The Kay County Equalization Board met in Special Session on Tuesday, May 30, 2006 at 2:00 a.m. in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma. Notice of the meeting was posted on May 26, 2006, at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Chairman Cary called the meeting to order. Those present were as follows: Joe R. Cary, Chairman; Floyd Harden, Vice-Chairman; J. C. Estes, Member; Judy Barnes, Assessor; Tammy Reese, Secretary/Kay County Clerk.

Motion was made by Estes and seconded by Harden approving Special Session Minutes on May 23, 2006. Motion carried: Cary, aye; Estes, aye; Harden, aye.

Motion was made by Estes and seconded by Harden to sustain Current Market Value on Formal Appeal Decision for Mr. Robert Estep (no hearing Mr. Estep’s schedule didn’t allow); statute requires value to be reflected by the sale price. Motion carried: Cary, aye; Estes, aye; Harden, aye.

Motion was made by Harden and seconded by Estes to sustain Current Market Value on Formal Appeal (hearing was May 23, 2006) for Mr. S. Kirk Glasby, Consultant for Continental Carbon Company; the Board felt it was a reasonable valuation based on Pritchard & Abbott, Inc.’s valuation. Motion carried: Cary, aye; Estes, aye; Harden, aye.

Formal Appeal to the Kay County Board of Equalization hearings were heard as follows:

a) Mr. Ratliff, Ponca City, is appealing based on independent appraisal report by Inskeep Appraisal Co. and the purchase price of the land. After reviewing the assessments with Ms. Barnes, Mr. Ratliff realized he had the Market Value and the Assessed Value confused. Mr. Ratliff withdrew his request to appeal and stated that he was more than equally compensated.

b) Mr. Larry Depperschmidt, Ponca City, appealing because he feels the Market Value is too high based on the condition of home. He asked that the Board reevaluate the home considering these problem areas: flat roof, house sits in low spot and water comes in front door with heavy rains, windows need replaced, needs electrical work and the yard needs major work.

Motion was made by Estes and seconded by Harden to lower the Market Value of Mr. Depperschmidt’s property, based on condition of home. Motion carried: Cary, aye; Estes, aye; Harden, aye.

Motion was made by Estes and seconded by Harden to recess (3:45 p.m.) and reconvene at 4:30 p.m. Motion carried: Cary, aye; Estes, aye; Harden, aye.

4:30 p.m.

Motion was made by Harden and seconded by Estes to reconvene (4:30 p.m.). Motion carried: Cary, aye; Estes, aye; Harden, aye.

Motion was made by Estes and seconded by Harden noting and approving signing Formal Appeal Decisions made by Kay County Equalization Board on Mr. Harvey Hintergardt and Ms. Judy Rupp (decision reached in Special Session held on May 23, 2006) and Mr. Robert Estep, Mr. S. Kirk Glasby (Continental Carbon Co.), and Mr. Larry Depperschmidt. Motion carried: Cary, aye; Estes, aye; Harden, aye.

Motion was made by Estes and seconded by Harden to adjourn the 2006 Equalization Board (4:34 p.m.). Motion carried: Cary, aye; Estes, aye; Harden, aye.
