Kay County Courthouse

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, August 31, 2009, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on August 28, 2009, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Steve Austin called the meeting to order.  Those present were as follows:  Dee Schieber, Vice-Chairman; Laile Wilson, Member; Jennifer Layton, Kay County District Attorney First Assistant (ADA); Mary Ramey, Kay County Court Clerk; Carol Purdy, Kay County Assessor; Everette Van Hoesen, Kay County Sheriff; Steve Kelley, Kay County Undersheriff; Carol Kellum, Kay County Election Board Secretary; Larry Klumpp, OSU Extension; Ray Ball, Kaw Nation; Josh Newton, Blackwell Journal Tribune; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet). 

 

Chairman Austin led the Flag Salute.

 

Motion was made by Wilson and seconded by Schieber approving regular meeting minutes of August 24, 2009.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Steve Higa, Liberty National, gave a presentation pertaining to supplementary Group Life/Cancer policy.

 

Motion was made by Schieber and seconded by Wilson to approve giving Kay County employees the opportunity to consider this type of coverage.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Motion was made by Wilson and seconded by Schieber to adopt County Regulations for the Location, Design, Construction and Maintenance of Solid Waste Disposal Sites and Facilities.  ADA Jennifer Layton briefly went over the regulations and some of the changes that were made and answered questions.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Motion was made by Schieber and seconded by Wilson approving the renewal page on Kay County Emergency Operation Plan updates.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Jail Issues:  Kay County Sheriff, Van Hoesen, reported the daily inmate count showing 141.  He noted 26 inmates are waiting to be transferred to Department of Corrections (DOC). 

 

Motion was made by Wilson and seconded by Schieber accepting Gary Faul’s $410.00 bid on Bid#2009-49 Selling used cars (Sheriff) 2004 Ford Crown Victoria VIN#2FAFP71W84X146676, approximate mileage 171,838, B-629-80, per Sheriff Van Hoesen’s request.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Schieber said  Lake Road should be opened by tomorrow evening; Fountain Road will be capped; and Schieber finished by speaking of upcoming projects on Enterprise and Kildare Road. 

 

Motion was made by Schieber and seconded by Wilson approving going out for bid on Bridge on Old Hwy. 60 (North Avenue).  Schieber said CED will handle and funding for the bridge will be through Tonkawa Tribe.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Wilson and seconded by Schieber approving Contract-Eastern Oklahoma Youth Services & Kay County for services at Pittsburg County Regional Juvenile Detention Center at $23.25 per child per day.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Wilson approving Resolution 9, 10-42, HB 1176 (CRIB) requires counties to set county priorities for projects and these projects are currently funded by HB 1176:   2010-Construction for 1.5 miles on NC-331 (Waverly Rd.) from EW-19 extending north 1/5 mile to EW-18 (Hubbard Rd.), Phase 2 NS 1.5 miles A237 (Phase I was slated for 2009) STP funds moved to 2011, estimate revised from $1.5M to $2.7M; 2011-Construction for 2.2 miles starting at NS-331 (Waverly Rd.) on EW-18 Hubbard Rd. extending east to US-177.  Includes $1,000,000.00 STP STP-136D(117)CO JP No. 22953(04) Dist#1, first priority (Phase I EW 2 miles); 2013-Engineering for one (1) bridge CN 169 N3120E018003 NBI 03168 82’  Pony Truss Span, 44’ I-BM, Span Dist#3, third priority, Engineering Kay County Phase 1 of Peckham Rd. 13.5 miles and two bridges.  Schieber mentioned Kay County is one of two counties out of the state that is receiving this type of funding.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Wilson approving Application for Permit No. 10-6 Line Installation on County Right-of-Way for the installation of poly flow lines underground between Wells Crossing under two roads-South Waverly St. and West Oakland Rd., located T25N R2E SW ¼  Sec 4, SE ¼  Sec. 5 NE ¼ of Sec. 8, Dist#1.  Motion carried to go out for sealed bid:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Wilson and seconded by Schieber approving paying ODOT Form 324a, Engineering Fees-BIA Bridge Right-of-Way Staking, Bridge and approaches over Chikaskia River .05 Miles south and 1.2 miles east of US-60/US-77-CN-137-$1,500.00. 

Motion carried to Table:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Wilson approving Contract for Supervision of Community Service between the Board of County Commissioners and Oklahoma Court Services, Inc.  Whereas, BOCC will appropriate certain funds to provide a Community Service Program for offenders sentenced by the Kay County District Court. 

Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Wilson and seconded by Schieber approving Interlocal Cooperative Agreement with Contiguous Counties (Noble County), Resolution 9, 10-50.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Wilson approving Election Board Secretary’s salary for August 2009.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.   

 

Motion was made by Schieber and seconded by Wilson noting the following Monthly Report for July 2009:  Court Clerk – Blackwell, Newkirk and Ponca City offices.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Wilson and seconded by Schieber approving the following Resolution to Dispose of Equipment:  Res#9, 10-44, Assessor’s office, Laser printer, H-205-42, SN#SCNCN109992, surplus, PO#783-$50.00; Res#9, 10-45, Assessor’s office, Data hanging file cabinet, H-109-05, Model #24-38L, junked.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Schieber and seconded by Wilson approving the following Resolutions to Deposit:  Res#9, 10-41, Highway Dist#1-$47,321.60, H 3101-85 Fountain Road Project; Res#9, 10-43, Highway Dist#1-$1,000.00, two road crossings, Permit #10-6.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

Motion was made by Wilson and seconded by Schieber approving the following Cash Fund Estimate of Needs and Request for Appropriation:  Sheriff’s Service Fee-$18,479.26; Sheriff’s Jail Cash-$54,805.39; Sheriff’s Commissary-$3,479.35.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye. 

 

 

 

Unscheduled public appearances:  Kay County Treasurer Christy Kennedy reminded officers of Charlie Adams Day on September 12, 2009.  Officers agreed to and will provide a kids moonwalk for that day.

Officers were asked to review their previous Estimate of Needs for FY 2009-2010 requests and make cuts where possible.  Each officer presented their adjustments to the commissioners for consideration.
