Newkirk, Oklahoma

 

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, December 19, 2005, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on December 16, 2005, at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Wilson called the meeting to order.  Those present were as follows:  Wayne Leven, Vice-Chairman; Dee Schieber, Member; Pat Schieber, County Treasurer; Everette Van Hoesen, Sheriff; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).  

 

Motion was made by Schieber and seconded by Leven approving minutes of December 12, 2005.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Public comments were made by Albert Cooper concerning laying a salt water line in Dist#2.

 

Motion was made by Leven and seconded by Schieber to approve Chairman Wilson to sign Oklahoma Juvenile Affair Claim in the amount of $1,752.79.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Leven authorizing Eminent Domain (for construction of a new bridge) – A strip, piece or parcel of land lying in the NW ¼ of Section 1, T25N, R1W, I.M., in Kay County Oklahoma, being more particularly described by metes and bounds as follows:  Beginning at a point on the existing right-of-way line of the County Road which is 999.38 feet N89 21’47”E and 33.00 feet S00 38’13”E of the NW corner of said NW 1/4,; thence N89 21’47”E a distance of 201.88 feet; thence S00 38’13”E a distance of 37.00 feet; thence S89 21’47”W a distance of 201.88 feet; thence N00 38’13”W a distance of 37.00 feet to the point of the beginning.  And also a strip, piece or parcel of land lying in the NW ¼ of Section 1, T25N, R1W. I.M., in Kay County, Oklahoma, being more particularly described by metes and bounds as follows:  Beginning at a point on the existing right-of-way line of the County Road which is 1795.26 feet N89 21’47”E and 33.00 feet S00 38’13”E of the NW corner of said NW ¼; thence N89 21’47”E a distance of 54.72 feet; thence S55 17’43”E a distance of 66.05 feet; thence N00 38’13”W a distance of 37.00 feet to the point of the beginning.  Containing 0.18 acres, more or less, of new right-of-way.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber acknowledging the following Court Clerk’s November 2005 Monthly Reports:  Blackwell Division, Ponca City Division, Newkirk Division.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Leven approving Reimbursement for Election Board Secretary Salary for the month of November 2005, in the amount of $3935.14.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber to approve the following Cash Fund Estimate of Needs and Request for Appropriation:  Treasurer’s Mortgage Certification Cash Fund-&960.00 to Maintenance.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber to approve the following Transfer of Appropriation.  Sheriff Commissary Fund-Capital Outlay-$7,000.00 to Maintenance & Operation.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Leven to approve the following Resolutions: Res#5, 6-99, Disposing of Equipment Assessor’s Office-#H-205-08 Printer (junked).  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber to approve the following Resolutions:  Res#5, 6-98, Deposit to Highway Cash Fund, State of Oklahoma-Department of Emergency Management-$10,580.82 (Dist#1-$2,579.43, Dist#2-$6,659.09, Dist#3-$1,342.30)

 

Reimbursement State share of a Presidential Declared Disaster Grant for Debris Removal and Roads & Bridges.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Assistant District Attorney Will Clark commented that December 27th will be the date to have answer filed on the declaratory judgment filed against the county by landfill proponents, Dilworth Development.  The case has been assigned to Judge D. W. Boyd.

 

No action was taken on Payroll Claims with warrants to be released on December 22, 2005.
