Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, August 2, 2010, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on July 30, 2010, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Dee Schieber called the meeting to order.  Those present were as follows:  Steve Austin, Member; Jennifer Layton, First Assistant District Attorney (ADA); Carol Purdy, Kay County Assessor; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Steve Kelley, Kay County Undersheriff; Carol Kellum, Kay County Election Board; Larry Klumpp, OSU Extension; Vicky Purdy; Ray Ball, Kaw Nation; Scott Cloud, Newkirk Herald; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).  Laile Wilson, Member, absent.

 

Chairman Schieber led the Flag Salute.

 

Motion was made by Austin and seconded by Schieber approving regular meeting minutes of July 26, 2010.  Motion carried:  Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber accepting bid received from David Kelly on property 312 S. Lincoln (3 lots) Lots 30-32, Block 7 Westside Addition, Ponca City in the amount of $25.00 on County Treasurer’s Transcript of Proceedings on Sale of County Property Acquired at Resale for Approval of the Board of County Commissioners.  Motion carried:  Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber accepting bid received from Daniel Amos on property 407 W. Oklahoma (2 lots) Blackwell Original Town Lot 4-5, Block 88, Blackwell in the amount of $25.00 and 1007 W. Bridge (1.5 Lots) Blackwell Baptist College, Lot 4 and all of Lot 5, Block 11 W/2 in the amount of $25.00 on County Treasurer’s Transcript of Proceedings on Sale of County Property Acquired at Resale for Approval of the Board of County Commissioners.  Motion carried:  Schieber, aye; Austin, aye. 

 

Sheriff Everette Van Hoesen reported the daily inmate count showing 125 and the July monthly average as 118.

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Schieber said painting will be done to Kildare Road and he answered questions regarding speed limit signs.

 

Austin said flooring for concrete box will be poured at Adobe and Ranch Drive Road and noted road will be closed for another two-three weeks.

 

Motion was made by Schieber and seconded by Austin approving Phase 1 & 2 of Right-of-Way of Utility and Encroachment Agreements, Waverly & Hubbard Road Projects.  Motion carried:  Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving Detention Services Agreement By and Between the Board of County Commissioners for Tulsa County and the Kay County Board of County Commissioners, $39.32 a day per child.  Motion carried:  Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving Memorandum of Agreement by and between the Kay County Health Department and the Braman Public School District.  Motion carried:  Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving Contract for Labor for the Department of Human Services whereas Jacky Bagg shall perform interior and exterior custodial maintenance.  Austin mentioned the bid was approved prior to the contract.  Motion carried:  Schieber, aye; Austin, aye.   

 

Motion was made by Austin and seconded by Wilson approving reimbursement for Kay County Election Board Salary for July 2010.  Motion carried:  Schieber, aye; Austin, aye.

 

Motion was made by Austin and seconded by Schieber approving the following reports from the Kay County Treasurer:  Annual Statement, FY 2009-10; Resolutions applying to the Treasurer’s office; 2009 Tax Roll Audit Report.  Motion carried:  Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the following Resolutions to Dispose of Equipment: Res#10, 11-26, Court Clerk, Toshiba E-28 Copier, transferred to Kay County Clerk; Res#10, 11-27, Hwy. Dist#1, John Deere (JD) CX Mower; 1993 JD Motor Grader; 1987 Freightliner Tandem Dump Truck; 1969 1 ½ Ton Chevrolet Truck, all items sold at CED Auction 3-13-09.  Motion carried:  Schieber, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving the following Resolutions to Deposit:  Res#10, 11-24, Highway Dist#1, BIA Reimbursement H3101-84, Blue Star Rd. Project FY 2008-09-$239,965.68 and BIA Reimbursement H3101-86, Pecan Rd. Project FY 2009-10-$74,690.72; Total $314,656.40; Res#10, 11-25, Highway Dist#1, BIA Reimbursement H3101-81, Pleasant view Rd. Project FY2008-09-$2,708.94.  Motion carried:  Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving the following Cash Fund Estimate of Needs and Request for Appropriations:  Highway, Dist#1-$314,656.40; Highway, Dist#1-$2,708.94; Highway-$324.05; Highway-$325,191.00; Sheriff’s Service Fee-$3,955.04; Sheriff’s Jail-$511.00; Sheriff’s Commissary-$2,383.08; Sheriff’s Jail-$38,743.17; Sheriff’s Service Fee-$26,051.80; CBRI 105C-$382,467.47.  Motion carried:  Schieber, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Schieber approving the following Transfer of Appropriations:  Preservation Fee Personal Services-$6,950.05 to Maintenance & Operations (M&O).  Motion carried:  Schieber, aye; Austin, aye. 

 

No unscheduled public appearances were made.
