Kay County Courthouse

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, April 19, 2010, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on April 16, 2010, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Dee Schieber called the meeting to order.  Those present were as follows:  Laile Wilson, Vice-Chairman; Steve Austin, Member; Everette Van Hoesen, Kay County Sheriff; Mary Ramey, Kay County Court Clerk; Carol Purdy, Kay County Assessor; Larry Klumpp, OSU Extension Office; Ray Ball, Kaw Tribe; Nixie Goff, Blackwell Journal Tribune; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).  

 

Chairman Schieber led the Flag Salute followed by 30 seconds of silence to remember the Oklahoma City Murrah Building Bombing Victims.

 

Motion was made by Austin and seconded by Wilson approving regular meeting minutes of April 12, 2010.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

District Judge Boyd brought to the Commissioners attention the budget cuts his office will be facing this upcoming fiscal year; State Legislators said Judiciary will suffer a ten percent cut which would mean $73-74,000 for his office.  Judge Boyd told Commissioners he would like to eliminate paying his portion of the courthouse utility bill of $3000.00.  He also asked them to consider paying for one deputy court clerk salary of $32,000.00 that is currently being paid out of the state court clerk fund.  Judge Boyd said FY 2012 revenue will be less than FY 2011 so this request may need to be extended.

 

Commissioner Austin told the Judge he appreciated knowing in advance the challenges the county will be facing this budget season. 

 

Motion was made by  Wilson and seconded by Austin approving Chairman Schieber to sign Oklahoma Juvenile Affairs claims for January 2010-$3,290.72 and February 2010-$2,687.48.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Jail Issues:  Sheriff Everette Van Hoesen reported the daily inmate count showing 124; 22 Department of Corrections with 98 non-sentenced.

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Schieber said the floor has been poured on the bridge near Tonkawa. 

 

Motion was made by Schieber and seconded by Wilson approving Application for Permit Line Installation on County Right-of-Way, Permit #10-14, requesting two (2) road crossings for the purpose of installing a low pressure, natural gas gathering pipeline in T28N, R5E, for IACX Energy, LLC, Dist. #1.  The proposed pipeline would enter the north edge of E. Canteen Rd. in the SW quarter of Section 31 T28N, R5E and cross the road to the southern edge where it will turn eastward and continue parallel to the roadway.  There is a bridge in the middle of Section 31, once reached, the poly-pipe will transition to 6:, .250: wall steel pipe and be tacked to the south side of the bridge using U-bolts, and proceed along the southern edge of E. Canteen Rd. where just prior to entering Section 32 of T28N-R5E, the pipe will cross the road for a second time trending to the northeast and return to private lands in the SW quarter of Section 32 of T28N-R5E.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Austin approving Agreement between Kay County and the Bureau of Indian Affairs to resurface Pecan Road (Kildare to Highway 11).  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Wilson and seconded by Austin to use J & J Plaster for plaster repairs needed throughout the courthouse at a cost of $3,860.00, (this cost does not include painting).  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Kay County Treasurer Christy Kennedy presented a Contract for Labor, a mowing contract for the period of May 20, 2010, through October 20, 2011, to the BOCC to have in place if and when needed. 

 

Motion was made by Wilson and seconded by Austin approving Chairman Schieber signing Claim for Loss of revenue to Kay County and the School Districts therein due to the Additional Homestead Exemptions allowed for the year 2009 in the amount of $44,205.45.  Kay County Assessor Carol Purdy said the county has not received reimbursement for this since 2006.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Motion was made by Austin and seconded by Wilson acknowledging the following Monthly Reports for March 2010:  Public Health.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Wilson and seconded by Austin approving the following Resolutions to Deposit:  Res#9, 10-168, Child Abuse Prevention-$240.00, jury service; Res#9, 10-169, Highway Dist#1-$1,000.00, Road Crossing Permit#10-14; Res#9, 10-170, Highway Dist#1-$66,740.97-Pleasant View Road Project H3101-81; $34,827.95-Blue Star Road Project H3101-84.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Wilson approving the following Cash Fund Estimate of Needs and Request for Appropriation:  Child Abuse Prevention-$240.00; Highway Dist#1-$1,000.00; Highway Dist#1-$101,568.92; Drug Court-$15,733.50; Highway Dist#1-$159.26.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Austin and seconded by Wilson approving the following Transfer of Appropriations:  LEPC Capital Outlay-$500.00 to Maintenance & Operations. Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

There were no unscheduled public appearances made.
