Newkirk, OK  74647


The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, November 10, 2008, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on November 7, 2008, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Chairman Laile Wilson called the meeting to order.  Those present were as follows:  Vice-Chairman, Steve Austin; Member Dee Schieber; District Attorney Mark Gibson; Assistant District Attorney (ADA) Kristin Taylor; Judy Barnes, Kay County Assessor; Carol Purdy, Kay County Assessor office; Everette Van Hoesen, Kay County Sheriff; Steve Kelly, Kay County Undersheriff; Larry Klumpp, OSU Extension; Joe Harris and Attorney Jon Ihrig, Kay Electric Cooperative; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary; (see sign in sheet). 


Motion was made by Austin and seconded by Schieber approving regular meeting minutes of November 3, 2008.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.


HealthChoice Representatives Sue Comby-Young and Tricia Parker gave a brief presentation and answered questions pertaining to county coverage’s.


Motion was made by Schieber and seconded by Austin Tabling entering into Executive Session, pursuant to Oklahoma Statutes Title 25 Section 307(B)(4), for the purpose of discussing litigation with the Assistant District Attorney on the Dilworth Development Inc. versus Kay County Board of County Commissioners.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.


No action was taken on a Resolution to encourage the Kay County Commission to proceed to work with the City of Newkirk and to engage in all action reasonably necessary to expeditiously cause the annexation of the proposed new jail site into the city limits of Newkirk, including the providing of utility services.


DA Gibson stated the Board of County Commissioners (BOCC) has no authority of how the Justice Facilities Authority (JFA) spends money; he said the BOCC can not commit to anything on expenditures for the jail.  The Resolution would simply be to encourage annexation only.


Wilson asked Gibson if the City of Newkirk annexes the new jail site location would the JFA still be able to look at other utility providers.


Gibson answered the City of Newkirk can annex anytime they want and the annexation does not bind anyone to the City of Newkirk.  He said they can only contract on a year to year basis; no long term contract or commitment.


Gibson reiterated the Resolution should only read to express support or encouragement.


Jail Issues:  Sheriff Van Hoesen reported the daily inmate count showing 117. 


Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Schieber said his Highland Project has been delayed due to weather.


Motion was made by Austin and seconded by Schieber approving application for 216 Project through the Natural Resources Conservation Service, Dist#2.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.


Motion was made by Schieber and seconded by Austin approving ODOT claim in the amount of $150,000.00 LA Cann Lake access money, Dist#1.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.


Motion was made by Schieber and seconded by Austin noting Treasurer’s October Monthly Fee Report.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

Motion was made by Austin and seconded by Schieber approving the following Resolutions to Deposit:  Res#8, 9-73, Highway Dist#1-$800.00; Res#8, 9-74, Highway Dist#2-$2,000.00 Road Bore Permits; Res#8, 9-75, Emergency Management Agency-$14,300.00 Final Appropriation FY 2008/2009; Res#8, 9-76, Highway Dist#1-$200.00.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.


Motion was made by Schieber and seconded by Austin approving the following Cash Fund Estimate of Needs and Request for Appropriations:  Sheriff’s Jail Cash-$33,853.81; Sheriff’s Service Fee-$15,992.90; Treasurer’s Mortgage Certification-$685.00; Preservation Fee-$5,025.00; County Clerk Lien Fee-$1,511.75; Emergency Management Agency-$14,300.00.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.


Motion was made by Austin and seconded by Schieber to Table Bid#2008-42 Repair/Preservation Deed Books-County Clerk.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.


There were no unscheduled public appearances.
