Newkirk, Oklahoma 

 

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, August 28, 2006, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on August 25, 2006, at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Leven called the meeting to order.  Those present were as follows: Wayne Leven, Chairman; Dee Schieber, Vice-Chairman; Laile Wilson, Member; Everette Van Hoesen, Sheriff; Judy Barnes, Assessor; Pat Schieber, Treasurer; Mark Gibson, District Attorney; Carolyn Kahle, KGBN; Wayne White, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).   

 

Motion was made by Wilson and seconded by Schieber approving minutes of August 21, 2006.  Motion carried:  Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Wilson approving special meeting minutes of August 24, 2006.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Jail Issues:  Mark Gibson, District Attorney, reported the county could possibly be fined $95,000.  Gibson said the county would appeal and should know the results by the end of the week.  Sheriff Van Hoesen reported daily count of 130 inmates and new problems in the jail.  Commissioners asked Van Hoesen to stay on top of problems, especially those the county was fined for, oversee the efforts and make sure things are getting done.  Commissioners have taken on several of the problem areas in the jail and have also taken over several of the bills.  Commissioners questioned Van Hoesen on his purchase of new cars.  Van Hoesen has purchased four new cars since January 2006 and wants to lease purchase three more.

 

No action was taken on lease purchase agreement on Sheriff’s vehicles.

 

Presentation by:  David S. Cummings, Baumert, Cummings, Hiatt & Young, Ponca City; J. Brent Clark, Floyd Law Firm, P.C., Norman, Oklahoma; and Ben Graves, Architects in Partnership, Norman, Oklahoma, talked to Commissioners about a jail trust authority and how it would be beneficial to the county.

 

Motion was made by Schieber and seconded by Wilson noting Requisitioning Officer/Receiving Agent/Inventory Clerk for County Clerk’s office.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber approving the following Applications for Permit in Dist#3:  Permit#07-09, install a gas pipeline into NW ¼ Sec 9 28N 2W from SW ¼ Sec 4 28N 2W; Permit#07-10, install a gas pipeline from SE ¼ Sec 9 28N 2W diagonally into NW ¼ Sec 15 28N 2W; Permit#07-11, install a gas pipeline from SW ¼ Sec 15 28N 2W into NW ¼ Sec 22 28N 2W; Permit#07-12, install a gas pipeline from SW ¼ Sec 22 28N 2W into NW ¼ Sec 27 28N 2W; Permit#07-13, install a gas pipeline from SE ¼ Sec 34 28N 2W into SW ¼ Sec 35 28N 2W; Permit#07-14, install a gas pipeline from NE ¼ Sec 2 27N 2W into NW ¼ Sec 1 27N 2W; Permit#07-15, install a gas pipeline from NE ¼ Sec 1 27N 2W into NW ¼ Sec 6 27N 1W.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Wilson approving the following Cash Fund Estimate of Needs and Request for Appropriation:  Sheriff’s Jail Cash Fund-$18,987.63; Sheriff’s Service Fee Cash Fund-$10,508.65; Sheriff’s Commissary Cash Fund-$1,709.78; Sheriff’s Service Fee Cash Fund-$625.00; Sheriff’s Grant Cash Fund-$3,257.00.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

 

 

 

Motion was made by Wilson and seconded by Schieber approving Resolution No. 6, 7-45, requesting to participate in the County Road Machinery and Equipment Revolving Fund, Dist#3.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Wilson approving the following Resolutions to dispose of equipment:  Res#6, 7-46, Assessor’s Office, Serial #KR312FB328, County #H-205-33, Flat Screen Monitor, junked; Res#6, 7-47, Court Clerk’s Office, County #J-105-18, Counter desk, junked; Res#6, 7-48, Court Clerk’s Office, several items-list attached, sold at County Auction on June 17, 2006; Res#6, 7-49, District Court, several items-list attached, surplus; Res#6, 7-50, Court Fund Board, several items-list attached, obsolete and surplus; Res#6, 7-51, Court Clerk’s Office, several items-list attached, to be sold by sealed bid; Res#6, 7-52, Sheriff’s Department, Serial #475F2WA417, radio, junked; Res#6, 7-53, Election Board, several items-list attached, junked.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber approving Chairman Leven to sign renewal of Gas Sales Agreement, Contract No. G.S. 2200 between Clearwater Enterprises, L.L.C. and Kay County Courthouse.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber approving Resolution#6, 7-54 to deposit $700.00 to Highway Cash Fund, Dist#3 (Permits 07-09 through 07-15).  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

The Estimated General Fund Budget FY2006-07 prepared by Dona Brown, Budget Maker was presented for review and given to Commissioners and each officer in attendance.
