Newkirk, Oklahoma

 

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, October 10, 2005, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on October 7, 2005, at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Wilson called the meeting to order.  Those present were as follows: Wayne Leven, Vice-Chairman; Dee Schieber, Member; Kay County District Attorney, Mark Gibson; Charles Abbott, Blackwell Journal Tribune; Wayne White, Newkirk Herald Journal; Rog Allen, KACY Radio; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).  

 

Motion was made by Leven and seconded by Schieber approving minutes of October 3, 2005.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Leven to recess to Courtroom A.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Leven to reconvene meeting.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Public comments were made by Jerry Johnston, Mayor of Braman.

 

Motion was made by Chairman Wilson to accept the longer version of the Proposed Landfill Regulations “Kay County Rural Solid Waste Management Regulations” (Dist#3).  Hearing no second motion died from lack of vote or acceptance.

 

Motion was made by Leven and seconded by Schieber to approve the newest set of the Proposed Landfill Regulations “County Regulations for Municipal Solid Waste Landfill Operations and Solid Waste Landfill Operations” (No. 4).  Copies of this new proposal were distributed to citizens in attendance.  Motion carried:  Schieber, aye; Leven, aye; Wilson, nay.

 

Motion was made by Schieber and seconded by Leven approving Chairman Wilson to sign Election Board Secretary Salary Reimbursement Claim for September 2005 in the amount of $3,935.14.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber to approve Contract between the Kay County Health Department and Ron Richards (approved as to form by Kay County District Attorney, Mark Gibson).  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Leven approving Application for Reimbursement on Jag Grant (Sheriff’s Department).  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber to approve Proposal by Correctional Health Care and Health Professionals LTD for Health Care Service for inmates (Sheriff’s Department).  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber to approve Engineering Contract on Bridge 248, $52,000.00, Dist#2.  This contract may be signed after one paragraph is corrected and approved as to form by District Attorney’s office.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber awarding bids for the work listed below:  BIA Project No. B0705010, Bridge and approaches over Spring Creek 1.8 miles west and 1.0 mile south of the Junction US77 and SH11 (Bridge Location No. 36e0150n3310002/NBI No. 05330/CN-83).  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber to table awarding bids for the work listed below:  BIA Project No. B0705020, Bridge and approaches over Deer Creek 2.5 miles north and 2.2 miles east on Newkirk (Bridge Location No. 36n3360e060005/NBI No. 06480/CN-245); BIA Project No. B0705030, Bridge and approaches over Bitter Creek, 5.0 miles east and 1.0 mile north of the Jct. of I-35 and US177 (Bridge Location No. 36e0040n3220006/NBI No. 06366/CN-19).  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber to approve and sign Claim for Engineering Fee for BRO-136D(029)CO for $4,600.00 from the CBR1F account.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

The following Claim was tabled until October 17, 2005:  Engineering Fee for BRF-13C(036)CO for $3,600.00 from the CBR1F account.

 

Motion was made by Leven and seconded by Schieber to approve Resolution (Res#5, 6-71) to use soft match to replace the 20% match for engineering fees for BRF-136C (113) CO, BRO-136D (174) CO, BRF-136C (115) CO, BRF-136C (116) CO, Dist#2.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber to approve awarding contracts to Plains Bridge Construction for constructing Bridge No. BO705010 - $316,804.53 (start date will be given when money is available).  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Leven acknowledging the following Monthly Reports for September 2005:  County Clerk; Treasurer’s Fee; Election Board.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber tabling the following Application for Permit Line Installation on County Right-of-Way:  Proposed installation-6” Water Line; location-22 feet north of the south line of Sec. 13, T-29-N, R-2-E Kay County, Permit #05-23; Proposed installation -3” Poly Gas Line, location-West Ditch Line from Earth Rd. to Ford Rd.,Lakeland has lease on Sec. 16, East Line Sec. 16-T28-R1W, Permit #05-24; Proposed installation – 3” Poly Gas Line, location-SW4 Sec. 15 T28N R1W to Sec. 4 – Sec. 16 T28N R1W, Permit #05-25.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber to sell the following used equipment, Dist#2, as follows:  One (1) 1977 Pickup Chevrolet Model C30 Serial# CCS347Z133820 and One (1) 1986 1 Ton Pickup Chevrolet Serial# 1GBJC34W7GJ127168 to Clifford Locke, Newkirk, OK in the amount of $100.00 each; One (1) 130G Caterpillar Motor Grader Serial#74V01121 to Dixie Surplus Machinery, Inc. in Pollock, LA in the amount of $22,678.00; One (1)  Hawkeye Belly Dump Trailer Serial# 1BJS53022F1001637 and One (1) Hawkeye Belly Dump Trailer Serial# 122085,876028 did not sell for bid offered and will sell in auction; One (1) Walk-In Cooler (part of old Hide Out Night Club fixtures) to Jim Stuever, Newkirk, OK in the amount of $100.00.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Leven to approve the following Cash Fund Estimate of Needs and Request for Appropriation:  Visual Inspection Reimbursement Cash Fund-$1,710.26 to Maintenance; Treasurer’s Mortgage Certification Cash Fund-$1,200.00 to Maintenance.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye. 

 

Motion was made by Leven and seconded by Schieber approving Amendment to Requisitioning Officer, Receiving Agent, Inventory Clerk and adding two (2) new accounts.  Accounts:  Kaw 3 Bridge Project-H3101-66 and Bridge 58 & Bridge 246 Project-H3101-67, Dist#1.  Requisitioning Officer-Dee Schieber, Receiving Agent-Joan Otto, Inventory Clerk-Joan Otto.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Leven and seconded by Schieber to table the following Resolutions: Res#5, 6-67, Deposit to Highway Cash Fund, Ross Group Construction-$200.00 Water Line Installation Permit, Dist#2; Res#5, 6-68, Deposit to Highway Cash Fund, Lakeland Pipeline-$100.00.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Leven to go out for bid to purchase the empty building west of the courthouse (FSA Building) and to sell the Rippit Quilt Shoppe Buidling (Masonic Lodge Building) in Newkirk.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

Motion was made by Schieber and seconded by Leven to approve going out for bid to provide Janitorial Service to the satellite location to the District Court office located in Ponca City.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.

 

No action was taken on the County Sales Tax issue; however, there was much discussion. 

 

The Commissioners met with each County Official and each official had the opportunity to express their concerns and needs regarding their office budget for the fiscal year 2005-06.  The Commissioners reviewed the requests, no final budget was approved.
