Newkirk, Oklahoma

 

The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, April 26, 2004, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on April 23, 2004 at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Schieber called the meeting to order.  Those present were as follows:  Dee Schieber, Chairman; Laile Wilson, Vice-Chairman; Rog Allen, KACY FM; Jacquelynn Schroeder, Ponca City News; Rosie McCombs, Deputy Assessor; Phil Ross, Assistant District Attorney; Glenda Emerson, Court Clerk; Pam Goodno, Kay County Clerk/Secretary; and Carrie Glaser, Deputy County Clerk.  Absent:  Wayne Leven, Member.

 

Motion was made by Wilson and seconded by Schieber approving minutes from the April 19, 2004 meeting.  Motion carried:  Schieber, aye; Wilson, aye.

 

Purchase and/or sale of property for storage – No action.

 

The Board discussed with Phil Ross, Assistant District Attorney, and with Dusty Birdsong, ACCO, the Kay County Drug & Alcohol Policy as it related to the Sheriff’s Deputy involved in collision with a deer.  The policy details why and when testing is to be done, and includes a section concerning Deputy Sheriffs.  The Board is to further review the policy.

 

Craig Countryman, Sheriff, discussed an issue with the Board concerning healthcare provided to an inmate.  Kay County is required to provide medical care for inmates and to pay for said care, but inmates can be expected to reimburse the county for said payments.

 

Motion was made by Wilson and seconded by Schieber approving resolution depositing funds into the Highway Cash Fund as follows:

            State of Oklahoma, ODOW - $52,547.06 (wt#100370697)

                        Reimbursement for boat ramp-District #1

            Mike Graham Auctioneers - $1840.00 (ck#6988)

                        Sale of mower at CED Auction-District #1

            Mike Graham Auctioneers - $68,540.00 (ck#6958)

                        Sale of 2 trucks at CED Auction-District #3

Motion was made by Wilson and seconded by Schieber approving resolution disposing of the following equipment listed on the District #1 inventory:

            John Deere Flexwing Mower – Sold at CED Auction, $2000.00 less commission

Motion was made by Wilson and seconded by Schieber approving the following cash fund appropriation:

            Highway Cash Fund - $122,927.06

Motion carried:  Schieber, aye; Wilson, aye.

 

Motion was made by Wilson and seconded by Schieber approving letters to Senator Morgan and Senator Capps requesting help in securing state funds from ODCEM for the January 2002 Ice Storm, FEMA-1401-DR-OK and the December 2000/January 2001 Snow Storm, FEMA-1355-DR-OK.  Motion carried:  Schieber, aye; Wilson, aye.  (Exhibits A & B)

 

Motion was made by Schieber and seconded by Wilson approving Line Permit Application submitted by Rural Water District #71, Osage County, for installation of water line near SE/4 24-28-R3E and NE/4 25-28-R3E.  Motion carried:  Schieber, aye; Wilson, aye.  (Permit #04-09)

 

Motion was made by Schieber and seconded by Wilson approving contract between Kay County and BK&L Engineering for Phase II Washunga Road Project in the amount of $27,000.00.  Motion carried:  Schieber, aye; Wilson, aye.  (Project file)

 

Under new business, motion was made by Schieber and seconded by Wilson approving agreement between Kay County and the BIA for the construction of the old Arkansas River Bridge, known as the Arkansas River Bridge Project, in the amount of $2,000,000.00.  Motion carried:  Schieber, aye; Wilson, aye.

 

Glenda Emerson, Court Clerk, discussed with the Board an omission she had made concerning a pre-tax deduction.  She had discussed the issue with a representative of Aflac, the vendor, and was told that Kay County would have to authorize the correction.  Pam Goodno, County Clerk, stated that cafeteria plans are regulated by the IRS which only allow for changes during option period unless there is a qualifying family status event.  Phil Ross, Assistant District Attorney, advised that this was not a legal question, but a policy question.  Another concern of the Board was that if one employee was allowed to make this change it would set a precedence that should be allowed to all employees.  Ms. Emerson stated that she was just asking for cooperation in correcting her error.  Commissioner Schieber informed Ms. Emerson that any action needed postponed until Commissioner Leven was present since the issue affected a policy set by Kay County as well as regulations set by the IRS.  Goodno stated she would contact the Aflac representative and IRS concerning the legality of such a change.  Ross advised it to be put on the next weeks agenda for the Board to take any action.

 

Also under new business, motion was made by Schieber and seconded by Wilson to go out for bids for the construction of a bridge over the Chikaskia River southeast of Tonkawa, Bridge #154 aka Gun Bridge.  Motion carried:  Schieber, aye; Wilson, aye.
