The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, December 1, 2008, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on November 26, 2008, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Chairman Laile Wilson called the meeting to order.  Those present were as follows:

Vice-Chairman Steve Austin; Member Dee Schieber; District Attorney (DA) Mark Gibson; Christy Kennedy, Kay County Treasurer; Judy Barnes, Kay County Assessor; Carol Purdy, Kay County Assessor office; Everette Van Hoesen, Kay County Sheriff; Steve Kelly, Kay County Undersheriff; Larry Klumpp, OSU Extension; Charles Abbott, Blackwell Journal Tribune; Scott Cloud, Newkirk Herald Journal; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet). 

 

Motion was made by Schieber and seconded by Wilson approving regular meeting minutes of November 24, 2008.  Motion carried:  Schieber, aye; Austin, abstained; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving special meeting minutes of November 26, 2008.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber to enter into Executive Session, pursuant to Oklahoma Statutes Title 25 Section 307(B)(4), for the purpose of discussing litigation with the Assistant District Attorney on the Dilworth Development Inc. versus Kay County Board of County Commissioners.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin to reconvene into regular meeting.

Commissioner Wilson told audience the negotiations with Dilworth Development Inc. are ongoing but close to a settlement; Commissioners advised the District Attorney’s office to finalize some issues that are still pending.

 

Jail Issues:  Undersheriff Kelly reported the daily inmate count showing 124 and November monthly average showing 121.  Kelly said they finally have a Department of Corrections schedule with ten inmates being sent and two will be evaluated.

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Schieber reported road projects are completed except for painting; he said the temperature needs to be above 50 degrees before they can paint.

 

No action was taken on the Boundary and Annexation Survey.

 

Motion was made by Schieber and seconded by Austin approving Chairman Wilson to sign Reimbursement on Election Board Salary for the months of November 2008.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving 2009 NODA Reap Grants authorizing Steve Austin’s signature on the Certificate of Authorized Signatures form (Schieber and Wilson’s signature was approved in regular meeting on November 24, 2008).  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving Res#8, 9-90 Concerning Bridge Inspection Responsibility by Local Government for Compliance with National Bridge Inspection Standards-Choice for County Bridge Inspection Contracts

for March 2009-2011.  Commissioners choose a Circuit District if there is one available in area, bear 20 percent of the total bridge inspection cost with an 80 percent Federal match (Option 1, Circuit Engineering District #8).  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye

Motion was made by Schieber and seconded by Austin approving the following Cash Fund Estimate of Needs and Request for Appropriations:  Highway-$306,878.02.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving Commissioners Regular Meeting Dates for Calendar Year 2009.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

There were no unscheduled public appearances.
