Newkirk, Oklahoma

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, November 20, 2006, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on November 17, 2006, at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Vice-Chairman Schieber called the meeting to order.  Those present were as follows: Wayne Leven, Chairman (absent); Dee Schieber, Vice-Chairman; Laile Wilson, Member; Everette Van Hoesen, Sheriff; Judy Barnes, Assessor; Mary Ramey, Court Clerk; Pat Schieber, Treasurer; Wayne White, Newkirk Herald; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).   

Vice-Chairman Schieber suspended approval of minutes.

 

Road and Bridge Projects, Circuit Engineering District #8:  Commissioner Schieber announced that his bridge, “Big Snake Bridge” won Bridge of the Year.  Big Snake Bridge is located on Pecan and South Avenue.

 

Motion was made by Wilson and seconded by Schieber Tabling Application for Permit #07-25 to install a water line located 1905 South “S” Street crossing county road east to SW ¼ Section 22 T 27 R 1E for Beckridge, Inc., Dist#2.  Motion carried:  Schieber, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber approving Contract for Labor, custodial maintenance for the satellite location of the District Court in Ponca City, term of this contract period beginning January 1, 2007 and ending December 31, 2007.  Motion carried:  Schieber, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber Tabling Jail Trust Authority item.  Motion carried:  Schieber, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber approving Cash Fund Estimate of Needs and Request for Appropriation:  Emergency Management Agency-$13,500.00; Highway Cash Fund, BIA-$188,623.75, Dist#3; Highway Cash Fund, ODOT-$50,000.00, Dist#2.  Motion carried:  Schieber, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber noting the following October 2006 Monthly Reports:  Public Health; Treasurer; Court Clerk – Blackwell, Newkirk and Ponca City offices.  Motion carried:  Schieber, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber approving Amended Contract-New Rate Detention Services Agreement by and between Sac and Fox Nation and the Board of Kay County Commissioners.  Motion carried:  Schieber, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber approving Detention Services Agreement by and between Sequoyah Enterprises, Inc. and the Board of Kay County Commissioners.  Motion carried:  Schieber, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber approving Resolution #6, 7-105, Disposing of Equipment-Sheriff’s Department, Light bar (Model #9404, Serial #202277) to be transferred to River Road Fire Department.  Motion carried:  Schieber, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber the following Resolutions to deposit:  Res#6, 7-99, Highway Cash Fund-BIA-$188,623.75, Stink Creek Bridge Project, Dist#3; Res#6, 7-100, Highway Cash Fund-ODOT, Force Account-$50,000.00, Dist#2; Res#6, 7-101, Drug Court Cash Fund, State of Oklahoma-$10,416.65; Res#6, 7-103, Highway Cash Fund-$100.00, Road Crossing Permit, Dist#3; Res#6, 7-104, Emergency

 

 

Management Agency Cash Fund-$13,500.00, Final Appropriation FY06/07.  Motion carried:  Schieber, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber approving Kay 6 Water Line Extension, Resolution No. 6, 7-106.  The Board of Commissioners affirms its commitment to take all action within its power to facilitate the receipt of the assistance of community development funds if Kay County Commissioners is awarded a Community Development Block Grant, and upon receipt to administer said grant by the rules and regulations established by the United State of America, the State of Oklahoma, and all empowered agencies thereof.  Motion carried:  Schieber, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber Tabling Addendum 2004-1 to Kay

County Personnel Policy Handbook.  Motion carried:  Schieber, aye; Wilson, aye.

 

Unscheduled public appearances:  Judy Barnes mentioned centennial clock dedication on

November 30, 2006, at 11 a.m.  and December 4, 2006, 12-1 p.m. Courthouse closed

during this time for a potluck luncheon (luncheon will take the place of gifts being

exchanged between county offices).  Commissioner Schieber said the base for the clock

should be installed this week.  The cost of the clock was approximately $72,000.00 and

is being funded by Kaw Nation.

 

Sheriff reported 113 inmates as the present jail count.

 

Treasurer Pat Schieber said she will check her records to verify which officers have paid their annual county officer dues.  Dues help pay for courthouse special events like Leadership Groups, Christmas party, courthouse social functions, etc.

 

Commissioner Wilson referenced the article that was published in the Ponca City News on Sunday concerning the jail fines.  Sharon Rowen, Ponca City News said she interviewed Charles Broadway, General Counsel for the Oklahoma Department of Health.  Mr. Broadway said the jail has been out of compliance for the past 83 days and at any time he could issue an application for monetary penalties; each day the jail count is over the legal limit, another $500.00 could be assessed.  Mr. Broadway stated that if the county would have filed for a “Stay” and it was granted, then they would not be able to fine the county unless there was another court hearing. 

 

Commissioner Schieber asked Ms. Rowen to research the good side of a Jail Trust Authority, stating that she had researched the bad side of a Trust Authority; Schieber said he would like her to put just as much effort into researching the positive side.  Schieber said he thinks it’s who you put in charge and stressed the importance of getting component leadership.
