The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, July 2, 2018, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on June 29, 2018, at 8:50 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Member Paul Skidmore called the meeting to order.  Those present were as follows: Jack Godberson, Member; Brian Hermanson, District Attorney (DA); Susan Keen, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Carson Creed, Blackwell; John Wilson, Braman; Marvin Swopes, Citizen; Dorvin Constant, Citizen; Claude Williams, Taxpayers for Transparency; Tammy Reese, Secretary/Kay County Clerk.  (See sign in sheet).    Absent:  Jason Shanks, Chairman.

 

Member Paul Skidmore led the Flag Salute.

 

Motion was made by Godberson and seconded by Skidmore approving regular meeting minutes of June 25, 2018.  Motion carried:  Godberson, aye; Skidmore, aye.

 

Motion was made by Skidmore and seconded by Godberson approving to release county owned property and deed to City of Newkirk, Lots 17-23, Block 28, east Newkirk Addition.  Treasurer Kennedy explained this is property that did not sell at Resale and it was now owned by the county and it would be the county’s responsibility to mow and maintain.  She said the City of Newkirk wanted the property; she told they have done the same in the past for Ponca City, Blackwell, etc.  Godberson asked if they would get the property at no cost and Kennedy answered yes, if the BOCC approves deeding it to the City of Newkirk.   Motion carried:  Godberson, aye; Skidmore, aye.

 

Motion was made by Godberson and seconded by Skidmore approving on Contracts between FALCO Alarm Company of Stillwater and the Kay County Health Department’s Alarm System Monitoring Agreements.  Location Type:  Commercial/Temp for Ponca City and Blackwell offices and Commercial/Fire-Ponca City office. DA Hermanson approved as to form.  Motion carried:  Godberson, aye; Skidmore, aye.  

 

No action was taken on Service Agreement/Business Associate Agreement by and between the Kay County Health Department and R.K. Black, Inc., to have access to and/or to create Protected Health Information for the Blackwell and the Ponca City locations.

 

Motion was made by Skidmore and seconded by Godberson approving Participating Addendum with Kay County Health Department and Western States Contracting Alliance and National Association of State Procurement Officials (NASPO) for mail room equipment, services and support administered by the State of Arizona.  Motion carried:  Godberson, aye; Skidmore, aye. 

 

Motion was made by Skidmore and seconded by Godberson approving Memorandum of Agreement by and between the Kay County Health Department and Ponca City Public School District to provide Behavioral Health Services to the students and/or families of students.  Motion carried:  Godberson, aye; Skidmore, aye. 

 

Motion was made by Godberson and seconded by Skidmore approving Agreements between the BOCC and the following to have remote terminal capabilities with the Assessor’s office:  Moore Water Treatment; Tom Burg.  Motion carried:  Godberson, aye; Skidmore, aye.

 

Motion was made by Skidmore and seconded by Godberson approving Contract with Kay County for support services for the Mapping and Information Management System (MIMS) through the Kay County Assessor’s office, FY 2018-19.    Motion carried:  Godberson, aye; Skidmore, aye. 

 

Motion was made by Skidmore and seconded by Godberson approving Software Lease & Maintenance Agreement entered into by and between Kay County Treasurer and TM Consulting, FY 2018-19.  Motion carried:  Godberson, aye; Skidmore, aye. 

 

Motion was made by Godberson and seconded by Skidmore approving Reimbursement Claim for Election Board Secretary Salary for the month of June 2018.  Motion carried:  Godberson, aye; Skidmore, aye. 

 

Motion was made by Godberson and seconded by Skidmore approving and designating County Clerk Tammy Reese as the county official to compile the Schedule of Expenditures of Federal Awards (SEFA) Report by grant for FY 2017-2018.  Motion carried:  Godberson, aye; Skidmore, aye.

 

Quotes for janitorial services for the DHS building:  Calie Choate-$1,000 a month inside and $400 outside; Jack & Trudy Bagg-No Quote; JMS-No Quote.

 

Motion was made by Godberson and seconded by Skidmore approving Calie Choate-$1,000 a month inside and $400 outside Total-$1,400.00 a month for janitorial services for the DHS building.  Motion carried:  Godberson, aye; Skidmore, aye.

 

Road and Bridge Projects/Circuit Engineering District (CED) No.8 Road and Bridge Projects: Commissioner

Godberson said crews were blading, hauling materials and mowing ditches district wide.  Crews are also installing culvert on Tower Rd., pulling and trimming trees, cleaning ditches, boom mowing on several roads.  He also noted crews are mowing around Lake Ponca today in preparation for the 4th of July fireworks display.

 

Commissioner Skidmore said his crews have been weed eating, spraying ditches and bridges. He stated crews finished hauling dirt from “P” Street to roads, work continues on road signs, grading roads and hauling sand and shale; he noted crews put in a culvert on 29th south of Highway 60.  

 

Motion was made by Skidmore and seconded by Godberson approving Association of County Commissioners of Oklahoma (ACCO) annual dues for FY2019-$4,250.00.  Motion carried:  Godberson, aye; Skidmore, aye.

 

Motion was made by Skidmore and seconded by Godberson approving to void Res#18, 19-8, Resale Fund Salaries.  Treasurer Kennedy said a new procedure is in place and the Resolution is no longer needed.  Motion carried:  Godberson, aye; Skidmore, aye. 

 

Motion was made by Skidmore and seconded by Godberson approving Application for Financial Assistance and Affidavit of Financial Inability to Pay.  Motion carried:  Godberson, aye; Skidmore, aye. 

 

Motion was made by Skidmore and seconded by Godberson approving to go out for bid to tear down the old shop building at 1814 W. Dewey and to put it back up at new shop location, Dist#3.  Motion carried:  Godberson, aye; Skidmore, aye. 

 

Quotes for a 48’’ severe duty bucket, Dist#3:  Warren Cat-$12,356.99 (holds 1.74 cubic yard); Yellowhouse-$7,606.00 (holds 1.5 cubic yards); Kirby Smith-$11,450.00 (holds 1.87 cubic yards).  Commissioner Skidmore told the reason he is not going to accept the lowest quote is because the lowest cost holds the smallest amount and over time the 1.87 severe duty bucket will produce more material and be more efficient of time and less wear on equipment compared to the 1.5 cubic yard.

 

Motion was made by Skidmore and seconded by Godberson approving and accepting Kirby Smith-$11,450.00 (holds 1.87 cubic yards) for the 48” severe duty bucket, Dist#3.  Motion carried:  Godberson, aye; Skidmore, aye. 

 

Motion was made by Skidmore and seconded by Godberson approving Equipment Lease Renewal State FY2019/Res#18, 19-22 and Insurance Verification on equipment Kay County is leasing through the County Road Machinery and Equipment Revolving Fund, FY 2019.  Motion carried:  Godberson, aye; Skidmore, aye.

New Business [As per 1991 O.S. 25 § 311.A.9 - ‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting.]   Commissioner Skidmore said he has been receiving many calls regarding Hubbard Rd. and wanted to report he is waiting on the guard rails to be installed.

 

Commissioner Skidmore and DA Hermanson stepped out of the meeting.  Both returned and DA Hermanson left the meeting to attend court.
