Newkirk, Oklahoma 

 

The Board of County Commissioners of Kay County, Oklahoma, met in special session at 3:30 p.m., Thursday, December 20, 2007, in Commissioners Court located on the First Floor of the Kay County Courthouse in Newkirk, Oklahoma.Notice of the meeting was posted for public information on December 18, 2007, and Special Meeting Agenda was posted December 19, 2007, at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Schieber called the special meeting to order.Those present were as follows:Members Laile Wilson and First Deputy Peggy Ennis; Judy Barnes, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Everette Van Hoesen, Kay County Sheriff; First Assistant District Attorney (ADA) Will Clark; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign-in sheet).

 

ADA Clark, Sheriff Van Hoesen, and Commissioner Laile Wilson went to Oklahoma City on December 17, 2007 for a 10:00 a.m. hearing concerning fines on the county.

 

Clark said they arrived early in hopes of speaking with Charles Broadway, Oklahoma State of Health (OSDH) but he was not present and no witnesses have received subpoenas.

 

Clark reported the OSDH said the county was making progress in bringing the jail into compliance and Clark said he is hopeful by the next court date the case could be dismissed.The next hearing on the remanded issues is scheduled for May 13, 2008, at 10:00 a.m.

 

Clark said there is still significant money involved and reiterated the importance to keep working hard to get the jail in compliance.

 

Medical Expenses in the Kay County Jail:Clark said District Attorney Mark Gibson asked for this item to be placed on the agenda in order to make everyone aware of the Oklahoma Supreme Court Case dealing with the medical cost of prisoners in jail with pre-existing conditions and who is responsible for treatment.The answer is the county where the inmates are in custody.

 

Motion was made by Wilson and seconded by Ennis approving to pass Resolutions 7, 8-134 and 7, 8-135 using eminent domain to acquire land to complete the Low Water Bridge Project.Motion carried:Schieber, aye; Ennis, aye; Wilson, aye.

 

Motion was made by Ennis and seconded by Wilson approving accepting Bid#2007-48 Lease Purchase-Trackhoe, D#2 from Northern Equipment in the amount of $103,553.00.Motion carried:Schieber, aye; Ennis, aye; Wilson, aye.

 

Motion was amended by Ennis and seconded by Wilson approving accepting Bid#2007-48 Lease Purchase-Trackhoe, D#2 from Northern Equipment in the amount of $103,553.00, excluding the thumb option.Motion carried:Schieber, aye; Ennis, aye; Wilson, aye.

 

ADA Clark recommended entering into executive session pursuant to Title 25 Section 307(B)(4) regarding Kay County District Court Case Number CV-05-28PC, wherein The Board of County Commissioners are a party to the matter.Clark said Attorney Kim Carrier from Dilworth Landfill submitted an option for the county to consider concerning the landfill.

 

Motion was made by Wilson and seconded by Ennis to enter into executive session upon Clarkís recommendation at 3:58 p.m.Motion carried:Schieber, aye; Ennis, aye; Wilson, aye.
