedy, Kay County Treasurer; Carol Purdy, Kay County Assessor; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Jody Burd, Kay County Detention Center Director (KCDCD); Larry Klumpp, OSU Extension; Cheryl Howard, Kay County Election Board Secretary; Tiffany Davis, Oklahoma Court Services; Jim Menzer, Menzer Law Offices, P.C.; Steve Lewis, Freeport; Ray Ball, Kaw Nation; Sharon Rowen, Ponca City News; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet). 

 

Chairman Dee Schieber led the Flag Salute.

 

Motion was made by Austin and seconded by Rowe approving regular meeting minutes of April 9, 2012.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Tiffany Davis, Oklahoma Court Services, presented the number of community service hour’s defendants worked showing 535 hours, showed illustration of Kildare Public School Auction and noted it was successful.

 

Jail Director Report:  Jody Burd, KCDCD, reported the daily inmate count of 172; he mentioned 87 were arrested and released and 45 were in DOC.  

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Rowe reported beams have been set on 108th Streets Bridge and hopes to pour floor in the next couple of days.  He discussed the Blackwell Wind Farm Project and said Brake Road/ 108th Street will be closed for around six weeks.

 

Commissioner Austin said crew poured bridge flooring on Bridge 29 on Bender Road and will begin putting up guardrail.  He mentioned he would be meeting with ODOT regarding upcoming projects.

 

Commissioner Schieber noted a CED meeting would be held this Wednesday in Alva and a school regarding right-of-ways will be held on the April 19th in Stillwater. 

 

Motion was made by Schieber and seconded by Austin approving Acknowledgement of Lease Assignment and Affidavit on Bid#2012-18, Used Motor Grader, Dist#1 (bid awarded on March 26, 2012).  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Motion was made by Rowe and seconded by Austin approving for Dist#3 Lease Purchase Agreement for Equipment on two CTS Belly Dump Trailers Serial No.’s 5TU114023CS000831 and 5TU114023CS001039, Total lease purchase price for both is $64,951.80 and Kaufman RGN Lowboy Trailer Serial No. 5VGFR4331CL0021011 Total lease purchase price-$53,907.60; Dist#1 two CTS Belly Dump Trailers Serial No’s 5TU114023CS001042 and 5TU114021CS000830 Total lease purchase price for both-$65,600.40; Schedule of Rental Payments; Certificate of Acceptance; Insurance Coverage Requirements; Opinion of Counsel; Certificate with Respect to Qualified Tax-Exempt Obligation; Acknowledgement of Receipt; Form 8038-GC.    Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Motion was made by Rowe and seconded by Austin approving to purchase two Belly Dump Trailers for Dist#3 (bid originally opened in 4-2-12 BOCC Regular Meeting) on Bid#2012-20 awarded to Irwin Trailers.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye.  

 

Motion was made by Rowe and seconded by Austin approving to go out for bid for an Ingersaw 84” Roller, Dist#3.  Rowe said this bid would be for one or more on a 2007 or newer model.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe to go out for bid to sell the following:  1990 140G Cat Motor Grader-District#2; Two 2006 belly dump trailers-District#2.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving and authorizing Chairman Schieber to sign Additional Homestead Exemption Reimbursement Form and Claim to Oklahoma Tax Commission Ad Valorem Division for $39,370.14.  Assessor Carol Purdy noted we only receive this if there is something to reimburse.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving the Public Service/Pipeline Crossing Line Installations; Range Resources, beginning SW SW 26-25-2W crossing Cowboy Hill Rd and ending NW NW 35-25-2W, D#3.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin noting the following April 2012 Monthly Reports of Officers:  Election Board.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Resolutions to Dispose of Equipment:  Res#11, 12-189, Highway Dist#3, belly dump trailer, sold; Res#11, 12-190, Highway Dist#3, belly dump trailer, sold; Res#11, 12-191, Court Clerk, DR 2010 Scanner, transferred back to vendor; replaced with new one.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Resolutions to Deposit Funds:  Res#11, 12-186, Highway Dist#3-$11,000.00, Superior Pipeline Road Project H3103-58; Res#11, 12-187, Highway Dist#1-$3,618.91, BIA H3101-98 Pecan North Road Project FY11-12; Res#11, 12-188, Highway Dist#3-$250.00, Road Crossing Permits; Res#11, 12-192, Highway Dist#3-$500.00, Road Bore Permit.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Motion was made by Rowe and seconded by Austin approving the following Cash Fund Estimate of Needs and Request for Appropriations:  Highway Dist#1-$3,618.91; Highway Dist#3-$250.00; CBRI 105C-$31,794.02; Highway Dist#3-$11,000.00; Highway Dist#3-$500.00.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Transfer of Appropriations:  General - Election Board Maintenance & Operations-$1,432.90 to Capital Outlay (purchase computer).  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Unscheduled public appearances: Steve Lewis, Freeport McMoran, Inc. referred to agenda item regarding Blackwell Smelter Waste situation and said several months ago he was contacted by legal counsel.  He said he hasn’t seen data that indicated damage to human health or environment.  He suggested an environment assessment be done by appropriate investigator to determine if there is damage and, if so, Freeport will step-up and work with you as Freeport has worked with other elected officials in Kay County.  Freeport would like to meet your concerns and are willing to start assessment anytime you are ready.

 

County Clerk Reese thanked DA Hermanson and his office for supporting Relay for Life and for having a first time courthouse team.   The DA office and other county officials had a hamburger/hotdog luncheon at the courthouse and accepted donations from those who attended to support the fight against cancer. 

 

Motion was made by Austin and seconded by Rowe approving to enter into Executive Session pursuant to and convened under authority of Oklahoma Statutes Title 25 Section 307.B.4 to discuss potential litigation at 9:50 a.m.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Austin and seconded by Rowe approving to reconvene regular meeting of the BOCC at 10:46 a.m.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Rowe and seconded by Austin approving and authorizing the law firm of Ryan Whaley Coldiron Shandy to file litigation for damages resulting from Blackwell Smelter Waste.   Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.
