The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, April 2, 2018, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma. Notice of the meeting was posted for public information on March 29, 2018, at 8:50 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.
Chairman Jason Shanks called the meeting to order. Those present were as follows: Jack Godberson, Member; Paul Skidmore, Member Brian Hermanson, District Attorney (DA); Janell Leaming, First Deputy Kay County Assessor; Dennis Bonewell, Emergency Management Director; Claude Williams, Taxpayers for Transparency; Cody Griesel, Newkirk Herald Journal; Tammy Reese, Secretary/Kay County Clerk. (See sign in sheet). Absent: Chairman Jason Shanks
Chairman Jason Shanks led the Flag Salute.
Motion was made by Skidmore and seconded by Godberson approving regular meeting minutes of
March 26, 2018. Motion carried: Shanks, abstained; Godberson, aye; Skidmore, aye.
Motion was made by Godberson and seconded by Skidmore approving Ad Valorem Reimbursement Fund, for loss of revenue due to exemption of new or expanded manufacturing facilities in 2016 for 2017 tax year. Ms. Leaming said this claim is for reimbursement on the Five Year Manufacturing Exemption Applications and money is divided the same as Ad Valorem collections. This claim is in the amount of $9,562,507.00. Motion carried: Shanks, aye; Godberson, aye; Skidmore, aye.
Motion was made by Shanks and seconded by Godberson approving on Agreements between the BOCC and the following to have remote terminal capabilities with the Assessor’s office: Schemmer. Motion carried: Godberson, aye; Skidmore, aye.
Motion was made by Skidmore and seconded by Godberson approving Agreement between Pictometry International Corp and Kay County for online services. DA Hermanson noted he approved as to form. First Deputy Janell Leaming, Kay County Assessor’s office, told this was the yearly agreement. Chairman Shanks asked the fund this was paid out of and Ms. Leaming said it is paid from the Assessor’s account. Motion carried: Shanks, aye; Godberson, aye; Skidmore, aye.
Motion was made by Skidmore and seconded by Godberson approving Reimbursement for Election Board Secretary Salary for the month of March 2018. Motion carried: Shanks, aye; Godberson, aye; Skidmore, aye.
Road and Bridge Projects/Circuit Engineering District (CED) No.8 Road and Bridge Projects: Commissioner Godberson stated crews are blading and hauling material to roads district wide, cleaning ditches and boom mowing on Prentice and Prospect, boom mowing on Coleman Rd., cutting trees on Rockcliff and Prentice, installed culvert pipe on “S” Silverdale Lane and did maintenance on a tandem dump truck.
Commissioner Shanks said his crews are taking out trees and building roads up on Gate Rd. and “T” Street. He said crews will move to Prentice and Bender Rds. and start taking out trees and pulling ditches. Shanks noted crews are also repairing damaged road areas to improve school bus travel.
Commissioner Skidmore said his crews are grading, hauling sand and shale to roads, ripping and screening shale at Redding pit, using the chipper/shredder cleaning up sites where trees have been cut, taking out trees on Earth Rd., working on culverts, putting out signs and picking up trash. Crews continue to work in shop servicing trucks and building and painting new barricades.
Motion was made by Skidmore and seconded by Godberson approving Bureau of Indian Affairs (BIA) Release of Claims on the following: Eight (8) Kaw Bridges; Hartford Rd.; Oakland Ave (west of Hwy. 156). Motion carried: Shanks, aye; Godberson, aye; Skidmore, aye.
Motion was made by Shanks and seconded by Godberson approving the following Public Service/Pipeline Crossing Line Installations: Dalton Cloud, SW4/SW4 S11 T25N R2E ending NE4/NE4 S15 T25N R2E, Pleasantview Rd. & Fountain Rd., D#1. Godberson said he was okay with them putting in a water line. Motion carried: Shanks, aye; Godberson, aye; Skidmore, aye.
Motion was made by Godberson and seconded by Skidmore approving the following Resolutions to Dispose of Equipment: Res#17, 18-142, Court Clerk-Elite 8300 Computer, sent back to AOC/MIS quit working properly. Motion carried: Shanks, aye; Godberson, aye; Skidmore, aye.
Motion was made by Skidmore and seconded by Shanks approving and awarding Bid#2018-13 Radiant Heaters, Dist#3 (opened in BOCC meeting on 3-19-18) to the only bidder Stolhand Heating & Air Conditioning, Inc.-$12,835.00. Commissioner Skidmore asked DA Hermanson opinion on the bidding process and DA Hermanson told stated he approved the process. Motion carried: Shanks, aye; Godberson, aye; Skidmore, aye.
Motion was made by Skidmore and seconded by Godberson approving the following Resolutions to Deposit Funds: Res#17, 18-139, Highway Dist#1-$500.00, Public Service/Pipeline Crossing Line Installation; Res#17, 18-140, Highway Dist#2-$6,137.50, BIA Maintenance Agreement FY17-18; Res#17, 18-141, Highway Dist#2-$247.68, overpayment on Purchase Order 4672; Res#17, 18-143, Highway Dist#3-$1,635.40, sale of unprepared #2 HMS. Motion carried: Shanks, aye; Godberson, aye; Skidmore, aye.

DA Hermanson left to attend court.
