Newkirk, Oklahoma

 

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, November 5, 2007, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on November 2, 2007, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Chairman Schieber called the meeting to order.  Those present were as follows: Dee Schieber, Chairman; Laile Wilson, Vice-Chairman; Wayne Leven, Member; Jennifer Layton, Assistant District Attorney (ADA); Judy Barnes, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Larry Klumpp, OSU Extension; Carol Kellum, Kay County Election Board Secretary; Senator David Myers; Charles Abbott, Blackwell Journal Tribune; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).   

 

Motion was made by Wilson and seconded by Leven approving regular meeting minutes of October 29, 2007.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Unscheduled public appearances:  Senator David Myers said he wanted to publicly recognize Wayne Leven for his many years of service to Kay County.  Myers said it is no easy task; he congratulated and thanked Leven from the State of Oklahoma and as a constituent of his.

 

Sheriff Van Hoesen reported a total count of 114 inmates in the Kay County facility and 7 inmates in the Osage County facility. 

 

Jail Issues:  Lighting and installation for county pod was discussed in detail.

 

Motion was made by Leven and seconded by Schieber for the Sheriff to pay for invoices from Osage and Grant County for housing Kay County inmates out of his funds; when Sheriff’s money is depleted the county general will transfer money to the Sheriff’s account.

 

Sheriff Van Hoesen presented Oklahoma Statutes 57 § 41, 51, 60 and 64 to the commissioners.  Van Hoesen said by the statutes the commissioners were responsible to pay for housing inmates in another facility through the general government fund.

 

ADA Jennifer Layton said she reviewed the Statutes and since the Sheriff is funded by the county the Sheriff can pay for out of his funds and any extra funds needed may be provided by the commissioners.

 

Schieber recommended the Sheriff taking care of the prisoners and suggested he get a purchase order for this invoice and get a purchase order in place for November.

 

Motion carried:  Schieber, aye; Leven, aye; Wilson, nay.

 

Road and Bridge Projects, Circuit Engineering District (CED) #8:   Schieber said Highland Drive should be finished in around three weeks.

 

Motion was made by Leven and seconded by Schieber appointing Peggy Ennis as First Deputy for District #2.  Leven said Ennis will attend commissioner meetings in order to keep updated on county business.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Wilson approving Requisitioning Officer’s-Peggy Ennis/Justin Parker; Receiving Agent’s-Amos Nash/Clifford Locke; and Inventory Clerk’s-Amos Nash/Clifford Locke for District #2.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

 

 

Motion was made by Wilson and seconded by Leven appointing Fred Horinek to the Flood Plain Board.  Wilson said Rick Jeans term expired and NRCS recommended Horinek.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Wilson approving to go out for bid for new control panels in the jail.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

No action was taken on off-site storage for the Election Board.  Carol Kellum, Election Board Secretary, said she is considering using Gary Bilger’s Mini-Storage Units to store ballots.

 

Motion was made by Schieber and seconded by Wilson approving Resolution No. 7, 8-104, Disposing of Equipment (Sheriff’s Department), Whelen Light Bar-249873, to be donated to Kildare Fire Department.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Wilson approving Resolutions to deposit:  Res# 7, 8-103, Child Abuse Prevention-$103.65, Jury Services Donations.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Wilson approving the following Cash Fund Estimate of Needs and Request for Appropriation:  Child Abuse Prevention-$103.65; Highway-$220,584.83; Preservation Fee-$5,305.00; County Clerk Lien Fee-$2,057.00; Sheriff’s Commissary-$783.23; Sheriff’s Training-$1,000.00; Sheriff’s Jail-$16,456.45; Sheriff’s Service Fee-$16,676.46.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Leven approving the following Transfer of Appropriations:  Sheriff Jail-Travel-$416.46/Capital Outlay-$500.00 to Contract-$916.46; General-Assessor Part-time-$500.00 to Visual Travel.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Unscheduled public appearances:  Carol Kellum, Election Board Secretary, said she received a telephone call from the Governor’s office and the Special Election for Kay County Commissioner, District #2 will be February 5, 2008-Primary Election and March 4, 2008-General Election.  The filing dates will be the same as the schools School Board Election.  The filing dates are December 3, 4, and 5, 2007.

 

Citizen Don Garrett asked for the commissioners to get an update on the Landfill situation from First Assistant District Attorney Will Clark.
