Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, April 9, 2012, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on April 5, 2012, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Dee Schieber called the meeting to order.  Those present were as follows: Steve Austin, Member; Tyson Rowe, Member; Brian Hermanson, Kay County District Attorney (ADA); Carol Purdy, Kay County Assessor; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Steve Kelley, Kay County Undersheriff; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet). 

 

Chairman Dee Schieber led the Flag Salute.

 

Motion was made by Austin and seconded by Rowe approving regular meeting minutes of April 2, 2012, and special meeting minutes of April 3, 2012.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Jail Director Report:  Sheriff Van Hoesen reported the daily inmate count of 159; he mentioned 33 were arrested and released over the weekend and 44 were in DOC.  

 

Motion was made by Rowe and seconded by Austin approving and authorizing Chairman Schieber to sign the Jag Grant for the Sheriff’s Department.  Kelley noted the amount of the grant was $2,900 and smaller than previous years.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8: Commissioner Schieber mentioned the weather forecasts are predicting rain for the next 10 days so he is uncertain about continuing progress on Pecan Road.

 

Commissioner Rowe reported beams have been set on 108th Streets Bridge and hopes to pour floor and then move to Brake Road; he noted Blackwell Wind Farm Project started today.

 

Commissioner Austin said, weather permitting, crew hopes to pour bridge flooring on Bridge 29 on Bender Road on Wednesday; he noted Dry Road Project is almost complete. 

 

Motion was made by Rowe and seconded by Austin approving the following Public Service/Pipeline Crossing Line Installations:  Select Energy, NE4/NE/4 S28 T25N R2W ending SE4/SE4 S21 T25N R2W, D#3.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following April 2012 Monthly Reports of Officers:  County Clerk.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye.  

 

Motion was made by Austin and seconded by Rowe approving the following Resolutions to Dispose of Equipment:  Res#11, 12-183, Court Clerk, Court Reporter Desk, surplus to be transferred to Kay County Adult Drug Court.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Motion was made by Rowe and seconded by Austin approving the following Resolutions to Deposit Funds:  Res#11, 12-184, Highway Dist#1-$19,037.81, BIA Blue Star Road Project FY11-12 H3101-84; Res#11, 12-185, Child Abuse Prevention-$308.21, Juror donations.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Cash Fund Estimate of Needs and Request for Appropriations:  Highway-$54.88, D#1-$18.30; D#2-$18.29; D#3-$18.29; Highway Dist#1-$19,037.81; Highway Dist#1-$67,340.51 status; County Clerk Lien Fee-$2,873.00; Preservation Fee-$5,560.00; Treasurer’s Mortgage Certification-$535.00; Public Buildings Authority-$1,408.84; Child Abuse Prevention-$308.21; Drug Court-$12,395.83.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye.

Unscheduled public appearances: DA Hermanson reminded those in attendance of the Relay for Life luncheon to be held this Friday and mentioning all donations will benefit the work to fight against cancer.

Bids were discussed.

 

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting.].  None.

 

Commissioner Schieber contacted Joe Gaspar, Irwin Trailer, LLC by telephone and discussed the payment schedule on Bid#2012-20, Belly Dump Trailer, Dist#1 (bid opened in 4-2-12 BOCC Regular Meeting) and Mr. Gaspar stated the five year lease purchase price he bid was $30,425.00 with electric tarp did not include the interest.  The total price of his bid was $32,661.60.

 

Discussion was made whether or not Dist#3 could make a motion to accept (two) belly dump trailers with manual tarps since Agenda only mentioned Dist#1 but bid read one or more could be purchased.

 

DA Hermanson recommended putting this item on next week’s agenda referencing Dist#3 and only allowing Dist#1 could make a motion today.

 

Motion was made by Schieber and seconded by Austin accepting bid received by Irwin Trailer, LLC to purchase two (2) belly dump trailers on Bid#2012-20 with an electric tarp.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

10:00 a.m. Bid#2012-21, Selling Used Belly Dump Trailers, Dist#1 and Dist#3 were opened as follows:  Van Keppel-No Bid; Frontier Equipment Sales, LLC-No Bid; Yellowhouse Machinery-No Bid; City Trailer, Inc.-$24,025.00 for Dist#1 and $27,025.00 for Dist#3; Jeff Schieber-$28,000.00 for Dist#1 and $30,000.00 for Dist#3.

 

Motion was made by Schieber and seconded by Austin to sell used belly dump trailers to the highest bid received from Jeff Schieber, Model BBT4 Serial#5TU1140218S000611 and Serial#5TU1140258S000614 with electric tarps purchased in 2008 in the amount of $28,000.00 each totaling $56,000.00.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Rowe and seconded by Austin to sell used belly dump trailers to the highest bid received from Jeff Schieber, Model CTS-BDT40, Serial#5TU114023BS000620 and Serial$5TU114025BS000621, manual tarps purchased in 2011 in the amount of $30,000.00 each totaling $60,000.00.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

There being no other business, motion was made by Rowe and seconded by Austin to adjourn, 10:02 a.m.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.
