Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, March 26, 2012, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on March 23, 2012, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Dee Schieber called the meeting to order.  Those present were as follows: Steve Austin, Member; Tyson Rowe, Member; Brian Hermanson, Kay County District Attorney; Christy Kennedy, Kay County Treasurer; Carol Purdy, Kay County Assessor; Everette Van Hoesen, Kay County Sheriff; Jody Burd, Kay County Detention Center Director (KCDCD); Larry Klumpp, OSU Extension; Ray Ball, Kaw Nation; Darin Wood, River Ridge Construction; Gary Sharp, Cummins Equipment Company; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet). 

 

Chairman Dee Schieber led the Flag Salute.

 

Motion was made by Austin and seconded by Rowe approving regular meeting minutes of March 19, 2012.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Motion was made by Austin and seconded by Rowe approving and authorizing Chairman Schieber to sign the following Oklahoma Juvenile Affairs Claims:  November 2011-$4,450.16; December 2011-$2,561.92; January 2012-$3,749.87.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Jail Director Report:  Jody Burd, KCDCD, reported the daily inmate count of 164; he mentioned 43 were arrested and released over the weekend and 47 were in DOC.

 

Motion was made by Austin and seconded by Rowe approving general government account to pay invoice (approximate amount of $1,610.00), when received, from the Newkirk Sale Barn for feed and care of stray horses. Commissioners said they would like for DA Brian Hermanson to take action to retrieve money from the owners of the horses for reimbursement to the county.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Motion was made by Rowe and seconded by Austin approving Clearwater Enterprises Amendment to Gas Sales Agreement.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8: Commissioner’s commented since the rains have stopped they will be putting in extra hours to try and get caught up. 

 

Motion was made by Rowe and seconded by Austin Tabling Public Service/Pipeline Crossing Line Installation to install an electric overhead crossing and trenching; a system of buried electrical collection lines and overhead electrical transmission lines for Blackwell Wind, LLC.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Motion was mad Austin and seconded by Rowe approving the following February 2012 Kay County Monthly Reports:  County Health; Court Clerk.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye.

 

Motion was made by Rowe and seconded by Austin approving the following Resolutions to Dispose of Equipment:  Res#11, 12-171, Sheriff Department, 2003 Ford Crown Victoria, surplus to be sold; Res#11, 12-173, Treasurer’s Office, six chairs to be transferred to Drug Court.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye.  

 

Motion was made by Austin and seconded by Rowe approving the following Resolutions to Deposit Funds:   Res#11, 12-169, Highway Dist#3-$1,000.00, two Road Crossing Permits from Rite-Way Construction, LLC; Res#11, 12-170, Highway Dist#1-$8,176.41, BIA H3101-84 Blue Star Road Project FY11-12; Res#11, 12-172, Highway Dist#1-$337.30, overpayment on lease purchase.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye.

Motion was made by Austin and seconded by Rowe approving the following Transfer of Appropriations:  Highway Dist#1 Ridgevale Rd. Repair-$9.10 to Hubbard Bridge; County Clerk Travel-$52.68/Maintenance & Operations (M&O)-$162.92 Totaling-$215.60 to Purchasing M&O.  Motion carried:  Schieber, aye; Austin, aye; Rowe, aye. 

 

Unscheduled public appearances:  DA Hermanson told about an upcoming “Ropin’ in a Cure for Cancer Luncheon” with donations going to the Relay for Life American Cancer Society.  He said the plan is to have a big cook-out with hamburgers and or hotdogs and dessert, similar to the Bedlam cookout the courthouse has each year.  Hermanson said this is for a good cause and it would get the entire courthouse involved in the fight against cancer, as there are several cancer survivors working amongst us.  The date would be Friday, April 13, 2012, from 11 a.m. to 1 p.m.

Motion was made by Rowe and seconded by Austin approving to accept the bid on Bid#2012-19, Blackwell Wind Farm Project for Dist#3 from the only bidder River Ridge Construction, LLC in the amount of $955,500.00.  Stated in this motion was the bid was approved but not awarding contract until BOCC receives a signed contract from Blackwell Wind Farm.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.
