The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, November 17, 2008, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on November 14, 2008, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Chairman Laile Wilson called the meeting to order.  Those present were as follows:  Vice-Chairman, Steve Austin; Member Dee Schieber; Assistant District Attorney (ADA) Jennifer Layton; Carol Purdy, Kay County Assessor office; Everette Van Hoesen, Kay County Sheriff; Steve Kelly, Kay County Undersheriff; Larry Klumpp, OSU Extension; Charles Abbott, Blackwell Journal Tribune; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary; (see sign in sheet). 

 

Motion was made by Austin and seconded by Schieber approving regular meeting minutes of November 10, 2008.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin approving and authorizing Chairman to sign Office of Juvenile Affairs claim in the amount of $5,242.71.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Discussion and possible action was taken on litigation on Dilworth Development Inc. versus Kay County Board of County Commissioners.  Chairman Wilson directed the topic to ADA Jennifer Layton.  Layton said the decision the commissioners will need to make is whether or not to appeal for the second time the ruling of the Judge that appealed the regulations as unlawful.  Layton advised it is not a good decision to appeal again, but said it is for the commissioners to decide.  She said the Judge made his decision based on the legal interpretations according to the Statutes and two times he has made the same decision; the Judge followed the law and we cannot change the Statutes.

 

Schieber said the county could create a Resolution asking for a tipping fee.

 

Motion was made by Schieber and seconded by Austin advising the Kay County District Attorney’s office not to file an appeal but to continue negotiations with Dilworth Development Inc.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Jail Issues:  Undersheriff Steve Kelly reported the daily inmate count showing 128.  Kelly said it would be the first week in December before they are allowed to move DOC inmates.  He commented that bricks in the cells still need to be cemented in, water valves have been ordered at $200 a piece and around the middle of December jailers should be back to eight hour shifts.

 

ADA Layton reminded the Sheriff that the attorney for the Department of Health will be coming and she told the Sheriff that he or the Undersheriff or both should be available to go through the jail with him along with Commissioner Wilson.  She reiterated that the jail needs to be in good shape in order to make the attorney happy.

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Schieber said Donnie Head was inspecting his new bridge today; he also spoke about his Highland Project.

 

Motion was made by Wilson and seconded by Austin approving Assurances Relating to Real Property Acquisition on the following EWP Projects in Dist#3:  Rence Salt Fork; Chrysler Avenue; “O” Street and Fountain Road;  “O” Street Dike; Brake Road and Main Street; 29th Street.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Austin approving Application for Permit Line Installation on County Right-of-Way to install an overhead electric line located on 13th Street from “B” Street in Tonkawa across 13th, North 1325 feet and back across

13th Street at the Asbury Machine – line changes from 2400kv to 7200kv to satisfy new electrical requirements, Permit#09-14, Dist#3.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving Lease Purchase Agreement for Equipment on a Grader, Dist#2.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin noting the following October 2008 Monthly Reports:  Kay County Election Board.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving Resolution No. 78 to put up a sign on Fork Road designating it as “Memorial Parkway” (Hwy.77 & Pecan) in honor of all the veterans who gave their life serving our country.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving the following Resolutions to Dispose of Equipment:  Res#8, 9-79, Assessor’s Office, County#H-102-58 Chair, teal green, can not find; Res#8, 9-80, Assessor’s Office, County#H-105-39, Table on wheels, junked; Res#8, 9-81, Assessor’s Office, County#HV-205-20, Epperson Photo, junked.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin approving the following Resolutions to Deposit:  Res#8, 9-77, Public Building Authority-$1,408.84, November 2008 Rent.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving the following Transfer of Appropriations:  Sheriff Maintenance & Operation (M&O)-$7,000.00 to Overtime.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin approving Bid#2008-42 Repair/Preservation Deed Books-County Clerk.  Reese said she would accept half of the bid this fiscal year and half the next fiscal year.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

There were no unscheduled public appearances.
