The Board of County Commissioners of Kay
County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, March 20, 2006, in the Commissioners Court of the Kay
County Courthouse in Newkirk, Oklahoma. Notice of the meeting was posted for public
information on March 17, 2006, at the Courthouse
front door, Commissioners Court, and basement
handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.
Chairman Leven called the meeting to order. Those present were as follows: Wayne Leven, Chairman;
Dee Schieber, Vice-Chairman; Laile Wilson, Member; Joe.
R. Cary, Chairman Excise Board; Floyd Harden, Member Excise Board; Will Clark,
Assistant District Attorney, Judy Barnes, Assessor, Pat Schieber, Treasurer,
Everette Van Hoesen, Sheriff, Buddy Thomas, Under Sheriff; Scott Pemberton,
Deputy Sheriff; Carol Kellum, Election Board Secretary, Larry Klumpp and Chad
Otto, OSU Extension; Sharon Rowen, Ponca
City News; Tammy Reese, Kay
County Clerk/Secretary (see sign in sheet).
Motion was made by Wilson and seconded by Schieber approving
minutes of March 13, 2006.

Unscheduled public appearances:
Jim Gentry with Bulldog Bedliners briefly spoke about shower stalls and
kitchen needing maintenance and attention in jail.
Motion was made by Schieber and seconded by Wilson to approve and authorize Chairman Leven
to sign Oklahoma Juvenile Affairs Claim
in the amount of $1,961.96. Motion
carried: Schieber, aye; Leven, aye; Wilson, aye.
Motion was made by Wilson and seconded by
Schieber approving request to accept the SLA Grant Agreement with
Oklahoma Emergency Management and Kay County Emergency Management (KCEM) from
Dennis Bonewell, KCEM pending approval of Assistant District Attorney, Will
Clark. Motion carried: Schieber, aye; Leven, aye; Wilson,
aye.
No action was taken
on entering into Executive Session as per O.S.2001, 25§307.B.4 (Confidential communications between a public body and
its attorney concerning a pending investigation): a. Discuss
pending litigation Delagarza vs. Kay County – pursuit to Cross Claim against
Correctional Health Care Management, CJ-2004-157 (case settled).

and seconded by Schieber to approve and accept Agreement whereas the office of
the Kay County Assessor has records computerized and accessible – Agreement
between Board of County Commissioners of Kay
County, and Nicholson Auction
Co. Motion carried: Schieber, aye; Leven, aye; Wilson,
aye.

and seconded by Schieber to Table action on Insurance on Sheriff’s vehicles
(wrecked). Motion carried: Schieber, aye; Leven, aye; Wilson,

Table action on “NASCCO” Safety Incentive Awards Competition. Motion carried: Schieber, aye; Leven, aye; Wilson,
aye.
Motion was made by Wilson
and seconded by Schieber to Table action on Grant to construct a 140’ x 12.9’
standpipe, 45,000 LF waterline, allowing new users to both systems and
providing increased volume for better fire protection. Motion carried: Schieber, aye; Leven, aye; Wilson,
aye.
Motion was made by
Schieber and seconded by Wilson to approve
Contract for Labor to maintain grass and tress on property owned by Kay
County. The term of this contract
shall be for the
period of May 15, 2006 to October 15, 2006. Motion carried: Schieber, aye; Leven, aye; Wilson,
aye.

Wilson and seconded by Schieber to Table Warranty Deed between Board of County
Commissioners and Donna Broyles on Lots 25 and 26, Block 29, Original Town now
City of Newkirk, Kay County, State of Oklahoma.

approve Cash Fund Estimates of Needs and Request for Appropriation: Public Buildings Authority-Health Cash Fund,

Wilson and seconded by Schieber to approve Transfer of Appropriations with
changes: Highway Fund, Maintenance &
Operations-$300.00 to (changing Lease Purchase to TRAVEL), Dist#1; Sheriff
General, Personal-$2,300.00 to Over-time.

Discussion concerning ongoing jail problems and issues with the
Commissioners and what steps County can take to resolve the most serious of the
problems. The Commissioners, along with
other Officials and Assistant District Attorney, toured the jail to see first
hand the problems the County is facing. Will
Clark, Assistant District Attorney said he would draft a letter for the Sheriff
to send to the National Institute of Corrections asking them to come and do an assessment of the County Jail.
