Newkirk, Oklahoma

 

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, June 18, 2007, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on June 15, 2007, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Chairman Schieber called the meeting to order.  Those present were as follows: Dee Schieber, Chairman; Laile Wilson, Vice-Chairman; Wayne Leven, Member; Will Clark, First Assistant District Attorney (ADA); Mary Ramey, Kay County Court Clerk; Judy Barnes, Kay County Assessor; Everette Van Hoesen, Kay County Sheriff; Carol Kellum, Kay County Election Board Secretary; Larry Klumpp, OSU Extension; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).   

 

Motion was made by Wilson and seconded by Leven approving regular meeting minutes of June 11, 2007.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Wilson approving Oklahoma Juvenile Claim in the amount of $4,108.86 for the month of May 2007.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Wilson to enter into executive session (9:03 a.m.) pursuant to Title 25 Section 307(B) (4) regarding Kay County District Court Case Number CV-05-28PC, wherein the Board of County Commissioners are a party to the matter, advised by Will Clark, ADA, who mentioned discussing the Civil Appeal that has been Reversed and Remanded pending litigation.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Wilson to reconvene to regular meeting (9:15 a.m.).  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Jail Issues:  Sheriff Van Hoesen reported the daily inmate count showing 126.  Van Hoesen said they still are without locks and hot water to the kitchen.  He also said the lights in the female pod are all out.

 

Leven asked the Sheriff to be contacting Sweepers about the locks and he said he would contact someone about the slider doors.

 

Motion was made by Leven and seconded by Wilson approving the following Resolutions to dispose of equipment, Dist#2:  Res#6, 7-218, D2-302-36 Truck Tractor Freightliner, Serial Number 1FUYDTB7RP417910, surplus; Res#6, 7-219, D2-302-75, Truck Tractor International 1995 Model 920, Serial Number 2HSFMAHR3SC054256, surplus; Res#6, 7-220, D2-301-21 Pick-up Ford 1992 Model F250, Serial Number 1FTEF25NINLA66356, surplus.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Leven approving the following Court Clerks May 2007 Monthly Reports:  Blackwell Division; Newkirk Office; Ponca City Division.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Wilson approving going out for bid on 2007-08 ballots.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Wilson approving going out for bid to sell three surplus vehicles-Truck Tractor Freightliner/Truck Tractor International 1995 Model 920/Pick-up Ford 1992 Model F250.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

No action was taken on 2007/2008 Property/Liability quote.

 

Motion was made by Leven and seconded by Wilson approving on Contract Renewal/Amendment between Clearwater Enterprises, L.L.C. (natural gas supplier) and Kay County Court House.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Leven approving LPA Agreement on Project BRF-136C (113) CO. J/P 22817(04) Kay County, plans, easements, procedures, and property rights.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Leven approving the following Resolutions to deposit:  Res#6, 7-214, Highway Cash Fund, Ponca Iron & Metal-$1,155.00 (sale of scrap metals), Dist#3; Res#6, 7-215, Drug Court Cash Fund, State of Oklahoma-$4,958.34, May/June 07 Drug Court; Res#6, 7-216, Highway Cash Fund, Eastman National Bank-$105.84, overpayment lease purchase, Dist#2 warehouse; Res#6, 7-217, Drug Court Cash Fund, Bridgeway, Inc.-$160.00/Bridgeway, Inc.-$50.00/Tangelar Falls-$200.00/ $1,060.00 (cash)/Drug Court Fee, User Fee, Supervisor Fee, & UA Fee payments, Total $1,470.00.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Wilson approving the following Cash Fund Estimate of Needs and Request for Appropriation:  Drug Court-$4,958.34.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Wilson approving the following Transfer of Appropriations:  Sheriff, Personal Service-$1,529.51, Travel-$2,156.94, Maintenance-$3,705.03 to Part-time-$758.34 and Overtime-$6,633.14; Sheriff Service Fee-Capital Outlay-$5,459.49 to Overtime; Highway, Dist#1-Capital Outlay-$3,500.00 to Personal Service; Health Department Cash Fund-Capital Outlay-$150,000.00 to Personal Services.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Discussion was made concerning the policies and procedures for accidents occurring in the courthouse.  ADA Clark recommended one central place to send in Accident Report to ACCO.  He said all county agencies, officials and employees should work together with County Clerk.  Clark said the person who witnesses an accident should write in the comment section on the ACCO form and each county employee should be prepared to make statement on the form.  All forms are to be finalized by the County Clerk’s office and the County Clerk’s office will mail and file the form.  Clark will prepare a policy and procedure on accidents to add to the Employee Personnel Policy Handbook.

 

Motion was made by Schieber and seconded by Leven accepting bid from Cummins Equipment on Bid#2007-39-Lease purchase, backhoe, Dist#1.  Schieber indicated the bid was selected because of the resale value and being able to interchange oil, filter, and parts.  Bid accepted on a 2005 John Deere 310SG backhoe, 305 hours, price $59,750.00.

Moved back to item discussing 2007-08 Property/Liability quote.  Discussion was made via phone call between Wayne Leven and Dusty Birdsong, ACCO.
