The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, September 28, 2009, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on September 25, 2009, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Steve Austin called the meeting to order.  Those present were as follows:  Dee Schieber, Vice-Chairman; Laile Wilson, Member; Jennifer Layton, Kay County District Attorney, First Assistant (ADA); Christy Kennedy, Kay County Treasurer; Mary Ramey, Kay County Court Clerk; Carol Purdy, Kay County Assessor; Everette Van Hoesen, Kay County Sheriff; Steve Kelley, Kay County Undersheriff; Bill Grose, Kay County Sheriff Deputy; Carol Kellum, Kay County Election Board Secretary; Larry Klumpp, OSU Extension; Scott Cloud, Newkirk Herald Journal; Josh Newton, Blackwell Journal Tribune; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet). 

 

Chairman Austin led the Flag Salute.

 

Motion was made by Wilson and seconded by Schieber approving regular meeting minutes of September 21, 2009.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Motion was made by Schieber and seconded by Wilson approving special meeting minutes of September 23, 2009.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Jail Issues:  Sheriff Van Hoesen reported 141 for the daily inmate count.

 

Motion was made by Wilson and seconded by Schieber approving Oklahoma Highway Safety Contract.  Deputy Bill Grose said this contract is to put significance on drunk driving and seat belts and the Sheriff’s Department will be able to purchase equipment for their deputy cars.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Wilson approving Detention Services Agreement Contract between Tulsa County Juvenile Detention Home and Kay County for FY 2009-2010, at $39.32 per child per day.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  No discussion was made.

 

Motion was made by Wilson and seconded by Schieber approving to go out for bid to purchase a rubber tire loader, Dist#3.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Wilson approving Oil and Gas Lease on a tract of land located within the Original Townsite, now the City of Newkirk, Kay County, Oklahoma, Section 26, Township 28N, Range 2E, containing 3.632 acres.  ADA Layton said the five year contract on this lease was acceptable because the county is not committing money so therefore the county is not restricted.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Wilson and seconded by Schieber approving Publishing Sheet for Kay County Financial Statement/Estimate of Needs for all Funds for the FY ending June 30, 2010.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Wilson noting the following September 2009 Monthly Reports:  Court Clerk Offices – Blackwell, Newkirk, Ponca City.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

 

Motion was made by Wilson and seconded by Schieber approving the following Resolutions to Deposit:  Res#9, 10-59 – Open Dump-$100.00, August 2009 collections; Res#9, 10-61 – Highway D#1-$2,667.60, H3101-81 Pleasantview Road Project; Res#9, 10-62 – Highway D#2-$751.00, H3102-42 LA Cann/Fork Road Project; Res#9, 10-63 – Highway D#2-$420,511.35, H3102-42 LA Cann/Fork Road Project.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Wilson approving the following Cash Fund Estimate of Needs and Request for Appropriation:  Open Dump Reward - $100.00; Highway Dist#1 - $2,667.60 (Pleasantview Road Project); Highway Dist#2 - $751.00 & $420,511.35 (LA Cann/Fork Road Project); Highway Dist#1 Lapsed Balance 2008-2009 H3101-85 BIA Fountain Road Project-$47,321.60.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Wilson approving action to rescind decision on Transfer of Appropriations approved in BOCC meeting of September 21, 2009, D#1 H3101-85 Fountain Road Project-$47,321.60 transferring to Hwy. Mtce.-$10,000.00/Hwy. Capital Outlay-$37,321.60.  Austin explained the reason rescinding was because you cannot transfer money in 2008-2009 into 2009-2010.  A lapsed balance was made and money was appropriated into suitable accounts.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Unscheduled public appearances.  Kay County Court Clerk Mary Ramey said news confirmed a student at Newkirk Public Schools has H1N1 virus.
