The Board of County Commissioners of Kay
County, Oklahoma, met in regular session at
Chairman Wilson called the meeting to
order. Those present were as follows: Peggy
Ennis, Vice-Chairman; Dee Schieber, Member; Judy Barnes, Kay County Assessor; Christy
Kennedy, Kay County Treasurer; Everette Van Hoesen, Kay County Sheriff; Kay
County District Attorney (DA) Mark Gibson; Scott Cloud, Newkirk Herald Journal;
Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see
sign in sheet).
Motion was made by Schieber and seconded by
Ennis approving regular meeting minutes of
Bid specifications for the ladies restroom
renovation were tabled.
Commissioner Wilson asked DA Mark Gibson to
comment on item regarding possible appraisal and/or purchase of real property,
to include obtaining earnest money, for new jail location. Gibson simply said the board of commissioners
already acted on this item in a special meeting held on
Wilson stated the following item regarding Resolution and issuance of an Election Proclamation calling a countywide sales tax election for May 13, 2008, for the purpose of providing revenues to secure bonds, the proceeds of which shall be used to acquire real property, acquire, construct and equip a new Kay County Detention Facility; to provide operations and maintenance expenses for the new Kay County Detention Facility and undertake existing jail renovations for future use was acted on in a special meeting held on Friday.
Gibson
stated there needed to be clarification explaining the motion that was acted on
in the special meeting on

suggested tabling the Resolution until the next commissioners meeting on

Ennis and seconded by Schieber upon recommendation of DA Mark Gibson to enter into executive session, pursuant to Title
25 Section 307 (B) (1), to discuss the demotion, discipline or termination of
all janitorial staff. Motion

Motion was made by Schieber and seconded by
Ennis to reconvene into regular meeting (
Jail Issues: Sheriff Van Hoesen reported the
daily inmate count showing 114. Van
Hoesen said a window had been broken out over the weekend and a metal plate
would be welded over the opening.
Undersheriff Steve Kelly handed
Commissioners a Notice of Violation Investigation of Complaint 07-200 listing
specific deficiencies. Kelly asked
commissioners to sign. Deficiencies
listed: a) Single-service and single-use
articles may not be reused b) facility shall comply with state and local
sanitation and health codes c) floors shall be kept clean, dry and free of
hazardous substances d)lighting to be at least twenty foot candles. Motion was
made by Ennis and seconded by Schieber authorizing Chairman Wilson to sign,
upon approval of DA Mark Gibson. Motion

Road and Bridge Projects, Circuit
Engineering District (CED) No. 8:
Schieber said he would be meeting this week with Cowley County
Commissioners (Kansas) to discuss the access road to the future home of the
Ponca Tribe Casino.
Motion was made by Schieber and seconded by
Ennis approving an Agreement between the Board of County Commissioners and
‘Subscribers’ listed allowing remote terminal capabilities with the Assessor’s
Office: Rock Solid. Motion carried: Schieber, aye; Ennis, aye;
Courthouse roof: Commissioners said they wanted to make sure
re-caulking the windows in the bay area was included in the already approved
contract.

Ennis noting the following January 2008 Monthly Reports: Court Clerk – Newkirk Office, Blackwell and

Ennis approving the following Resolutions to Dispose of Equipment: Res#7, 8-171, Court Clerk, SN CNFB809848,

Motion was made by Ennis and seconded by
Schieber approving the following Resolutions to deposit: Res#7, 8-168, Drug Court, January 08 Adult
Drug Court-$3,187.50; Res#7, 8-169, Emergency Management, expenses for July
through September 2007, 4th quarter-$4,838.10; Res#7, 8-170, Highway Dist#1,
sale of scrap-$2,394.60. Motion

Motion was made by Ennis and seconded by
Schieber approving the following Cash Fund Estimate of Needs and Request for
Appropriation:

Schieber approving the following Transfer of Appropriations: Sheriff Jail Contract Services - $1,200.00 to
Maintenance; Sheriff Training Donation - $2,000.00 to Equipment. Motion carried: Schieber, aye; Ennis, aye;

No unscheduled public appearances were
made.

Former Sheriff Danny Johnstone appeared and
asked where the new jail was going to be located. Schieber said he does not think a sales tax
will pass if the voters do not know where the jail will be located; he stated
he did not understand why the cost for the Kay County Facility was so much
higher than other counties who are building a similar sized jail.
