Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, October 24, 2011, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on October 21, 2011, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Steve Austin called the meeting to order.  Those present were as follows:  Dee Schieber, Member; Tyson Rowe, Member; Brian Hermanson, District Attorney (DA); Christy Kennedy, Kay County Treasurer; Carol Purdy, Kay County Assessor; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Larry Klumpp, OSU Extension; Jody Burd, Kay County Detention Center Director; Ray Ball, Kaw Nation; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary.  (See sign-in sheet).

 

Chairman Steve Austin led the Flag Salute.

 

Motion was made by Rowe and seconded by Schieber approving regular meeting minutes of October 17, 2011, and special meeting minutes of October 19, 2011.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Jail Director Report:  Jody Burd reported the daily inmate count as 172 and noted 84 were arrested and released last week.  He mentioned upcoming jury trials in November.

 

DA Hermanson said the first preliminary hearing via satellite was held and noted it went very well. 

 

Motion was made by Schieber and seconded by Rowe approving Resolution 11, 12-53, a Resolution regarding the partial paving of West Dry Road and entering into an Agreement with the Kay County Justice Facilities Authority for funding of the project.  Before motion was made, Schieber expressed his opinion regarding specifications for Bid#2011-51 Dry Road Project, stating he did not think the specifications and bids received were apple to apple.  Motion carried:  Schieber, nay; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving Paving Construction and Funding Agreement by and between Kay County Commissioners and Kay County Justice Facilities Authority on West Dry Road Project.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving Agreement by and between BOCC and Craig M. Kessler for remote terminal capabilities with the Assessor’s office.

Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Schieber said beams are being set on bridge by Ponca Lake.

 

Commissioner Rowe noted 60th Street and Hubbard Rd., 60th Street and Indian Road and 44th Street south of Fountain Rd. will be closed.

 

Commissioner Austin said Bridge Inspectors have been in Kay County and Bridge 53 will be closed; Austin said this bridge is on the Five Year Plan.

 

Commissioner Schieber suggested hiring CED District No. 8 to inspect the road projects and said CED would charge six to seven percent of the bid price.

 

Motion was made by Rowe and seconded by Schieber approving Resolution No. 11, 12-58, whereas CED Dist#8 is selling/transferring a 2008 Chevy Silverado extended cab 4x4 pickup in the amount of $9,000.00 to Dist#3.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving Resolution No. 11, 12-55, Dist#2; Bridge 53 will be closed by October 21, 2011 and is scheduled to be replaced in this fiscal year on the County’s 5 year plan to be funded by BIA.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving the Public Service/Pipeline Crossing Line Installation for Blackwell rural Water Corporation to install a water line NW Qtr. S25 T26N R1W crossing Hubbard Road and ending at SW Qtr. S24 T26N R1W, Dist. #3.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving Commissioners Sale and bid received from Daniel Amos in the amount of $25.00 on Blackwell Baptist College Lot 7 & 8 Block 7, 1315 W. Blackwell.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving the following Contract Agreement Emergency and Transportation Revolving, ETR Fund on the following Projects:  Project No. ETRCB-8-36-3(14)11-$75,000.00; Project No. ETRCB-8-36-3(15)11-$75,000.00; Project No. ETRCB-8-36-3(16)11-$75,000.00; Project No. ETRCB-8-36-3(17)11-$75,000.00; Project No. ETRCB-8-35-3(18)11-$80,000.00.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe noting the following September 2011 Monthly Reports as follows:  Court Clerk – Newkirk.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving the following Resolutions to Deposit:  Res#11, 12-52, Highway Dist#3-$1,378.58, rubber tire roller (Agenda read sale of scrap tires) & sale of iron; Res#11, 12-54, Highway Dist#1-$80,650.00, Hubbard Bridge #105 Road Project FY11/12 H3101-97; Res#11, 12-56, Highway Dist#3-$286.00, sale of 84 Chevy ¾ ton pickup; Res#11, 12-57, Highway Dist#3-$1,927.10, sale of unprepared plate and structural steel.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving Officer’s Request for Supplemental Appropriations, money being added to Kay County Detention Center Sales Tax Account ST0800, reimbursement for Workers’ Comp-$47,978.00 and Liability Insurance-$52,233.00, approved in Justice Facilities Authority meeting on August 12, 2011, Totaling $100,211.00. Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving Officer’s Request for Supplemental Appropriations, money being added to General Government Maintenance & Operations (M&O), money from Emergency Performance Grant funds for 3rd quarter period from April 1, 2011-June 30, 2011, and funds from 4th quarter period July 1, 2011-September 30, 2011, Totaling $8,063.50.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

Motion was made by Austin and seconded by Rowe accepting low bid from Hembree and Hodgson Construction L.L.C. in the amount of $228,325.00 on Bid#2011-51, West Dry Road Project.  Motion carried:  Schieber, nay; Rowe, aye; Austin, aye.

 

Motion was made by Austin and seconded by Schieber accepting low bid from  River Ridge Construction L.L.C. in the amount of $26,000.00 on Bid#2011-52 Bridge Work, Dist#2.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting.].   None.
