Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Tuesday, February 22, 2011, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on February 18, 2011, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.


Chairman Steve Austin called the meeting to order.  Those present were as follows:  Dee Schieber, Member; Tyson Rowe, Member; Kristin Monroe, Assistant District Attorney (ADA); Christy Kennedy, Kay County Treasurer; Everette Van Hoesen, Kay County Sheriff; Steve Kelley, Kay County Undersheriff; Jody Burd, Kay County Detention Center Director; Larry Klumpp, Kay County Extension Agent; Dennis Bonewell, Kay County Emergency Management; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).  


Chairman Austin led the Flag Salute.


Motion was made by Rowe and seconded by Schieber approving regular meeting minutes of February 14, 2011.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.


Discussion was made regarding HB 1888 Rural Ambulance Service.  Bryce Kennedy, Attorney for City of Tonkawa, began by saying; it is law that the county prepares a plan for ambulance service including additional funding issues and county boundaries.  He also discussed municipalities’ loss in revenue, restricting the size of district, adding additional assessment to property owners, and the Health Department’s involvement.  Kennedy explained State Constitutional Amendment 522 Emergency Medical Service (EMS) District.


Kennedy introduced Perry, Oklahoma’s Mayor to those in attendance.  Mayor Hall brought a visual aid of a redistricting map and financial chart.  He told BOCC how he addressed these same issues with Noble County BOCC. 


Mark Skiles, Blackwell City Manager, said if the county will not help with these funding issues it will force cities to downsize services.  Styles said over the past few years Blackwell has suffered around $200,000 to $300,000 in losses and are working with fewer staff.


Craig Stephenson, City Manager in Ponca City, said Ponca City is evaluating these issues and are willing to work to find solutions and want to work with the county regarding these services.


Commissioner Steve Austin said those interested could attend next week’s BOCC meeting in order to try and come up with a workable solution.


Jail Issues:  Jody Burd, Kay County Detention Center Director, gave the daily inmate count of 152 and he introduced newly hired, Harold Hughes, Deputy Director.


Sheriff Issues:  Undersheriff Steve Kelley presented a January 2011 Monthly Activity Report to BOCC.  Kelley reported number of crimes, calls received, and transport miles.  He said a total of 103 cases were worked for the month.


Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Schieber said CED will have a state wide board meeting on Wednesday.  Commissioner Austin said work will begin on a bridge east of Newkirk.  Commissioner Rowe noted a road closing south of 44th Street. 


Motion was made by Rowe and seconded by Schieber approved going out to rebid Bid#2011-5 Concrete on the six month bid list.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 


Motion was made by Schieber and seconded by Rowe approving adopting a new Road Crossing Permit form as adopted by CED.  Commissioner Rowe said the purpose for this form was to have consistency.  Commissioner Austin mentioned new and higher costs involved.  Commissioner Schieber said the intentions are to have all 14 counties in CED Dist#8 using the same form with the same costs.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 


Motion was made by Austin and seconded by Rowe approving to go out for bid on bridge building for District #2.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 


Motion was made by Schieber and seconded by Rowe approving the following January 2011 Kay County Monthly Reports:  County Clerk; Court Clerk – Blackwell, Newkirk, Ponca City; Assessor; Election Board.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 


Motion was made by Schieber and seconded by Rowe approving Officer’s Request for Supplemental Appropriations on money to add to General Government Maintenance & Operations (M&O) G2000-20 Account (reimbursement money from Emergency Performance Grant for period October 1, 2010, to December 31, 2010, 1st quarter).  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 


Motion was made by Rowe and seconded by Schieber approving the following Resolutions to Deposit:  Res#10, 11-117, Highway, BIA Reimbursement H3101-78 “S” Street Project FY 10/11, D#1 - $15,324.00; Res#10, 11-118, Highway, Reimbursement-East River Bridge damage in Blackwell, NBI No. 01414-$258.90.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 


Motion was made by Schieber and seconded by Rowe approving the following Cash Fund Estimate of Needs and Request for Appropriation:  Highway Dist#1-$15,324.00; Highway Dist#3-$258.90; CBRI 105C-$31,397.39; Visual Inspection Reimbursement-$1,490.71; Public Buildings Authority-Health-$651.01.  Motion carried:  Schieber, aye; Rowe, aye, Austin, aye. 


Motion was made by Rowe and seconded by Schieber approving the following Transfer of Appropriations:  Justice Facilities Authority (JFA) Personal Services-$3,000.00 to Part Time; Sheriff Jail M&O-$3,000.00 to Contract; Sheriff Service M&O-$2,000.00 to Capital Outlay.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye.


Motion was made by Rowe and seconded by Schieber selecting Irwin Trailer Co., bid on Bid#2011-15 Belly Dump Trailers to lease purchase two trailers for three years at $24,685.00, monthly payments of $726.92, with an interest rate of $3.29 to finance through Welch State Bank.  Other bids received:  Van Keppel Company, Frontier Equipment Sales, L.L.C., C. L. Boyd Company, Inc., Kirby-Smith Machinery, Inc., all No-Bids.  Motion carried:  Schieber, aye; Rowe, aye; Austin, aye. 


Motion was made by Rowe and seconded by Schieber to Table Bid#2011-16 Used Motor Graders bids were received from Cummins Equipment-$155,000.00m, Warren Power & Machinery, Inc.-$197,800.00, Yellowhouse Machinery-$188,707.00, G. W. Van Keppel Co.-$137,700.00, C. L. Unscheduled public appearances:  County Clerk Tammy Reese reminded officers the Blackwell Leadership class would be visiting the Courthouse and Detention Center on Wednesday for their County Government Day.
