The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, April 23, 2018, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on April 20, 2018, at 8:50 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

 

Chairman Jason Shanks called the meeting to order.  Those present were as follows: Jack Godberson, Member; Paul Skidmore, Member;  Shawna Taylor, Assistant District Attorney (ADA); Susan Keen, Kay County Assessor; Steve Kelley, Kay County Sheriff; Christy Kennedy, Kay County Treasurer; Dennis Bonewell, Emergency Management Director; John Wilson, Braman; Steven Rohde, Evans & Associates; Claude Williams, Taxpayers for Transparency; Tammy Reese, Secretary/Kay County Clerk.  (See sign in sheet).   

 

Chairman Jason Shanks led the Flag Salute.

 

Motion was made by Skidmore and seconded by Godberson approving regular meeting minutes of

April 16, 2018.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye.

 

Application for Financial Assistance and Affidavit of Financial Inability to Pay:  Chairman Shanks said the application indicated the person didn’t have any family.  Commissioner Skidmore said he spoke with Jim Roberts, Roberts and Son Funeral Home and was told there was no family.

 

Motion was made by Shanks and seconded by Godberson approving Application for Financial Assistance and Affidavit of Financial Inability to Pay.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye.

 

Motion was made by Skidmore and seconded by Godberson approving on Agreements between the BOCC and the following to have remote terminal capabilities with the Assessor’s office:  Arcadis US, Inc.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye.

 

Motion was made by Godberson and seconded by Shanks approving Contract for Services an Agreement by and between the Kay County Assessor’s Office, by and through the BOCC and Total Assessment Solutions Corp. (TASC) allowing TASC to do assessments on personal properties in Kay County.  Assessor Keen said this contract is presented each year and it is paid out of her budget.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by Godberson Tabling Trane Service Agreement for the air-chiller unit.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye. 

 

Motion was made by Skidmore and seconded by Godberson approving Detention Services Agreement by and between SAC and Fox Nation and the BOCC, $21.11 a day per child.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye. 

 

Allowing the City of Newkirk to put electrical outlets around the green electrical box located in the yard south of the Courthouse for a cost of approximately $300.00 with the City doing the work:  Shanks said the green box that sets in the yard once supplied electricity to the school.  He said the city would like to put in outlets and would do the work; Shanks was proposing for the county to pay the $300 and the city do the work.  Treasurer Kennedy asked who was requesting this, the county or the city.  Shanks said the city was but the county would use, for instance, on Charlie Adams Day when the county provides the inflatable outdoor activity.  Commissioner Godberson asked if this was strictly for Newkirk’s activities.  Kennedy questioned the county paying for this since it seemed to be more for the city’s use.  Dennis Bonewell said this box was not hooked to the courthouse and asked how the power was fed.  Skidmore asked if it was a transformer box.

 

Motion was made by Shanks approving the county to spend $300 to put electrical outlets around the green electrical box located in the yard south of the Courthouse with the City of Newkirk providing the work.  Motion died due to lack of a second.

 

 

 

 

Road and Bridge Projects/Circuit Engineering District (CED) No.8 Road and Bridge Projects: Commissioner Godberson stated crews are blading and hauling material to roads district wide, cutting trees on Coleman and Longwood Rds., boom mowing on Riverview and Bear Creek Rds., and patching asphalt holes on Hartford, Enterprise and Rockcliff Rds.

 

Commissioner Shanks said his crews were doing maintenance work in the shop.  He told crews are on Peckham Rd. blading, putting on rock and working on road repairs and will be on that road until all repairs are completed.

 

Commissioner Skidmore said his crews are doing ditch work at 108th & “N” Avenue and Earth Rd., hauling sand, grading roads, working on oil line and air in work pit in the new west shop, making trucks repairs and changing oil.

 

Motion was made by Skidmore and seconded by Godberson approving to go out for bid on the Six Month Bids for Commonly Used Items on the following items:  Asphalt; Bridge Materials; Grader Blades; Concrete; Road Rock; Culvert Pipe; Office Supplies Janitorial Supplies.  Clerk Reese asked BOCC to notify office of any needed changes to these bids before sending them out to bid.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye.

 

Motion was made by Skidmore and seconded by Godberson approving Contract with Circle “C” Paving Bid#2018-14 Chip & Seal, Dist#2.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye.

 

Motion was made by Skidmore and seconded by Godberson approving Resolution No. 17, 18-153, Contract Agreement Renewal Emergency and Transportation Revolving, ETR Fund, extension for the ETR Loan on Bid#2018-14 Chip & Seal, Dist#2.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by Godberson approving to purchase one or more new 672G Motor Grader on a five year Lease Purchase with warranty off State Wide Contract, Dist#3.  The language “or equivalent” as noted on Agenda was removed from the motion.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye.

 

Motion was made by Skidmore and seconded by Shanks approving Title Page on Existing NBI No’s, Bridge 1-NBI#11633 and Bridge 2-NBI#17985, Dist#2.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye. 

 

Motion was made by Skidmore and seconded by Godberson approving Resolution No. 17, 18-154 to authorize and create and account for the purposes of the office of the Kay County Clerk in office Change Account Fund.  Reese noted this practice has been in place under the authority of T19 O.S. § 682; creating Resolution for accounting records.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye. 

 

Motion was made by Shanks and seconded by Skidmore approving the following Public Service/Pipeline Crossing Line Installations:  Kay Electric Cooperative, NW4/NW4 S9 T27N R2E ending SW4/SW4 S4 T27N R2E, W. Brake Rd., Dist#2.   Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye. 

 

Motion was made by Godberson and seconded by Skidmore approving the following Resolutions to Deposit Funds:  Res#17, 18-152, Highway Dist#1-$198.90, sale of scrap tin.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye.

 

Motion was made by Shanks and seconded by Skidmore approving and awarding Bid#2018-15 Rock, Dist#2 (opened in BOCC meeting 4-9-18) to the highest bidder Dolese Bros. Co-$23.14 per ton.  Chairman Shanks said he spoke with the auditors regarding this bid because APAC-Central did not bid correct size and Burbank Materials was not clean enough and had up to ¾” rock instead of 5/8”. 

Auditors advised Shanks he had reasonable cause to choose the high bidder in this instance.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye.

 

 

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting.]  Dennis Bonewell told the BOCC he would be out of the office on Tuesday to attend Floodplain training for accreditation.

Motion was made by Godberson and seconded by Shanks approving and awarding the only bidder on Bid#2018-16 Asphalt Overlay (South Avenue), Dist#1 – Evans & Associate Construction Co., Inc.-$58,657.50.  Commissioner Godberson said this for a mile of 1” overlay with financial assistance from landowners.  Motion carried:  Shanks, aye; Godberson, aye; Skidmore, aye.
