The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, July 30, 2018, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma. Notice of the meeting was posted for public information on July 25, 2018, at 8:50 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.
Chairman Shanks called the meeting to order. Those present were as follows: Paul Skidmore, Member; Brian Hermanson, District Attorney (DA); Susan Keen, Kay County Assessor; Kay County Sheriff, Steve Kelley; Michael Garcia, Courthouse Security Deputy; Dennis Bonewell, Emergency Management; Cheryl Howard, Kay County Election Board Secretary; John Wilson, Braman; Carson Creed, Blackwell; Claude Williams, Taxpayers for Transparency; Tammy Reese, Secretary/Kay County Clerk. Absent: Jack Godberson, Member. (See sign in sheet).
Chairman Jason Shanks led the Flag Salute.
Motion was made by Skidmore and seconded by Shanks approving regular meeting minutes of July 23, 2018. Motion carried: Shanks, aye; Skidmore, aye.
Agreement between Gregg Storage Warehouse and Kay County Election Board for two storage units: DA Hermanson stated he reviewed the contract and had concerns with language regarding a lien on property and being able to take possession and sell. DA Hermanson noted he would contact Gregg Storage and work out the language details.
Motion was made by Shanks and seconded by Skidmore Tabling Agreement between Gregg Storage Warehouse and Kay County Election Board for two storage units until language issues are settled on the agreement. Motion carried: Shanks, aye; Skidmore, aye.
Motion was made by Skidmore and seconded by Shanks approving Memorandum of Agreement by and between Newkirk Public School District to provide Behavioral Health Services to the students and/or families of students of the Newkirk-Braman Schools. Motion carried: Shanks, aye; Skidmore, aye.
Motion was made by Shanks and seconded by Skidmore approving Contract between Eastern Oklahoma Youth Services and Kay County for Juvenile Detention Services at Pittsburg County Regional Juvenile Detention Center, $38.97 per child per day. Motion carried: Shanks, aye; Skidmore, aye.
Communication equipment for courthouse security: Sheriff Kelley told about the hand-held radios the courthouse deputies are currently using and told they are able to communicate efficiently with these particular radios. He said he would like to have an antenna and repeater installed on the Coop Elevator and told that the Newkirk Fire Department is doing the same. Kelley said he had several quotes and the cost should be around $8,500.00 with the help of Newkirk Fire Department. He said to pay out of Courthouse Security Capital Outlay Account.
Motion was made by Skidmore and seconded by Shanks approving purchase of communication equipment for courthouse security and paying approximately $8,500.00 out of Courthouse Security Capital Outlay Account. Motion carried: Shanks, aye; Skidmore, aye.
Road and Bridge Projects/Circuit Engineering District (CED) No. 8 Road and Bridge Projects:
Commissioner Shanks noted crews were working on signs at LA Cann/River Rd., working in shop, mowing and will start blading weather permitting. He also told one courtroom is finished and working on the other.
Commissioner Skidmore said his crews have been ripping shale at Smethers Pit, hauling sand and shale to roads, hauling free rock from south of Ponca City to county roads, spraying and mowing intersections. He told Blue Sky has been putting up walls to the new building.
Motion was made by Skidmore and seconded by Shanks approving Memorandum of Understanding between Sumner County, KS and Dist#3 Kay County pertaining to Bridge 96081707140 (2.1 miles east of Hwy. 177) that lies on a state line. Skidmore said the road is maintained by Sumner County. Motion carried: Shanks, aye; Skidmore, aye.
New Business [As per 1991 O.S. 25 § 311.A.9 - ‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting.] None.
DA Hermanson left the meeting to attend court (9:15 a.m.). Commissioner Skidmore stepped out of the meeting and returned at 9:22 a.m.

10:00 a.m. - Opened Bid#2018-30 Labor & Equip to tear down and reconstruct old shop building, Dist#3: No Bids were received. Commissioner Skidmore said he was going to get a new scope of work and re-bid at a later time.
No action was taken on Bid#2018-30 Labor & Equip to tear down and reconstruct old shop building, Dist#3 because no bids were received.
