The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, May4, 2009, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on May 1, 2009, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Steve Austin called the meeting to order.  Those present were as follows:  Dee Schieber, Vice-Chairman; Laile Wilson, Member; Assistant District Attorney (ADA) Kristin Taylor; Christy Kennedy, Kay County Treasurer; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Steve Kelley, Kay County Undersheriff; Larry Klumpp, OSU Extension; Melissa Cottle, North Central Reporter; Charles Abbott, Blackwell Journal Tribune; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet). 

 

Chairman Austin led the Flag Salute.

 

Motion was made by Schieber and seconded by Wilson approving regular meeting minutes of April 27, 2009.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Motion was made by Wilson and seconded by Schieber approving Chairman Austin to Oklahoma Juvenile Affairs claim for March 2009 in the amount of $2,866.75.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Jail Issues:  Sheriff Van Hoesen reported the daily inmate count showing 132 and the April monthly average was 133; he said they would be making transports sometime this week.

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8.  Schieber mentioned the District meeting to be held Wednesday in Alva.  He said Evans and Associates received permit to close Pecan Road and work will begin Thursday.

 

Motion was made by Schieber and seconded by Wilson approving, upon approval of District Attorney, Emergency Transportation Revolving Fund Agreement, Dist#1 on the following Projects:  Project No. ETRCB8-36-3(05)09-$50,000.00; Proj. No. ETRCB8-36-2(06)09-$65,000.00; Proj. No. ETRCB8-36-1(02)09-$50,000.00; Proj. No. ETRCB8-36-1(03)09-$70,000.00; Proj. No. ETRCB8-36-2(07)09-$80,000.00; Proj. No. ETRCB8-36-3(04)09-$50,000.00.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Motion was made by Wilson and seconded by Schieber approving the lowest quote received to repair water damages done on the second and third floors of the courthouse by Rick Scott Construction in the amount of $12,548.00; Architect Troy Lewis prepared specifications for quote.  Judge Boyd told commissioners he would pay $8,000.00 toward this project and the commissioners agreed to pay $4,000.00.  The only other quote was received was by Sooner Construction in the amount of $16,500.00.  Motion carried:  Schieber, aye; Wilson, aye; Austin, abstained.

 

Motion was made by Schieber and seconded by Wilson to participate in the Residential or Recreational Property above Cleanup Criteria in Blackwell; Property owned by county is 801 W. Frisco.  This property was sampled and tested under the program following procedures specified in a Sampling and Analysis plan approved by the Oklahoma Department of Environmental Quality (ODEQ).  The results indicate that measured concentrations of arsenic, cadmium and/or lead in some portions of this property are above the cleanup levels established by ODEQ for Blackwell.  Recommendations are to remove yard soil from the affected area and replace with clean soil.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Larry Klumpp, OSU Estension, noted there will be a bi-annual meeting tonight at 7 p.m. to elect board of directors for the Kay County Free Fair.

 

 

Motion was made by Schieber and seconded by Wilson approving Chairman Austin to sign reimbursement for Election Board Secretary Salary for April 2009.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Motion was made by Wilson and seconded by Schieber approving the following Resolutions to Dispose of Equipment:  Res# 8, 9-163, Assessor’s Office, Ser#AS0417297796, County#HV-205-62, Battery back-up Smart 1500 UPC, junked; Res#8, 9-164, Sheriff’s Office, Ser#213417, Whelen strobe light bar, junked.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Motion was made by Schieber and seconded by Wilson approving the following Resolutions to deposit:  Res#8, 9-165, Highway Dist#2-$76.19, reimbursement one day of workers comp benefit; Res#8, 9-166, Highway Dist#1-$659.12, overpayment lease purchase.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.

 

Motion was made by Wilson and seconded by Schieber approving the following Cash Fund Estimate of Needs and Request for Appropriations:  Highway-$271,054.98 – D#1-$94,706.65; D#2-$91,300.72; D#3-$89,745.23; Highway Dist#2-$76.19; Highway Dist#1-$659.12; Sheriff’s Service Fee-$17,525.70; Sheriff’s Jail-$2,473.44; Sheriff’s Jail-$14,345.83.  Motion carried:  Schieber, aye; Wilson, aye; Austin, aye.
