Newkirk, Oklahoma

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, February 23, 2009, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma. Notice of the meeting was posted for public information on February 20, 2009, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Chairman Steve Austin called the meeting to order. Those present were as follows:

Dee Schieber, Vice-Chairman; Laile Wilson, Member; Carol Purdy, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Everette Van Hoesen, Kay County Sheriff; Bill Grose, Captain, Kay County Sheriff Department; Larry Klumpp, OSU Extension; Cheryl Howard, Kay County Election Board; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).

Chairman Austin led the Flag Salute.

Motion was made by Wilson and seconded by Schieber approving regular meeting minutes of February 17, 2009. Motion carried: Schieber, aye; Wilson, aye; Austin, aye.

Jail Issues: Sheriff Van Hoesen reported the daily inmate count showing 124 and noted six (6) inmates were taken to Department of Corrections (DOC) last Thursday.

Motion was made by Schieber and seconded by Wilson authorizing Chairman Austin to sign 2010 OSCHA Contract/Highway Safety Project Application. Captain Bill Grose told Commissioners this was a grant that provided funding for overtime worked enforcing traffic laws and driving under the influence. Motion carried: Schieber, aye; Wilson, aye; Austin, aye.

No discussion was made regarding Roads and Bridge Projects, Circuit Engineering District (CED) No. 8.

Motion was made by Austin and seconded by Schieber regarding a parcel of land off the north side of the Southwest Quarter Section 14 Township 29 North Range 3 East, 33 feet wide off the north side of the Southwest Quarter to be used for road purposes only owned by the Board of County Commissioners (BOCC), Kay County, Oklahoma, and stating the BOCC will maintain this road for public use. A warranty deed dated February 19, 1927, indicates it was deeded to BOCC, Kay County, Oklahoma. This situation, not knowing for certain who owned the road located between two property owners, was brought to the Commissioners attention by Jerry Edson. Motion carried: Schieber, aye; Wilson, aye; Austin, aye. (May refer to Exhibit A attached to minutes).

Motion was made by Wilson and seconded by Schieber to Table Development Permit Application Form Applicant Faulkner Exploration (for proposed development on lands located in a community with floodplain areas). Motion carried: Schieber, aye; Wilson, aye; Austin, aye.

Caleb Stone, Natural Resource Conservation Services (NRCS) explained how the EWP/ODOT Agreement will work. Stone said Commissioners signed an agreement to be sponsors with Oklahoma Department of Transportation (ODOT) on ODOT Projects. ODOT Projects are as follows: Chikaskia River log jam, Dry Creek Log Jam, Shoe Fly Creek Log Jam, and Tickle Railroad Slope Protection. ODOT went through FEMA and FEMA could not help with funding. ODOT will fund projects 30 percent vs. 25 percent normally used to help fund projects; ODOT will also do in-kind work and the Board of County Commissioners (BOCC) will not have to fund anything toward these projects nor will the BOCC have any obligations.

Motion was made by Schieber and seconded by Wilson approving Agreement between Bureau of Indian Affairs and Kay County, Casino Road Ponca City-$650,000.00, Cooperative Agreement between the Bureau of Indian Affairs and Kay County, Oklahoma.

Blue Star Road Construction Project State Highway 177 and EW 28.5 and commencing a half mile west. Motion carried: Schieber, aye; Wilson, aye; Austin, aye.

Motion was made by Wilson and seconded by Schieber approving on Programming Resolution Bridge 19A NBI09244 to be added to five year plan, Dist#2. Funded with 100 percent County Bridge and Road Improvement (CBRI) Funds through the Force Account. Replace bridge over East Bitter Creek, Location No. 36NE0040N3230004. Motion carried: Schieber, aye; Wilson, aye; Austin, aye.

Motion was made by Wilson and seconded by Schieber approving the following Resolutions to Dispose of Equipment: Res#8, 9-132, D#3, D3-301-9 1987 Chevrolet ¾ ton pickup, Serial#1GCGR24K1HS143485, surplus to be sold per sealed bid. Motion carried: Schieber, aye; Wilson, aye; Austin, aye.

Motion was made by Wilson and seconded by Schieber Tabling the following Resolutions to deposit: Res#8, 9-131, JFA Gross Revenue-Sales Tax Collections-$291,109.01/Cigarette Tax Collections-$2,588.95, Totaling $293,697.96. Motion carried: Schieber, aye; Wilson, aye; Austin, aye.

Motion was made by Wilson and seconded by Schieber approving the following Transfer of Appropriations: Election Board Travel $776.00/Maintenance-$500.00 Totaling $1,276.00 to Part-time. Motion carried: Schieber, aye; Wilson, aye; Austin, aye.

There were no Unscheduled Public Appearances.

Motion was made by Austin and seconded by Wilson accepting bid from Double Check Co., for removal/installation diesel fuel tanks at 1125 W. Motion was made by Austin and seconded by Schieber accepting bid from Hotsy of Oklahoma for clean burn waste oil furnace in the amount of $13,500.00 on Bid#2009-25 Clean Burn Waste Oil Furnace, Dist#2. Motion carried: Schieber, aye; Wilson, aye; Austin, aye.

Motion was made by Austin and seconded by Schieber accepting bid from Evans & Associates Construction Co., Inc. in the amount of $22,137.00 on Bid#2009-26 Concrete Boxes for L.A. Cann Road, Dist#2. Motion carried: Schieber, aye; Wilson, aye; Austin, aye.

Motion was made by Schieber and seconded by Wilson accepting bid from Hembree & Hodgson Construction in the amount of $25,000 on Bid#2009-27 Building Addition Ranch Drive Volunteer Fire Department. Motion carried: Schieber, aye; Wilson, aye; Austin, aye.
