Newkirk, Oklahoma

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Wednesday, January 3, 2007, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma. Notice of the meeting was posted for public information on December 29, 2006 at 8:30 a.m. and the Amended Agenda with Change of Date was posted December 29, 2006 at 3:30 p.m. after receiving Governor Brad Henry’s Immediate Release stating that Tuesday, January 2, 2007, would be a National Day of mourning in memory of President Gerald R. Ford, posted at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Chairman Schieber called the meeting to order. Those present were as follows: Dee Schieber, Chairman; Laile Wilson, Vice-Chairman; Wayne Leven, Member; Pat Schieber, Treasurer; Judy Barnes, Assessor; Larry Klumpp, OSU Extension; Everette Van Hoesen, Sheriff; Will Clark, First Assistant District Attorney (ADA); Charles Abbott, Blackwell Journal Tribune; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).

Motion was made by Leven and seconded by Wilson approving regular meeting minutes of December 27, 2006. Motion carried: Schieber, aye; Leven, aye; Wilson, aye.

Motion was made by Wilson and seconded by Leven approving Claims for the following projects with Brawley Engineering Corp. (ODOT Form 324A): CR-136C(126) – District 1 – 80% Claim; BRF-136C(113)CO – District 3 – 80% Claim; BRF-136C(114)CO-District 2 – 80% Claim; BRF-136C(115)CO – District 2 – 80% Claim; BRF-136C(116)CO– District 2 – 80% Claim; (corrected from Agenda that read District 3 for Projects 114 through 116 should have read District 2). Motion carried: Schieber, aye; Leven, aye; Wilson, aye.

Motion was made by Leven and seconded by Wilson approving Chairman Schieber signing on Reimbursement for Election Board Secretary for the month of December 2006 in the amount of $3,937.84. Motion carried: Schieber, aye; Leven, aye; Wilson, aye.

Motion was made by Leven and seconded by Wilson to recess to enter into Kay County Home Finance Authority special meeting (9:21 a.m.). Motion carried: Schieber, aye; Leven, aye; Wilson, aye.

Motion was made by Wilson and seconded by Leven to reconvene into Commissioners regular meeting (9:31 a.m.). Motion carried: Schieber, aye; Leven, aye; Wilson, aye.

Motion was made by Wilson and seconded by Leven approving Application for Permit, Permit#07-27, to install a flow line from SW 21-25N-1W to NW 28-25W-1W, District #3. Motion carried: Schieber, aye; Leven, aye; Wilson, aye.

Jail Trust Authority: Special meeting tentatively set for Friday, January 12, 2007, at 1:30 p.m.

Motion was made by Wilson and seconded by Leven approving the following Cash Fund Estimate of Needs and Request for Appropriation: Highway - $228,698.16; Sheriff’s Commissary-$385.82; Sheriff’s Service Fee-$2,547.38; Sheriff’s Service Fee-$7,517.89; Sheriff’s Jail-$31,706.50. Motion carried: Schieber, aye; Leven, aye; Wilson, aye.

Motion was made by Schieber and seconded by Wilson approving the following Resolutions to deposit: Res#6, 7-119, Highway Cash Fund, $13,500.00, Resurface Kay Drive, Dist#1. Motion carried: Schieber, aye; Leven, aye; Wilson, aye.

Discussion was made on Addendum 2004-1 to Kay County Personnel Policy Handbook (Longevity Pay) and entirety will be further reviewed before making final decisions.

Unscheduled public appearances: Citizen Don Garrett directed a question to ADA Will Clark concerning the sealed jail judgment Case-87-308. Clark’s reply was a hearing in front of Judge Boyd will occur.
