Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, June 13. 2011, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on June 10, 2011, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Steve Austin called the meeting to order.  Those present were as follows:  Dee Schieber, Member; Tyson Rowe, Member; Brian Hermanson, Kay County District Attorney (DA); Carol Purdy, Kay County Assessor; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Jody Burd, Kay County Detention Center Director; Harold Hughes, Kay County Detention Center Deputy Director; Cheryl Howard, Kay County Election Board Secretary; Ray Ball, Kaw Nation; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary. 

 

Chairman Steve Austin led the Flag Salute.

 

Motion was made by Schieber and seconded by Rowe approving regular meeting minutes of June 6, 2011.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Jail Issues:  Jody Burd, KCDC Director, said 43 were booked in over the weekend making the count reach 196.  He said 1,215 have been booked in the last five months.  Burd reported the daily inmate count at 183. 

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Schieber said he attended a meeting regarding Wind Energy.  He said according to plans CED No. 8 would form and would collect tax off wattage for the 14 counties in Dist#8.

 

Commissioner Rowe noted he had to close a bridge and said one of the bridges in his District will soon be completed. 

 

Commissioner Austin said he has a bridge that should be finished in the next 10 days. 

 

Motion was made by Schieber and seconded by Rowe approving Public Service/Pipeline Crossing Line Installation from Max Oil Co., to install a trench on W2 SW4 S21 T27N R1E.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe acknowledging Commissioner Schieber’s decision to designate Jamie McAllaster’s First Deputy for Highway Dist#1.   Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving Resolution No. 10, 11-198, Contract Agreement Renewal Emergency and Transportation Revolving, ETR Fund.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Austin approving appointment of Dee Schieber to be the designee for district boundaries provided by the Oklahoma House of Representatives.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Rowe and seconded by Schieber approving going out for bid for Election Ballots, six month period July-December 2011.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving Resolution No. 10, 11-204 enacting Use Tax for Kay County to go into an all-purpose fund.  DA Hermanson said the statute does not state it has to go into any particular account.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving Contract between Kay County Health Department and Laboratory Associates, Inc.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving Agreement between Kay County Health Department and Four Seasons Lawn Care.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving Contract between Kay County Health Department and Carol Rickards, RN.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Rowe and seconded by Schieber approving Contract-Western Plains Youth & Family Services, Inc. Kay County for Services at Beckham County Regional Juvenile Detention Center, $29.35 per child per day.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving Resolution 10, 11-196, Resolution to Execute the Agreement Establishing the Association of County Commissioners of Oklahoma Self-Insurance Fund (Workers’ Compensation Program).  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving using existing codes for Employee and Employer Retirement Contribution Rates for Fiscal Year 2012 noting a one percent increase on the elected official contribution rates for the employer.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving the following May 2011 Kay County Monthly Reports:  Election Board; Treasurer; County Clerk; Health Department; Assessor;  Court Clerk-Blackwell, Newkirk, Ponca City.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.

 

Motion was made by Rowe and seconded by Schieber approving the following Resolutions to Deposit:Res#10, 11-195, Highway Dist#1-$2,500.00 reimbursement for rock; Res#10, 11-197, Public Building Authority (PBA)-$1,408.84; Res#10, 11-199, Highway Dist#1-$1,500.00, Road Crossing Permit.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Rowe approving the following Cash Fund Estimate of Needs and Request for Appropriation:  Highway D#1-$2,500.00; County Sales Tax-$829.44; County Sales Tax-$455.77; County Sales Tax-$20,524.13; Treasurer’s Mortgage Certification-$490.00;  Visual Inspection Reimbursement-$1,142.53;  PBA-$1,408.84;  Highway D#1-$1,500.00.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.
