Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, August 16, 2010, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on August 13, 2010, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Dee Schieber called the meeting to order.  Those present were as follows:  Laile Wilson, Member; Steve Austin, Member; Mark Gibson, District Attorney (DA); Jennifer Layton, Assistant District Attorney (ADA); Christy Kennedy, Kay County Treasurer; Carol Purdy, Kay County Assessor; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Steve Kelley, Kay County Undersheriff; Ray Ball, Kaw Nation; Tyson Rowe; Scott Cloud, Newkirk Herald; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).  

 

Chairman Schieber led the Flag Salute.

 

Motion was made by Wilson and seconded by Austin approving regular meeting minutes of August 9, 2010.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Wilson approving to enter into Executive Session, pursuant to and convened under authority of Oklahoma Statutes Title 25 Section 307.B.4 to discuss litigation of Tyson Foods, Inc., vs. Kay County Assessor.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Wilson and seconded by Austin approving to reconvene regular meeting of the BOCC (9:23 a.m.).  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Wilson authorizing the Kay County Assessor to hire outside counsel for the Tyson Foods, Inc. vs. Kay County Assessor case not to exceed $20,000.00.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Sheriff Everette Van Hoesen reported the daily inmate count showing 129.  Undersheriff Kelley mentioned the current drug recovery building would eventually be moved to the new jail.

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Schieber said next month there will be CED meetings held across the state and encouraged Kay County BOCC to attend the meeting to be held in Enid.

 

Commissioner Wilson said he had a black topped road that was bleeding and said chips were being put down to help bring to an end.

 

Commissioner Austin commented the concrete box has been poured. 

 

Motion was made by Wilson and seconded by Austin noting the following Monthly Reports for July 2010:  Court Clerk – Blackwell, Newkirk, Ponca City offices; County Health; Treasurer Trust; County Clerk; County Election.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Wilson approving the following Resolutions to Dispose of Equipment:  Res#10, 11-31, Court Clerk, CPU Hard Drive, junked.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Wilson and seconded by Austin approving the following Resolutions to Deposit:  Res#10, 11-29, Public Building Authority (PBA)-$1,408.84, August 2010 rent; Res#10, 11-30, Highway Dist#1-$516,389.16, BIA Reimbursement, H3101-86 Pecan Rd. Project FY 09-10.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Wilson approving the following the following Cash Fund Estimate of Needs and Request for Appropriation:  PBA-$1,408.84; Highway Dist#1-$516,389.16; Highway Dist#1-$59.94; PBA-Health-$449.58; Visual Inspection Reimbursement-$2,409.15; CBRI 105C-$28,581.32.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Wilson and seconded by Austin approving the following Transfer of Appropriations:  Sheriff Jail Maintenance-$1,300.00 to Travel.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

There were no unscheduled public appearances made.

 

Motion was made by Austin and seconded by Wilson approving Payroll with warrants to be released on August 30, 2010.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.
