Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, November 21, 2011, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on November 18, 2011, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Steve Austin called the meeting to order.  Those present were as follows:  Dee Schieber, Member; Tyson Rowe, Member; Brian Hermanson, District Attorney (DA); Christy Kennedy, Kay County Treasurer; Carol Purdy, Kay County Assessor; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Jody Burd, Kay County Detention Director; Harold Hughs, Kay County Detention Center Assistant Director; Larry Klumpp, OSU Extension; Cheryl Howard, Kay County Election Board Secretary; Ray Ball, Kaw Nation; James L. Menzer, Menzer Law Offices, P.C.; Stephen C. Gelnar, Donald K. Shandy, and Patrick R. Pearce, Jr., Ryan Whaley Coldiron Shandy; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet).

 

Chairman Steve Austin led the Flag Salute.

 

Motion was made by Rowe and seconded by Schieber approving regular meeting minutes of November 14, 2011.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Jail Director Report:  Burd reported 115 were booked in and out last week and 41 over the weekend, 173 is the current daily inmate count with a high of 183 over the weekend.  Burd discussed the Department of Corrections (DOC) changes that have been made. 

 

Motion was made by Schieber and seconded by Rowe approving Chairman Austin to sign Amending the Paving Construction and Funding Agreement between the Kay County Commissioners and the Kay County Justice Facilities Authority to add the approval and payment of a road construction inspector, not to exceed $10,000.00 regarding the Dry Road Project.  Austin said Circuit Engineering District No. 8 would be doing the inspection.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving Contract-Eastern Oklahoma Youth Services & Kay County for services at Woodward County Regional Juvenile Detention Center, $23.25 per child per day, striking wording regarding automatic renewal clause.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving reimbursement claim for County Election Board Secretary for the month of October 2011.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving Chairman Austin to sign Agreement by and between Shannon Robinson and BOCC for remote terminal capabilities in the Assessor’s Office.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Schieber said beams were set on bridge by Ponca Lake last Friday and work continues.

 

Commissioner Rowe said he is waiting on Engineering on bridge/road projects.

 

Commissioner Austin said work continues on “S” Street and working on guard rail.

 

No action was taken on going out for bid for a heavy duty, drop deck, detach trailer, Dist#3.

 

Motion was made by Schieber and seconded by Rowe approving the following Resolutions for Disposing of Equipment:  Res#11, 12-75, Sheriff’s Department, 2004 Ford Crown Victoria Police Car, surplus, to be sold; Res#11, 12-76, Sheriff’s Department, 2006 Chevrolet Impala Police Car, surplus, to be sold.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving the following Resolutions to Deposit Funds:  Res#11, 12-74, Highway District#2 - $1,687.50, sale of scrap iron; Res#11, 12-77, Highway District#3 - $190.80, reimbursement for tow charges.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving the following Cash Fund Estimate of Needs and Request for Appropriations:  CBRI 105C-$27,388.79; Highway District #2- $1,687.50; Highway District #3- $190.80; Highway District #1 – Lapsed balance, $14,942.34.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

There were no unscheduled public appearances.

Motion was made by Rowe and seconded by Schieber approving going into Executive Session pursuant to and convened under authority of Oklahoma Statutes Title 25 Section 307.B.4 to discuss potential litigation (9:30 a.m.).  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Schieber and seconded by Rowe to reconvene regular meeting of the BOCC (10:35 a.m.).  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

No discussing was made regarding potential litigation.

 

Motion was made by Rowe and seconded by Schieber approving the BOCC hire outside counsel and hire Ryan Whaley Coldiron Shandy, P.L.L.C. for the purpose of providing legal representation related to the historical Smelter Operation in Blackwell, Oklahoma, and it’s related and affiliated entities and their respective successors or assign to engage in settlement discussions and, if necessary, to prosecute an action in a court of competent jurisdiction to recover damages and to take actions to abate and manage the damages.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.
