Newkirk, OK

 

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, July 14, 2008, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on July 11, 2008, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Chairman Wilson called the meeting to order.  Those present were as follows: Steve Austin, Vice-Chairman; Dee Schieber, Member; Mark Gibson, Kay County District Attorney (DA); Kristin Taylor, Assistant District Attorney; Christy Kennedy, Kay County Treasurer; Carol Purdy, Kay County Assessor Office; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Steve Kelly, Kay County Undersheriff; Carol Kellum, Kay County Election Board Secretary; Larry Klumpp, OSU Extension Office; Dusty Oxford, North Central Reporter; Charles Abbott, Blackwell Journal Tribune; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).

 

Motion was made by Austin and seconded by Schieber approving regular meeting minutes of July 7, 2008.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Before making the motion to enter into Executive Session regarding the County Sheriff, Schieber said he was the one who requested this Agenda item because he had things he wanted to discuss about the Sheriff.

 

Motion was made by Schieber and seconded by Austin to enter into Executive Session, pursuant to Oklahoma Statutes Title 25 Section 307(B)(4), for the purpose of discussing with the District Attorney possible investigation and action against the County Sheriff (9:05 a.m.).  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin to reconvene into the regular meeting (9:47 a.m.).  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Wilson commented no action was taken.

 

Dennis Bonewell, Emergency Management, explained to the Commissioners the Floodplain Violation committed by the City of Blackwell in the unincorporated are of Kay County.   Bonewell informed the Commissioners of the location and explained the problems and how it needs to be corrected.  Bonewell was seeking approval of the Commissioners before proceeding.

 

District Attorney Mark Gibson questioned why this action was presented before the Commissioners.  Gibson said the Board of County Commissioners has no roll in this; if this is criminal it needs to go to an investigative agency, such as the County Sheriff Department.

 

No action was taken.

 

Motion was made by Schieber and seconded by Austin approving the renewal of the Kay County Emergency Operations plan.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Jail Issues:  Sheriff Van Hoesen reported the daily inmate count showing 118.  Van Hoesen said windows need patched and boilers are not fixed.  Wilson told him to get the boiler units fixed.

 

No action was taken on Food Service Contract between Kay County and CBM Food Service for the Kay County Jail.

 

Motion was made by Wilson and seconded by Austin accepting Commissioners Real Estate Sale of Lot 12 Block 2 Peckham Addition, City of Blackwell by Ruth Huntington in the amount of $100.00.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Road and Bridge Projects, Circuit Engineering District (CED) No. 8:  Schieber mentioned upcoming meetings and projects and possible FEMA funds.

 

Motion was made by Schieber and seconded by Austin noting June 2008 Monthly Report on the following offices:  County Clerk; Public Health.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin noting Contracts/Agreements with Kellpro Computers and Kay County for the County Clerk’s office.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving “Memo” on approval of Electronic Signatures when paying all county disbursements.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving Contract with Flying Out Construction for courthouse roof project.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin approving the following Resolutions for Disposing of Equipment:  Res#8, 9-13, Court Clerk, Minolta Microfilm Scanner, junked.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving the following Resolutions to deposit:  Res#8, 9-12, Highway D#2-$62,200.00, Project#CB-136D(167) J/P No. 25289 (04) to rebuild bridge-materials, equipment and labor.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Austin approving the following Cash Fund Estimate of Needs and Request for Appropriations:  Visual Inspection Reimbursement-$4,348.16; Visual Inspection Reimbursement-$736.99; Treasurer’s Mortgage Certification-$910.00.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Motion was made by Austin and seconded by Schieber approving the following Transfer of Appropriations:  Sheriff Maintenance & Operations (M&O)-$5,000.00 to Overtime; Preservation Fee Capital Outlay-$18,280.51 to M&O; County Clerk Travel-$618.50 to M&O.  Motion carried:  Schieber, aye; Austin, aye; Wilson, aye.

 

Unscheduled public appearances:  Kay County Treasurer Christy Kennedy announced that Red Cross would be at the Courthouse Thursday, July 17, 2008, from 10 a.m. – 2 p.m. for a blood drive.  Kennedy said Butch Wolfe expressed his thanks to all the County Officials for working at the Newkirk Independence Day festivities.
