Newkirk, OK  74647

 

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, November 3, 2008, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on October 31, 2008, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Chairman Laile Wilson called the meeting to order.  Those present were as follows:  Vice-Chairman, Steve Austin; Member Dee Schieber; Assistant District Attorney (ADA) Jennifer Layton; Judy Barnes, Kay County Assessor; Carol Purdy, Kay County Assessor office; Christy Kennedy, Kay County Treasurer; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Larry Klumpp, OSU Extension; Bruce Robinson, Chairman of the Justice Facilities Authority; Charles Abbott, Blackwell Journal Tribune; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary; (see sign in sheet). 

 

Motion was made by Austin and seconded by Schieber approving regular meeting minutes of October 27, 2008.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Discussion was made by Bruce Robinson, Chairman of the Justice Facilities Authority, to encourage the Kay County Commissioners to proceed to work with the City of Newkirk and to engage in all action reasonable necessary to expeditiously cause the annexation of the proposed new jail site into the city limits of Newkirk, including the providing of utility services as quickly as possible.  Robinson said the only way Newkirk can be considered for utilities is if they annex; Robinson will present a Resolution with proper wording to the Commissioners at a later date.

 

Commissioner Schieber commented he is ready to move forward with this matter.

 

Commissioner Wilson asked if other utility sources will be considered.  Robinson replied yes.

 

The subject will be on Agenda again next week.

 

Motion was made by Schieber and seconded by Austin to recess from regular meeting and enter into Executive Session to discuss litigation on Dilworth Development Inc. versus Kay County Board of County Commissioners.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber to return to regular meeting (9:30 a.m.).  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

ADA Jennifer Layton said an appeal was sent and the county lost every single regulation.  The Judge ruled the regulations were not according to law or allowed under statute. Other settlement options were discussed and the county will need to negotiate every settlement option.

 

Motion was made by Schieber and seconded by Austin to authorize the District Attorney to negotiate on final settlements.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber to go out for sealed bid on county property for oil and gas leases.  Austin said he has the legal descriptions for county property being considered.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Jail Issues:  Sheriff Van Hoesen reported the October monthly daily inmate count of 115 and the daily count showing 114.  He said 14 would be taken to Department of Corrections. 

 

ADA Layton informed Sheriff Van Hoesen the Department of Health will be coming to inspect the jail facility in mid-November.  Layton said Attorney Charles Broadway will be doing the inspection; Layton told the Sheriff to make him happy.  She said Broadway will be interested in the physical aspects of the jail.

 

Roads and Bridge Projects, Circuit Engineering District (CED) No. 8:  Commissioner Schieber said his “S” Street project is completed except for painting; he also commented on his LA Cann and White Eagle projects.

 

Motion was made by Schieber and seconded by Austin approving Agreement between Board of Kay County Commissioners and Eliza (Lydee) Scudder with remote terminal capabilities with the Assessor’s Office.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin approving application for 216 Project through the Natural Resources Conservation Service.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin approving the designated personnel as Requisitioning Officer/Receiving Agent/Inventory Clerks for District#1 various account for FY 2008-09.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving the following four (4) Road Crossing Permits boring county roads east of Braman installing gas pipeline, Dist#2, G.A.W. Oil Co., Inc.:  Permit #09-10, 28N 1W SW9; Permit #09-11, 28N 1W NW10; Permit#09-12, 28N 1W SW3; Permit#09-13, 28N 1W SW2.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Austin approving Application for Permit Line Installation, Permit#09-09 on County Right-of-Way to install an electric line overhead located from SE corner of West Grand and 44th Street north on 44th Street across US Hwy. 60.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving the following Resolutions to Dispose of Equipment:  Res#8, 9-71, Highway Dist#3, D3-203-3 Cannon P101-DIV Calculator, junked; Res#8, 9-72, Assessor’s Office, D201JSR1K104 Campaq & Kds, junked.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin approving the following Resolutions to Deposit:  Res#8, 9-65, Highway Dist#2-$22,000.00 FY08 Reap Contract #KA08-5 reimbursement for Peckham Volunteer Department for a truck bed; Res#8, 9-66, Child Abuse Prevention-$475.17, jury service donations; Res#8. 9-67, Highway Dist#1-$10,000.00, Fern Drive Project; Res#8, 9-68, Highway Dist#2-$327,299.15, BIA Kaw Tribe for LA Cann/Fork Road H3102-42; Res#8, 9-69, Highway Dist#1-$701,388.76, BIA for LA Cann Project H3101-79.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

Motion was made by Austin and seconded by Schieber accepting bid from Warren Cat in the amount of $176,520, six (6) year lease purchase on Bid#2008-41 Motor Grader Lease Purchase Dist#2.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.
