Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, February 6, 2012, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on February 3, 2012, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Dee Schieber called the meeting to order.  Those present were as follows: Steve Austin, Member; Tyson Rowe, Member; Brian Hermanson, District Attorney (DA); Christy Kennedy, Kay County Treasurer; Carol Purdy, Kay County Assessor; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Larry Klumpp, OSU Extension; Ray Ball, Kaw Nation; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet). 

 

Chairman Dee Schieber led the Flag Salute.

 

Motion was made by Rowe and seconded by Austin approving regular meeting minutes of January 30, 2012.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving special meeting minutes of February 2, 2012.  Motion carried:  Schieber, aye; Rowe, aye; Austin, abstained. 

 

Motion was made by Austin and seconded by Rowe approving and authorizing Chairman Schieber to sign the following Agreements between the BOCC and the following Subscribers for remote terminal capabilities in the Assessor’s Office:  NW Oklahoma Land, L.L.C.; Devinney & Turner Law Firm P.C.; City of Tonkawa.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Jail Director Report:  Jody Burd, Kay County Detention Center Director, was not present for meeting but submitted a report. 

 

Motion was made by Rowe and seconded by Austin approving Application for Financial Assistance and Affidavit of Financial Instability to Pay for funeral expenses in the amount of $350.00.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8: Commissioner Schieber said crew was working on Bridge by airport on Prospect Street.

 

Commissioner Rowe said crew is working on Bridge on 108th Street, putting up stop signs and rocking roads.

 

Commissioner Austin said crew was driving pilings on Bridge 29 and repairing bad spots in roads.  He mentioned work had begun on the Dry Road Project. 

 

Motion was made by Rowe and seconded by Austin approving action to close Bridge 174 on 124th Street (1/2 mile south of Hubbard) requested by CED, Dist#3.  Rowe mentioned he was seeking emergency funding.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving Lease Purchase Agreement and all financial papers on a John Deere Tractor and Diamond Boom Mower, Dist#2.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving Lease Purchase Agreement and all financial papers on Excavator (Trackhoe), Dist#3.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving Installation Permit granting Natural Resources Conservation Service & Gay Douglas to block a diversion channel into the county right-of-way grading the water away from the county right-of-way onto the property to the south.  Diversion is location in the NW4 S11-T26N-R2W on Hubbard Road, Dist#3.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.  

 

Motion was made by Rowe and seconded by Austin approving Public Service/Pipeline Crossing Line Installation for Select Energy beginning NW4/NW4 S26 T25 R1 ending NW4/NW4 S25 T25 R1, Dist#3.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.   

 

Motion was made by Rowe and seconded by Austin approving the following Public Service/Pipeline Crossing Line Installation for Superior Pipeline Company, L.L.C., Dist#3: Pipeline-beginning NW4/NW4 S28 T25N R2W ending SW4/SW4 S21 T25N R2W; Pipeline-beginning NW4/NW4 S21 T25N R2W ending SW4/SW4 S16 T25N R2W; Pipeline-beginning NE4/NE4 S16 T25N R2W ending SE4/SE4 S9 T25N R2W; Pipeline-beginning NE4/NE4 S9 T25N R2W ending SE4/SE4 S4 T25N R2W; Pipeline-beginning NE4/SE4 S34 T26N R2W ending SW4/NW4 S35 T26N R2W; Pipeline-beginning NE4/NE4 S4 T25N R2W ending SW4/SW4 S34 T26N R2W.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.   

 

Motion was made by Rowe and seconded by Austin approving Public Service Pipeline Crossing for Range Resources starting SE4/SE4 S27 T27N R2W and ending SW4/SW4 S26 T26N R2W, Dist#3.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.   

 

Motion was made by Rowe and seconded by Austin approving and authorizing Chairman Schieber to sign Resolution #11, 12-124 to amend the Trust Indenture of the Kay County Justice Facilities Authority (JFA) to reduce the number of citizen trustees appointed by the BOCC from seven (7) to five (5), thereby reducing the total number of Trustees on the Authority to seven (7).  Austin mentioned this topic was discussed after JFA Trustee Darrel Grossardt resigned and the fact it is hard to find people to serve in this capacity.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.   

 

Motion was made by Rowe and seconded by Austin approving the following Resolutions to Dispose of Equipment:  Res#11, 12-126, County Clerk, printer, junked.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.   

 

Motion was made by Austin and seconded by Rowe on the following Resolutions to Deposit Funds:  Res#11, 12-125, Highway Dist#3-$3,000.00 for six (6) Road Crossing Permits; Res#11, 12-127, Highway Dist#3-$750.00, Road Crossing Permit; Res#11, 12-128, Highway Dist#3-$798.25, sale of scrap metal; Res#11, 12-129, Lien Fee-$5.00, rebate on Swingline stapler; Res#11, 12-130, Highway Dist#1-$51,270.00, Hubbard Road Project STP-136D (0117) CO J/P 22953(04) H3101-20; Res#11, 12-131, Highway Dist#3-$500.00, Road Crossing Permit.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving action to VOID Cash Fund Estimate of Needs and Request for Appropriation for the County Sales Tax Cash Fund in the amount $9,822.87 approved in BOCC meeting January 23, 2012.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Cash Fund Estimate of Needs and Request for Appropriations: Highway-$60.55, Dist#1-$20.18; Dist#2-$20.18; Dist#3-$20.19; Highway Dist#1-$51,270.00; Highway Dist#3-$5,000.00; Highway Dist#3-1,548.25; County Clerk Lien Fee-$5.00.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Rowe approving the following Transfer of Appropriations:  Highway Dist#3 Bridge #240-$10,135.56 to Maintenance & Operations (M&O); Highway Dist#1 M&O-$678.08 to Personal Services.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.
